CONVICTIONS.

Record of-The Court before whom a Licensed Holder is convicted of an offence, which may be reIcorded on his License, has an absolute discretion as to whether a record of the conviction is to be made or not.

Repeated Convictions.-See Section 30 of the Act of 1872.

Sometimes leases contain a clause that the tenant shall do no act that will affect, lessen, or make void a License, and in such a case where Justices have recorded the conviction, the tenant will not have committed a breach of the covenant.

For Adulteration.-A conviction for adulterating drink may be recorded on the License.

CLOSING HOURS &c.

Licensed Premises shall be Closed as follows, viz. :

In "Metropolitan District" (See Section 32, Act, 1874) on:

(a) Saturday from midnight till I p.m. on Sunday.

(b) Sunday from II p.m. till 5 a.m. on

Monday.

(c) Other days from 12-30 a.m. till 5 a.m.

Beyond Metropolitan District, and within Metropolitan Police District, or in a town or "populous place" (any collection of houses containing 1,000 inhabitants declared to be such by the Licensing Committee).

On

(a) Saturday, from 11 p.m. till 12-30 p.m.

Sunday.

(b) Sunday, from ΙΟ p.m. till 6 a.m.

Monday.

(c) Other days, from 11 p.m. till 6 a.m.

Every licensed house must be closed from 2-30 or till 6 o'clock on Sunday afternoon according as it is permitted to open at 12-30 or I o'clock on that day.

Christmas Day and Good Friday are considered as Sundays.

Licensing Justices beyond the Metropolitan District have power to appoint the hours of closing on Sunday afternoon to be the same as those within that district. [See Section 9 of 1874 Act.]

The above-mentioned times of closing will apply to six-day Licenses in cases where wines or spirits are sold under an excise License, though no Justices License may be necessary.

Where a grocer's shop is attached to premises used for the sale of intoxicating liquors by retail, at the time for closing the licensed premises all communication between the grocer's department and the licensed premises must be cut off, or if one shop is used for both purposes the intoxicating liquors should be covered up or the License Holder may be summoned for exposing liquors for sale.

Sunday Afternoon :-Alteration of Closing hours, by order of Licensing Justices. In a place beyond Metropolitian district, for the purpose of accommodating the hours of closing on Sunday, Good Friday, and Christmas day, to the hours of public worship, the Licensing Justices may order premises to be closed until I o'clock, instead of 12-30, and in

that case premises shall be closed in the afternoon from 3 till 6, instead of 2-30 till 6 o'clock.

Any such order shall not come into force until one month from the date thereof, and the Justices shall advertise the same, and it shall remain in force until revoked.

Sunday Entertainments.-If a house, room, or other place is opened or used for public entertainment, or amusement, or for public debating on any subject whatever on Sunday, if persons are admitted by money, or ticket representing money, it shall be deemed a disorderly house.-Penalty upon keeper, £200; manager, 100; door-keeper or servant, £50.

Section 9 of the Act of 1874, which repealed a previous enactment bearing on the same matter, states that:

"Any person who, during closing hours, sells, or exposes for sale, in licensed premises, any intoxicating liquors, or opens or keeps open such premises for the sale of intoxicating liquors, or allows intoxicating liquors, although purchased before closing time, to be consumed on the premises.-Penalty £10 first offence, and £20 for any subsequent offence."

The above provisions would seem not to apply to the following case, viz.: where liquor was purchased before closing time not to be consumed on the premises, the purchaser could call after the time of closing, if the liquor was previously purchased; an exchange or barter is treated as a sale.

The above-named section (9) will apply equally to grocers' Licenses and to excise Licenses where Justices' authority is not required.

Greenwich time is to be taken.

Bona-Fide Travellers.-See that Title.

Refreshment Houses.-These houses must be closed at the time for closing other licensed houses at night, and are to remain closed until 4 o'clock in the morning.
