AN ACT

To authorize the sale of School Section Sixteen, in the original surveyed Township Number Six, of range Number Seventeen, in Gallia County.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That section sixteen, in the original surveyed township number six, of range number seventeen, in Gallia county, be and the same is hereby authorized to be sold according to the provisions of the act entitled "an act to regulate the sale of ministerial and school lands, and the surrender of permanent leases thereto," passed February second, one thousand eight hundred and forty three.

AN ACT

To repeal the sixth, seventh, eighth and ninth sections, and so much of the tenth section of the act entitled "an act to provide for the sale of the Monroeville and Sandusky City Railroad, under the lien of the State, and to discharge the State of Ohio from all further liabilities to certain Railroad Companies therein named," passed March 11th, 1843, as shall be hereinafter specified.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the sixth, seventh, eighth and ninth sections of the act entitled "an act to provide for the sale of the Monroeville and Sandusky City Railroad, under the lien of the state, and to discharge the State of Ohio from all further liability to certain railroad companies therein named," passed March eleventh, one thousand eight hundred and forty three, be and the same is hereby repealed.

SEC. 2. That the latter clause of the tenth section of said act, in these words, "nor shall the state dividends be appropriated to the extension of said road," be hereby repealed.

SEC. 3. That the auditor of state be and he is hereby required to surrender to said companies any certificates of stock they may have deposited with him for interest on the stock set off to the state by said companies, under the provisions of the sixth and seventh sections of the above named

act.

SEC. 4. That this act shall take effect and be in force from and after its passage.

AN ACT

To authorize the Commissioners of Columbiana County to abolish the Board of Fund Commission. ers of said County.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That it shall and may be lawful for the commissioners of the county of Columbiana, at any regular meeting, by an order entered on their journals, to abolish the board of fund commissioners heretofore appointed by them, provided that the liability of said fund commissioners, on their bonds for acts done, shall not thereby be affected.

SEC. 2. That from and after the abolition of said board of fund commissioners, it shall be the duty of said county commissioners to act as a board of fund commissioners, who shall in all respects conform to the provisions of the act entitled "an act providing for the distribution and investment of this states' proportion of the surplus revenue," passed and took effect March twenty eighth, one thousand eight hundred and thirty seven, and the acts amendatory thereto.

AN ACT

To amend an act entitled "An act to incorporate the Dayton and Mad River Valley Turnpike Road

Company."

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the Dayton and Mad River Valley Turnpike Road Company, incorporated March thirteenth, one thousand eight hundred and forty three, may, in loca ting said road, omit making a point at George Crofts, as stipulated in said act of incorporation, and continue from Midway to the National Road by the route which to them may seem most practicable.

SEC. 2. The said company may, as soon as one hundred shares of stock are subscribed on the books opened for that purpose, extend their road, under the title and provisions of the aforesaid act of incorporation, by the most practicable to West Liberty, in Logan county; provided that no part of the stock subscribed on the present books of the company shall ever be applied to the construction of said extension.

SEC. 3. At no time shall there be elected, from stockholders who subscribed only to the extension, more than two directors of said company, and all dividends to holders of stock, from tolls received north and south of the National Road, shall be separately declared.

SEC. 4. That said company may increase their capital stock to the sum of fifty thousand dollars; that said company, and the corporators thereof, shall be subject to the provisions of all acts now in force, or which may be hereafter enacted for the purpose of governing and regulating turnpikes gener

ally, in this state, and also, "an act instituting proceedings against corporations not possessing banking powers and the visitorial powers of courts, and to provide for the regulation of corporations generally," passed March seventh, one thousand eight hundred and forty two.

AN ACT

To revive and continue the act to incorporate the Little Miami Railroad Company, passed March 11, 1836.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the charter of the Little Miami Railroad Company, be and the same is hereby revived and continued; and the additional term of five years, from the date of the passage of this act, is hereby allowed to said company for the purpose of completing said road, as provided in the original act to incorporate the said company, any thing in said act to the contrary notwithstanding.

