15 States Code is amended by adding at the end thereof the 16 following:

PROHIBITING USE OF ALIAS ON DIPLOMATIC PASSPORT

SEC. 33. Section 1546 of title 18 of the United States 19 Code is amended by adding, immediately following the third 20 paragraph thereof, a new paragraph as follows:

"Whoever, applying for a visa, permit, or other docu22 ment required for entry into the United States, or for admis23 sion to the United States, presents a diplomatic passport

1 made out in a name other than his own true and full name;

2 or".

AFFIRMATION OF ALLEGIANCE

SEC. 34. No person who refuses to swear or affirm his 5 allegiance to the United States shall be entitled to receive, 6 hold, or use any credential issued by, or under authority of, 7 the United States which identifies such person as one bearing 8 allegiance to the United States.

ADMISSION OF CONGRESSIONAL WITNESSES

SEC. 35. Notwithstanding any other provision of the 11 immigration laws, any individual whose testimony as a wit

ness is desired by a joint committee, committee, or subcom13 mittee of the Congress shall be permitted to enter the United States, as a parolee, when his entry is requested by a written resolution approved in writing by at least two-thirds of the 16 members of the committee or subcommittee desiring his testimony, including at least one member of such committee or subcommittee who is not a member of the political party having majority representation thereon.

CHAPTER 4-TRAVEL CONTROL

SHORT TITLE

SEC. 41. This chapter may be cited as the Travel Control

Act of 1971.

FINDINGS OF FACT

SEC. 42. The Congress finds and declares that in

addition to the conditions set forth as legislative findings in

1 section 2 of the Subversive Activities Control Act of 1950

2 and especially paragraph (8) of said section, which findings

3

are specifically reaffirmed as currently valid, there exist 4 complex and subtly shifting world conditions which currently 5 do and from time to time will make it contrary to the 6 national interest, a threat to the national security, and a 7 serious impediment to the realization of the foreign policy 8 objectives of the United States for nationals or residents of 9 the United States or certain classes thereof to travel abroad 10 or to enter or travel within or through certain areas under 11 foreign jurisdiction. The Congress further finds that, in a 12 world in which political changes and crises occur rapidly, 13 there is and will continue to be a need for prompt determina14 tions, from time to time, with respect to such travel and the 15 location of such areas. It is the purpose of this Act to provide 16 for such determinations, and to authorize, when necessary, 17 such restrictions as the national interest, the protection of 18 national security and the effective and successful conduct 19 of foreign affairs may require on such travel, or travel in 20 such areas, by nationals or residents of the United States.

TRAVEL REGULATIONS

SEC. 43. Whenever the Secretary of State determines,

23 subject to the approval of the President, that the national 24 interest, for the protection of national security or the effec25 tive and successful conduct of the foreign affairs of the 26 United States requires such action, the Secretary shall

1 promulgate regulations, subject to the approval of the Presi2 dent, describing particular areas under foreign jurisdiction 3 which may be entered or traveled within or through by individuals who are nationals or residents of the United 5 States or members of any reasonable designated class thereof, 6 only after receiving, and in accordance with, written authori7 zation therefor issued by the Secretary or his designee. Such 8 authorization shall be issued under regulations prescribed by 9 the Secretary which may reasonably limit or restrict the 10 purposes for which such authorization will be granted. No 11 regulation imposing any restriction or limitation upon such 12 travel shall be placed in effect under this section until the 13 Secretary has caused to be compiled and published the 14 findings of fact which provide the basis for his determination 15 that such restriction or limitation is necessary in the national 16 interest, for the protection of national security or the full, 17 effective, and successful conduct of the foreign affairs of the 18 United States. Findings of fact, determinations, and regu19 lations hereunder shall be promulgated by the Secretary 20 initially not later than ninety days after the date of enact21 ment hereof, and thereafter at the Secretary's discretion. 22 No such restriction may be imposed with respect to any 23 foreign nation on account of any policy of the government 24 thereof with respect to its internal affairs which does not sub25 stantially affect the national security of the United States or

1 the conduct of the foreign affairs of the United States. 2 The Secretary in his discretion may find initially that no 3 requirement exists for any travel restrictions at that time. 4 All regulations promulgated by the Secretary hereunder 5 shall be subject to the applicable provisions of subchapter 6 III, chapter 5 of title 5, United States Code.

8 SEC. 44. Whoever, being a national or resident of the 9 United States, shall willfully enter or travel within or 10 through any area contrary to a travel restriction described 11 and published pursuant to section 903 without receiving, or 12 in violation of the terms of, a valid authorization issued pur13 suant to the provisions of section 903, shall be fined not more 14 than $5,000, or imprisoned not more than five years, or both.

EFFECTIVE DATE

SEC. 45. The provisions of this chapter shall become

17 effective ninety days after the date of enactment thereof.
