CHAPTER 105.

An Act to Enable the Town of Windsor and the Muni-
cipality of West Hants to Grant Money
for the Purpose of Erecting a Mem-

orial to Fallen Soldiers.

(Passed the 6th day of April, A. D., 1923).

Be it enacted by the Governor, Council, and Assembly, as follows:

1 The Town of Windsor is hereby authorized to grant a sum not exceeding fifteen hundred dollars, and the Municipality of West Hants a sum not exceeding one thousand dollars for the purpose of erecting at Windsor a memorial to soldiers in the County of Hants who fell in the Great War.

2. The sums granted for the purposes of this Act by the Town of Windsor and the Municipality of West Hants respectively shall be deemed to be sums required for the ordinary lawful purposes of the said town and the said municipality, and such sums shall be raised, levied and collected by or for the said town and the said municipality in the same manner and in all respects as other sums required for ordinary lawful purposes of the said town and said municipality are raised, levied and collected.

3. This Act shall not take effect as regards the Town of Windsor until the same is adopted by resolution passed by a meeting of the ratepayers of the town duly convened in accordance with the provisions of Sections 143 and 144 of the Towns' Incorporation Act.

4 A certificate under the hand of the Mayor and Town Clerk, and under the corporate seal of the Town of Windsor, of a resolution passed under the provisions of Section 3 of this Act and Sections 143 and 144 of the Towns' Incorporation Act, shall be conclusive evidence of the adoption of this Act, and of the passing of the said resolution.

5. Inasmuch as the Municipal Council of the said Special Munimunicipality has already voted the sum of one thous- unnecessary and dollars towards the erection of the said Memorial, ratified. it shall not be necessary for the said Municipal Council to convene any additional meeting of the said Council or to take any other steps to make this Act effective, and the action of the Municipal Council in voting the said sum of one thousand dollars for the purposes and in the manner aforesaid is hereby authorized, ratified and confirmed.

CHAPTER 106.

An Act to Enable the Town of Yarmouth to Borrow
Money to Provide for the Equipment and In-
stallation of a Pumping and Lighting
Plant for the Town of Yar-

mouth.

(Passed the 17th day of April, A. D., 1923).

Be it enacted by the Governor, Council, and Assembly, as follows:

1' The Town of Yarmouth is authorized to borrow Authority to or raise by way of loan on the credit of the Town of Yarmouth the sum of thirty thousand dollars for the purpose of the purchase and installation of a good and sufficient plant for the purpose of running the pumps at the Pumping Station of the said town, and for the purpose of lighting the streets, roads, highways, lanes, sidewalks, bridges, parks, squares, thoroughfares and public buildings of the Town of Yarmouth.

2. Where any money is borrowed or raised by the Sinking fund. issue and sale of debentures of the Town of Yarmouth under this Act, and the Municipal Debentures Act, 1914, as amended, the Council of the Town of Yarmouth shall provide for a sinking fund with respect to such debentures. The amount to be paid annually into the sinking fund shall not be less than one per centum of the aggregate amount of said debentures,

and shall not be more than the Council deems sufficient to provide for the payment of the debentures when the same are payable, and the first payment into such sinking fund shall be made within one year from the date of the debentures.

4. This Act shall not take effect until the same is adopted by the ratepayers of the said Town of Yarmouth, by resolution passed at a meeting duly convened in accordance with the provisions of Sections 143 and 144 of the Towns' Incorporation Act.

5. A certificate, under the hand of the Mayor and the Town Clerk, and under the corporate seal of the said Town of Yarmouth, of a resolution passed as aforesaid, shall be conclusive evidence of the adoption of the Act, and of the passing of the said resolution.

CHAPTER 107.

An Act to Enable the Town of Yarmouth to Borrow
Money to Redeem Maturing Debentures
and Amend Chapter 139, Acts of
1893.

(Passed the 17th day of April, A. D., 1923).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The Town of Yarmouth is authorized to borrow Authority to or raise by way of loan on the credit of the town a $380,000, to resum not exceeding the sum of three hundred and es. eighty thousand dollars ($380,000) for the purpose of redeeming debentures outstanding, as follows, that is to say:

(a) debentures of the town to the amount of three hundred and twenty-five thousand dollars issued under Chapter 139 of the Acts of 1893, and maturing on the First day of June, A. D., 1923;

(b) debentures of the town to the amount of twenty-five thousand dollars issued under Chapter 104 of the Acts of 1895, and maturing on the first day of June, A. D., 1923;

(c) debentures of the town to the amount of seven thousand dollars ($7000.00) issued under Chapter 107 of the Acts of 1900, and maturing on the first day of June, A. D., 1923.

2. Where any money is borrowed or raised by Sinking fund. the issue and sale of debentures of the Town of Yarmouth under this Act and the Municipal Debentures Act, 1914, as amended, the Council of the said town shall provide for a sinking fund with respect to such debentures, provided that the amount to be paid annually into such sinking fund shall not be less than one half of one per cent of the aggregate amount of such debentures, and shall not be more than the Council deems sufficient to provide for the payment of the debentures when the same are payable, and the first payment into such sinking fund shall be made within one year from the date of the debentures.

Sec. 12, Ch. 139 Acts 1893, repealed.

3. (1) The moneys accruing from the annual income of the water supply of the town from whatever source shall be appropriated and applied in the first place to discharge the current expenses incurred in the execution of the requirements of Chapter 139 of the Acts of 1893, and in the next place towards the payment of the half-yearly interest on the debentures issued under the authority of this Act, and in the next place towards the annual payment of the sinking fund provided for by this Act.

(2) Every sum required for

(a) interest on such debentures;

(b) the sinking fund so provided,

other than the sums provided for by the preceding sub-section shall be held to be sums required for the ordinary lawful purposes of the said town, and shall be raised, levied and collected in the same manner and in all respects as other sums required for the ordinary lawful purposes of the said town are raised, levied and collected.

4. From and after the first day of June, A.D., 1923, Section 12 of Chapter 139 of the Acts of 1893 is repealed.

CHAPTER 108.

An Act Respecting the Municipality of the County of Antigonish.

(Passed the 6th day of April, A. D., 1923).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Notwithstanding any of the provisions of Chapter 33 of the Acts of 1922, the Municipality of the County of Antigonish is hereby authorized and empowered to borrow from any Chartered Bank in Canada a sum not exceeding twenty-five thousand dollars to
