(a) declare that, on and after a date to be named in such proclamation, this Act shall apply to such village;

(b) define the boundaries of such village to which this Act is to apply;

(c) appoint three commissioners for such village for the carrying out of the purposes of this Act.

(2) The Commissioners appointed by such proterm of office. clamation shall hold office as such until Commissioners are elected at the first annual meeting hereinafter mentioned.

15. The Commissioners appointed or elected under this Act and their successors in office shall be a body corporate under the name and title of "The Commissioners for the Village of.... .. under The

Village Supply Act, 1923," and shall be capable of suing and being sued in all Courts of Justice, of purchasing, acquiring and holding lands and tenements and all kinds of real and personal property for the use of such village for the purposes of this Act and of making and entering into such contracts as are necessary for the exercise of their corporate powers.

16. The Commissioners shall have a common seal, which shall be made of suitable metal, and shall have such device engraved upon it as the Commissioners may from time to time direct, and such seal shall be kept by the Clerk and Treasurer appointed by such Commissioners as hereinafter provided.

18. No person shall be qualified to serve as a Commissioner for a village under this Act, unless:—

(a) he is a British subject by birth or naturalization of the full age of twenty-one years and is an elector and ratepayer in such village under the provisions of this Act;

(b) has been a resident and ratepayer of such village for at least three years next prior to his appointment or nomination for such office.

20. All lands and erections thereon which were Lands, etc., at any time granted and conveyed or originally laid missioners. out or allotted to the village or to any person or persons or corporation in trust for the village or for the inhabitants thereof, or for any public use in the village, and any property heretofore declared by any Act of the Legislature to be the property of the village, shall upon the appointment of the Commissioners by the Governor-in-Council as in this Act provided, vest in such Commissioners and their successors in office for the use of the village and the inhabitants thereof.

Such Chairman shall hold office until the close of the next annual meeting of the electors or until after the next election of Commissioners.

23. The meetings of the Commissioners shall be held at such times and places as the Commissioners may by by-law determine.

(2) The Commissioner receiving the smallest number of votes at the first annual meeting shall retire at the second annual meeting.

(3) The Commissioner receiving the next smallest number of votes at the first annual meeting shall retire at the third annual meeting and at each annual meeting thereafter the senior Commissioner shall retire.

(4) All Commissioners shall hold office until their successors are sworn into office.

(2) Such election shall be held in the same manner as elections for Commissioners held at an annual meeting as herein provided.

(3) The person elected to fill any such vacancy shall serve in office for the remainder of the term of the Commissioner whose office he had been elected to fill.

26. A Commissioner may resign his office at any time by causing to be delivered to the Clerk a declaration under his hand of his intention to resign and on payment of a penalty of twenty-five dollars.

28. 31. (1) The electors present at an annual meet-Election of ing shall, after the presentation and disposal of the report of the Commissioners and of the financial statement, proceed to elect by secret ballot a Commissioner or Commissioners for the ensuing year.

printed, and such ballot shall thereupon be folded and handed by the person so voting to the Chairman, who shall deposit the same in the ballot box.

33. Every elector shall before voting if his right to vote at such meeting is challenged by a Commissioner or elector take the oath in form "D" in the schedule, which shall be administered by the Chairman.

34. When it appears to the Chairman that every elector entitled to vote at such election has voted he shall ask if there are any more electors who having not voted desire to do so and if there are no further electors desiring to vote he shall declare the poll closed.

35. (1) After the close of the poll the Chairman in the presence of each of the two scrutineers shall open the ballot box and examine the ballot papers and proceed to count the votes and shall declare the person or persons having the greatest number of votes elected.

(2) The Clerk shall after the votes are counted make up a written statement containing the following particulars:—

(a) the number of votes polled;

(b) the names of the person receiving votes and the number of votes received by each person.

(3) Such statement shall be signed by the Commissioners and by the Clerk and filed with the minutes of the meeting.

(4) Where on such election an equality of votes is found to exist between any two or more persons, and the addition of a vote would entitle any one or more of such persons to be declared elected, the Chairman shall give such casting or additional vote in favor of one or more of such candidates.

(5) If within three days after the day of election any elector requests a re-count of the votes cast at such election, the Clerk shall appoint a time within