SEC. 2. The capital stock of said company be and it is hereby extended to the sum of one million of dollars.

AN ACT

For the relief Mary K. Prentiss.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the superintendent of the Lunatic Asylum be and he is hereby authorized to consider the application of Mary K. Prentiss, of Summit county, for admission into said institution, in the same manner that he would by law be authorized to do, if the said Mary had been for one year a resident of this state.

AN ACT

To cede to the United States the jurisdiction of certain parcels of land, for the purpose of a Marine Hospital, situate in the City of Cleveland, in the county of Cuyahoga.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the jurisdiction of certain pieces or parcels of land, situate in the city of Cleveland, in the county of Cuyahoga, and state of Ohio, purchased by the United States of America, for the purpose of erecting a Marine Hospital thereon, and which are known and described by being city lots, numbers 183, 184, 185 and 186, in said city of Cleveland, containing in the aggregate, eight acres and fifty three hundredths of an acre, be and the same is hereby ceded to the United States of America for the use and purpose of a Marine Hospital; provided that the jurisdiction, so ceded, shall not extend so as to impede or prevent the execution of any process of law under the authority of this state, except so far as may affect any of the real or personal property of the United States, within the boundaries of the premises herein before described; and all the lands and tenements aforesaid, shall be and remain exempt from taxation, as long as the same continues the property of the United States.

AN ACT

To enable Charles E. Williams and Allen W. Gazlay to execute deeds of conveyance under certain restrictions.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That for the purpose of enabling the heirs at law, devisees and legatees of Elmor Williams, late of Hamilton county, deceased, to compromise, settle and adjust certain difficulties and disputes, growing out of the last will and testa. ment of the said Elmor Williams, that Charles E. Williams, aged sixteen years, son of Elmor Williams, deceased, and Allen W. Gazlay, aged fifteen years, son of James W. Gazlay, and grandson of the said Elmor Williams, deceased, are hereby authorized and empowered to make and execute any deed or deeds of conveyance, or other writing or writings, for any part of their or either of their interests in and to the estate of the said Elmor Williams, deceased, provided that the legal acting guardians of the said Charles E. Williams and Allen W. Gazlay, shall severally advise and counsel to the same, by duly signing and acknowledging such deed or deeds, or other writing or writings, executed and acknowledged in the manner provided for by the laws of the state of Ohio, which relate to the conveyance of land or real estate.

SEC. 2. That all other minors who are named in the last will and testament of the said Elmor Williams, or who are in any manner connected

as legatees or otherwise, or interested in the settlement of the estate of the said Elmor Williams, are hereby authorized and empowered to make and execute any deed or deeds of conveyance or writing or writings, or to make any contract or agreement in relation to their or either of their interests in and to the estate of the said Elmor Williams, deceased; provided, that the legal acting guardians of the said minors shall consent to the same, by duly signing and acknowledging such deed or deeds, or other writings or contracts, executed and acknowledged in the manner provided for by the laws of the state of Ohio, which relates to the conveyance of land or real estate.

SEC. 3. This act to take effect from and after its passage.

AN ACT

To provide for the sale of forfeited lands and lots in the county of Wood.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the auditor of the county of Wood be and he is hereby authorized to correct the list of lands and lots forfeited to the state of Ohio, in said county, by deducting therefrom all illegal taxation, and the interest and penalty thereon, and make return of said corrected list to the auditor of state on or before the first day of June next.

SEC. 2. That the auditor of state shall correct, from said list, the record in his office, and strike therefrom all lands or lots which may have been redeemed at his office, and immediately return a transcript of his own corrections to the said auditor of Wood county, who, after correcting from such transcript his own record, shall proceed to advertise and sell said lands and lots, in all things, according to the provisions of the act entitled "an act to provide for the sale of lands forfeited to the state for the nonpayment of taxes," passed March fourteen, one thousand eight hundred and thirty one; provided that, in adding the taxes of the year one thousand eight hundred and forty three to said lands and lots, no interest or penalty shall be calculated thereon.
