Woodhull Reid, Wright a Nicholson, 428 128 232 CASES DETERMINED IN THE SUPREME COURT OF JUDICATURE OF THE STATE OF NEW-JERSEY, AT FEBRUARY TERM, 1837. JOHNSON v BARCLAY. Matter of conviction of John I. Johnson for profane swearing. On Certiorari to the court of General Quarter Sessions of Monmouth county. An information and conviction for swearing the same profane oath, several times, on the same day, need not complain or convict of each of them separately. The charge in the precise words spoken, is sufficiently specific. One conviction for several profane oaths on the same day, is lawful. It is sufficient for that conviction to set forth the township where the offence was committed, although it is not named iu the information. No state of demand need be filed in such cases. Nor is the trial by jury, allowable on such information. In such cases, the title of the statute on which the complaint is made, or the name of the prosecutor, need not be indorsed on the process, This case was brought before this court on Certiorari, to reverse a conviction under the 8th section of the act, entitled "An act for suppressing vice and immorality." Rev. laws 378. Hartshorne, for plaintiff in Certiorari. J. F. Randolph, for informant. Hartshorne for plaintiff in Certiorari, cited the following authorities. 16 69 551 |
