The first witness, therefore, and the only witness who will be heard today, is Mr. Melvin L. Wulf, representing the American Civil Liberties Union.

Tomorrow, we shall hear from the Coast Guard, and on Thursday there will be four or five witnesses representing various private organizations.

After that, the hearings will stand in recess for 2 or 3 weeks, when we shall convene again to hear from the Department of Justice and, I hope, from other agencies in the executive branch.

Before we begin taking the testimony of Mr. Wulf, I will order that the text of each of the bills before us be inserted in the record at this point.

Mr. EASTLAND introduced the following bill; which was read twice and referred to the Committee on the Judiciary

A BILL

To amend title 18, United States Code, with respect to certain offenses against the security of the United States.

Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That this Act may be cited as the "Security Offenses Act 4 of 1971".

5 SEC. 2. SABOTAGE ON WAR PREMISES OR NATIONAL 6 DEFENSE PREMISES.-The definition of "war premises" in 7 section 2151 of title 18, United States Code, is amended to 8 read as follows:

"The words 'war premises' include all buildings, 10 grounds, mines, or other places wherein such war material 11 is being or may be produced, manufactured, repaired, stored,

1 mined, extracted, distributed, loaded, unloaded, or trans2 ported, together with all machinery and appliances therein 3 contained; and all forts, arsenals, navy yards, camps, pris4 ons, or other military or naval stations of the United States, or any associate nation."

The definition of "national-defense premises" in

7 section 2151 of title 18, United States Code, is amended to

8 read as follows:

"The words 'national-defense premises' includes all build10 ings, grounds, mines, or other places wherein such national11 defense material is being or may be produced, manufactured, 12 repaired, stored, mined, extracted, distributed, loaded, un13 loaded, or transported, together with all machinery and 14 appliances therein contained; and all forts, arsenals, navy 15 yards, camps, prisons, or other military or naval stations of 16 the United States."

SEC. 3. OFFENSES INVOLVING PERFORMANCE OF 18 OFFICIAL DUTIES.-(a) Chapter 213 of title 18 of the 19 United States Code is amended by adding at the end thereof

formance of official duties by Government em

ployees

"The running of any statute of limitations applicable to

any offense committed by any person (other than an offense

1 involving an assault or inflicting of bodily injury), an essen

2

tial element of which is (1) an act, or failure to act by an

3 officer or employee of the United States or any agency

4 thereof in the performance of his official duties or (2) an

5

6

attempt or offer to procure an act, or failure to act by an officer or employee of the United States or any agency 7 thereof in the performance of his official duties, shall be 8 suspended during any period during which the officer or 9 employee concerned is in the service of the United States or 10 any agency thereof."

(b) The analysis of chapter 213 of such title is amended

12 by adding at the end thereof:

"3292. Suspension of limitations in offenses involving performance of official duties by Government employees."

13 SEC. 4. LIMITATIONS APPLICABLE TO TREASON,

14 ESPIONAGE, SABOTAGE, SEDITION, AND

SUBVERSIVE

15 ACTIVITIES.-(a) Chapter 213 of title 18 of the United

16 States Code is amended by adding at the end thereof a new 17 section as follows:

18 "§ 3293. Treason, espionage, sabotage, sedition, and subver

"No person shall be prosecuted, tried, or punished for"(a) any offense described in chapter 37 (relating

to espionage and censorship), chapter 105 (relating to sabotage), or chapter 115 (relating to treason, sedition,

and subversive activities) of this title, or in subsection

10(b) of the Atomic Energy Act of 1946 (42 U.S.C. 1810 (b)), other than any such offense punishable by

death; or

"(b) any offense under section 371 of this title (relating to conspiracies) which involves a conspiracy to commit any offense described in chapter 37, chapter 105, or chapter 115 of this title, or in subsection 10 (b)

of the Atomic Energy Act of 1946 (42 U.S.C. 1810

(b)),

11 unless the indictment is found or the information is instituted 12 within fifteen years next after the offense shall have been 13 committed."

14 (b) The analysis of chapter 213 of title 18 of the 15 United States Code is amended by adding at the end thereof 16 a new item as follows:

"3293. Treason, espionage, sabotage, sedition, and subversive activities." SEC. 5. SMITH ACT AMENDMENTS. (a) The first

18 paragraph of section 2385 of title 18 of the United States 19 Code is amended so as to read:

of such action, whoever knowingly or willfully advocates,

abets, advises, or teaches the duty, necessity, desirability,

or propriety of overthrowing or destroying the Government of the United States or the government of any
