cil shall determine, which debentures shall be issued by the Mayor, under the seal of the City, and signed by the Mayor and City Clerk. And to each of such debentures shall be attached coupons or warrants for the payment of the interest, which coupons shall be signed by the Mayor and City Clerk of the City of Sydney, or their names may be impressed on said coupons by machinery or stamps provided for that purpose, by and with the authority of the City Council of the said City.

3. Such debentures shall be sold for such sums Lien. as may be obtained therefor, and shall be a charge on all the property, real and personal, of the City, and its inhabitants, and the proceeds of such debentures shall be placed to the credit of the City, and shall be used only for the purposes mentioned in this Act.

4. The City Council shall annually add to the Intere: amount to be assessed and levied on the real and personal property in the City, for general expenses, a sufficient sum to pay the annual interest on such debentures.

5. The City Council shall annually add to the Sinking fund. general assessment to be levied on the ratepayers of the said City, subject to assessment, such sums as may by resolution be determined by the City Council for the purpose of providing a sinking fund for such debentures; not, however, in any case, to be less than two per cent of the amount borrowed under this Act, and such sums shall be rated and collected in the same manner and with the same remedies as other rates and taxes in the said City are rated and collected; and such sums, when collected, shall be deposited in some chartered bank, or trust company, in the Province of Nova Scotia, to be approved of by the Governor-inCouncil, on deposit, bearing interest, and such sums and interest thereon shall be used for the payment of the debentures issued under the provisions of this Act, and for no other purpose.

7. (a) such sums may be separately submitted at various times or all at one time as the Council shall determine, and a certificate under the hand of the Mayor and City Clerk and under the corporate seal of the City that such approval has been obtained for the borrowing of each or all of the said sums shall be conclusive evidence of that fact, and debentures may be issued for such sums as are approved

(b) it shall not be necessary to submit the questions of borrowing the amounts specified in Sub-sections "E" and "H" to such vote of ratepayers.

An Act to Amend Chapter 174, Acts 1903, entitled,
"An Act to Incorporate the City of Sydney,
and amending Acts.'

(Passed the 23rd day of April, A. D., 1923).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Chapter 174 of the Acts of 1903, entitled, "An Act to incorporate the City of Sydney," is amended as follows:

1. Section 190 is amended by striking out the word "six" in the ninth line of said section, and substituting the word "eight."

2. Section 366 is amended by adding thereto the following sub-section:

The City Council may appoint a Clerk of the Civil Court, who shall hold office during good behaviour and may fix the salary for same, which amount shall be included in the annual estimates.

3. Section 372 is amended by striking out all the words after the word "costs" in the seventh line thereof, and substituting therefor the following:

And where no penalty is provided in such by-law for the infraction of the same, every person found guilty of any infraction of such by-law shall for each such offence be liable to a penalty not exceeding fifty dollars ($50.00); and, in default of payment, to imprisonment for a period not exceeding three months."

4. Section 168 is amended by striking out the word "three" in the third line thereof, and substituting therefor the word "six."

5. The Assessment Rolls and Registrar's Lists of gistrars Lists Voters for the City of Sydney for the year 1923 are Legalized. hereby legalized and confirmed.

CHAPTER 72.

An Act to Amend Chapter 58 of the Acts of 1922,
Relating to the City of Sydney.

(Passed the 23rd day of April, A. D., 1923).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 4 of Chapter 58 of the Acts of 1922 is Section 4. amended by adding thereto the following:--“and shall have power to enter into a contract with any person or corporation undertaking such erection and construction by which such person or corporation may purchase water from the said City at such rates, tolls or charges as may be agreed upon by said person or corporation and the said City, notwithstanding any provision of Chapter 1 of the Acts of 1913 or of any other Act of the Legislature of Nova Scotia."

CHAPTER 73.

An Act Relating to the Town of Dartmouth.

(Passed the 23rd day of April, A. D., 1923).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The Town of Dartmouth is authorized to borrow Authority to or raise by way of loan on the credit of the said Town the sum of six thousand dollars for the purpose of making sewer and water connections with buildings in the Town.

2. Where any money is borrowed or raised by the Sinking fund. issue and sale of debentures of the Town of Dartmouth under this Act, and the Municipal Debentures Act, 1914, as amended, the Council of the said Town shall
