PREFACE.

The insolvency law of California is in most respects similar to the United States bankruptcy law which was repealed in the year 1878. The sections of the United States law upon which the similar sections of the California Act are founded, are given in notes to the text, and following are notes of decisions of the United States and other courts, illustrating and explaining the national law. The authorities cited under the several sections of the California Act are taken from decisions of the California Supreme Court in cases explaining clauses and words of the general law governing frauds against and by creditors; and illustrating, in these respects and others, the practice of the courts of the state. Much labor has been expended upon the forms. They are nearly all new. If they contain superfluous words, it is not because there has not been an effort to condense. It is not to be hoped that their brevity will be recognized as a sign of peculiarity or originality. In an age of condensation there is no good reason why the "forms" used by legal practitioners should not be very much reduced in length. The author's aim has not been to prepare "forms" for every possible emergency, but to make only those necessary in a very large majority of cases. Hoping that the book will be useful, it is respectfully submitted to the bench and bar.
