ORIGINAL INDENTURE OF GRANT dated the 8th December, 1628, 4th Charles I, from the Court of Wards and Liveries to Donough O'Brien, son and heir of Connor O'Brien of Lemenegh, County of Clare, deceased, from the Claimant's archives.

"This Indenture made the VIII daie of December, Anno Dãi 1628, and in the fourth year of the reigne "of our Soveraigne Lord Charles by the grace of God Kinge of England, Scotland, Frannce, and Ireland, "Defender of the Fayth, &c. Betweene the Honble Sr William Parsons, Knight and Barronett, Master of His "Mts Courte of Wards and Liuris in his said Kingdome of Ireland, Sr Richard Bolton, Knight, Lord Chiefe "Baron of His Mats Court of Excheq', His Mats Attorney of the said Courte of Wards and Liùries, &c., and "William Barker, Esq., His Mats Survey of the said Courte, for and in the name and behalfe of Or Sovraigne "Lord the Kinge of the one ptie, and Donogh O'Bryen, sonne and heire of Connor O'Bryen of Lemenegh in "the county of Clare, gentleman, deceased, of the other ptie, Whereas or said Sovraigne Lo: the Kinge is 66 agreed to graunt to the said heire a speciall livy to be had of and in all such lordshipps, mannors, lands, "tenemts, rents, reucons, services, and other hereditaments, with the appurtences wch to the said heire be "descended and come in use, possession, or reversion, from the said Connor O'Bryen, as in the said speciall lily more playnely is contained, nevertheless for that of said Sovraigne Lord the Kinge should not be the said heire hath delivd the day of the date hereof unto His Maties Court "of Wards, a wrytinge in pchmt intented, hereunder annexed in which the said Donogh O'Bryen "covenanteth grannteth and pmisseth by these psents that therein are contayned and specified All those "lopps, mannors, lands, tenemts, rents, reucons, services, and other hereditaments wch he the sd heire "willeth and intendeth to have out of His Mts hands or possession by the said speciall liury.

PROPOSITION XX.

To Prove that the said DONOUGH O'BRIEN died 10th January, 1634, leaving issue by his wife, Honora (the 'daughter of Richard Wingfield, of Robertstown, in the county of Limerick, Esq.), an eldest son, CONNOR (born 1617).

LETTERS OF ADMINISTRATION of the Goods, &c., of Donat als Donnough O'Brien, dated the 11th December, 1635, granted by the Archbishop of Armagh to Honora ny Bryen als Wingfield, the widow of said deceased, in the Claimant's possession.

To Prove that CONNOR died 1651, leaving issue by his wife, Mary (the daughter of Teige Roe Mc Mahon), an eldest son, DONOUGH, who was created a Baronet of the Kingdom of Ireland.

did convey the premises to the said John Mc Nemara and Terlagh Mc Mahon, their "heires and assigns, to the uses following. And the said claymts farther setting forth "that the said Connor and Mary, and the said feoffees, being of the premisses soe seised, he the said Connor (haveing issue the said Onora, his first daughter by him begotten upon the body of the said Mary in "November, in the yeare one thousand six hundred forty-five, and likewise his said second daughter Mary, "in the yeare one thousand six hundred and fifty), was killed in his Maieties service, by and after whose "death the premisses by the said deed limitted to the said Connor and Mary his wife, and the survivor of "them dureing life, came to the said Mary by survivorshipp, and the remainder thereof imediately expectant, "to the said Donough O'Bryen, as sonne and heire male of the said Connor, begotten on the body of the said "Mary and the said ffeoffees respectively of the respective premisses "continued soe seized untill they were dispossed thereof by the late usurped powers. Upon which pleadings the said cause proceeded to a finall "heareing, and was heard by this Court this present day, that is to say, Friday, the one and twentith day of August, in the fifteenth yeare of the King's Maiesties raigne that now is, in open Court, at the place comonly called the Kings Inns, Dublin, in the presence of the counsell on both sides learned in the law And "forasmuch as upon hearing of the said cause, upon the testimonies, proofs, and evidences produced before us, "It appeared unto the Court that the said claymant resorteth to the benefitt of articles as to the lands of "Smithstown and the impropriacon of the parish of Kilshanny aforesaid, And that the said Donnogh O'Bryen "was and is an innocent Protestant, and sonne and heire of his father, the said Connor O'Bryen
