CHAPTER 81.

Authority to borrow $7,600.

Sinking fund.

An Act to Authorize the Town of Kentville to Borrow
Money for Water Purposes.

(Passed the 17th day of April, A. D., 1923).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The Town of Kentville is authorized to borrow or raise by way of loan on the credit of the town the sum of seven thousand six hundred dollars for the following purposes, that is to say:

(a) $985,00 for the purchase and laying down of a water pipe line from Oakdene Street through Oakland Subdivision to the residence of William Burgoyne;

(b) $3647.00 for the purchase and laying down of a water pipe line from Academy Street across Masters Park in the Town of Kentville;

(c) $1500.00 for the purchase and laying down of a water pipe on Belcher Street in the Town of Kentville;

(d) $743.00 for further extensions to the present water system in the Town of Kentville;

(e) $725.00 for a water meter in the Town of Kentville.

2. Where any money is borrowed or raised by the issue and sale of debentures of the town under this Act, and the Municipal Debentures Act, 1914, as amended, the Council of the Town of Kentville shall provide for a sinking fund with respect to such debentures. The amount to be paid annually into the sinking fund shall be not less than two per cent of the aggregate amount of said debentures, and shall not be more than an amount which the Council deems sufficient to provide for the payment of debentures when the same are payable, and the first

payment into such sinking fund shall be made within one year from the date of the debentures.

3. Every sum required for,

(a) interest on such debentures,

(b) the sinking fund so provided,

shall be held to be sums required for the ordinary lawful purposes of the town, and shall be raised, levied and collected in the same manner, and in all respects as other sums required for the ordinary lawful purposes of the town are raised, levied and collected.

4. For the purpose of Section 176 of Chapter deemed issued 51 of the Acts of 1887, as amended, debentures issued under authority under this Act shall be deemed to be issued under the authority of said Chapter 51.

After appropriating and applying the moneys Surplus income accruing from the annual income of the water supply how applied. from whatever source as directed in Section 176 of Chapter 51 of the Acts of 1887 as amended, any surplus shall in the next place be appropriated and applied towards payment into said sinking fund of the amount due the same, and in case there is no such surplus or it is not sufficient for the said payment into said sinking fund the amount required shall be made good and supplied by an annual assessment on the real and personal property in that portion of the Town of Kentville lying within the limits set forth in said Section 176 as amended, and the amount or sum of money which may be required for the purpose shall be estimated, assessed, rated and collected in the same manner and in all respects as the amount or sum of money which may be required to make good the deficiency mentioned in said Section 176 as amended is authorized to be estimated, assessed, rated and collected.

6. An Act to Amend Chapter 137, Acts of 1903, being the Sewerage Act of the Town of Kentville.

(Passed the 23rd day of April, A. D., 1923).

Be it enacted by the Governor, Council, and Assembly, as follows:-

1. Section 2 of Chapter 137 of the Acts of Nova Scotia, 1903, as amended by Chapter 101 of the Acts of Nova Scotia, 1921, is amended by adding thereto Sewerage dis- and including in the Sewerage District, the following trict enlarged. lands:-"Commencing at the north-east corner of Cornwallis Bridge, thence easterly by the north side of the Cornwallis River by its several courses to a point opposite Klondyke Avenue, thence northerly and easterly in a direct line to the north-west corner of lands owned and occupied by Frederick Eaton on Belcher Street, thence crossing Belcher Street to the corner of Belcher Street, and the west side of Mee Road, thence by the west side of the Mee Road northerly one hundred feet, thence westerly in a direct line to the north-west corner of lands known as the Campbell property, and occupied by Ivan Wagner, on the Campbell Road, thence westerly crossing the Campbell Road, and in a direct line to the north-west corner of lands now or formerly owned and occupied by Rufus Barnaby, known as the Chipman Lot on Oakdene Street, thence westerly crossing Oakdene Street, and in a direct line to a point onehundred and fifty feet south of the north west corner of lands of C. L. Baird, known as the George Beary place on Cornwallis Street, thence crossing Cornwallis Street at right angles with the street, thence southerly in a direct line to the north-west corner of lands known as the Exhibition Grounds on Exhibition Street, thence southerly by the west line of Exhibition Grounds to Meadow Street, and in a continuation of the same line to the Cornwallis River, thence by the Cornwallis River to the place of beginning, to be hereafter called the Northern Sewer Section of the Town of Kentville.”

2. Section 2 of Chapter 137 of the Acts of Nova Sec. 2, as Scotia, 1903, as amended by Chapter 101, Acts of Nova Ch. 101, 1921, Scotia, 1921, is amended by striking out the words in the first, second, third and fourth lines of said amendment, namely, "Thence northerly in a direct line to the south-west corner of lands of William MacIntosh, thence along the west line of said William MacIntosh's land," and substituting therefor, and in lieu thereof, the following words: "Thence westerly in a direct line to the south-west corner of lands of the Estate of Charles Dennison, thence northerly in a direct line to the south-west corner of lands of Kenneth Cook, thence northerly by Kenneth Cook's west line."

3. Section 3 of said Chapter 137 of the Acts of Section 3 1903 is amended by striking out the word "and" in the second line of said section, and adding thereto after the words "Western Section" in the said second line of said section the words "and a Northern Section."

4. Chapter 137 of the Acts of 1903 is further Section added. amended by adding thereto after Section 3 of said Act the following section: 3a. "That wherever the word "Section" or "Sections" is used in this Act, ed. or in any amendment thereof, referring to the Central, Eastern and Western Sections, the said word "Section" or "Sections" shall refer to and include the Northern Sewerage Section, and any other section or sections hereafter created in the Town of Kentville, as well as the sections now established in said Sewerage District."

An Act to Authorize the Town of Liverpool to Borrow

Money.

(Passed the 23rd day of April, A. D., 1923).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The Town of Liverpool is authorized to borrow or raise by way of loan on the credit of the town the following sums for the purposes mentioned respectively, that is to say—

(a) the sum of two thousand dollars for the purpose of redeeming the town's proportion of debentures issued by the Municipality of the County of Queens under Chapter 67 of the Act of 1894;

(b) the sum of two thousand dollars for the purpose of paying for improvements and additions to the Academy Building;

(c) the sum of two thousand five hundred dollars for the purpose of providing a new Strainer House in connection with the Town's Water Works System.

2. Where any money is borrowed or raised by the issue and sale of debentures of the town under this Act, and the Municipal Debentures Act, 1914, as amended, the Council of the town shall provide for a sinking fund with respect to the debentures. The amount to be paid annually into the sinking fund shall not be less than two and one half per centum of the aggregate amount of said debentures and shall not be more than the Council deems sufficient to provide for the payment of the debentures when the same are payable, and the first payment into such sinking fund shall be made within one year from the date of the debentures.
