* As to the form of the inftrument by which a power is executed.

Of the circumflances required to attend the execution of powers, which
will include the confideration of the nature of the act to be affected by the
execution of the power, and of the relative fituations of the donee and ap-
pointee under a power.

Precedents of Appointments.

Appointment of Copyhold Lands.

Appointment from a wife to her trustee, pursuant to a power reserved in a fet-
tlement to pay rent, and to convey freehold, and furrender copyhold lands
to the ufe of a purchaser.

Of a moiety of an estate limited for the use of younger children, who being
defirous to fell the fame, and the title deeds being refused to be produced,
an attorney is impowered to file a bill in chancery.
Special recitals intended to be inferted in the foregoing deed.
From a wife to her trustees to fell South-fea flock.
By a widow to a purchafer, (fubject to the payment of 100l.) and the confir-
mation of her trustees.

*Deed of appointment, leafe and release by trustees under a marriage fettle-
ment, with the confent of tenant for life, pursuant to a power therein referv-
ed, for felling or exchanging the fettled eftates, and purchasing others with
the money raised thereby.

A deed of conveyance to trustees under a power to fell eftates fettled, and
veft the money in the purchase of other eftates, in which part of the money
invested in the funds in the name of the said trustee and others, until an in-
fant comes of age to convey the estates.

Appointment Of Jointures, &c.

Appointment of a jointure made before marriage, pursuant to a power in a for-
mer deed.

Of a jointure by an intended husband for his intended wife's life, (the furthe

limitations to be expreffed in another deed) in confideration of a large port i

on, made pursuant to several surrenders, giving him power to appoint.

Of a jointure by virtue of a will.

By a husband of fo much of the premiffes mentioned in a will, as fhall be fuffi-

cient to pay 200l. per ann. after his death to his wife for her jointure, in case

no other fettlement is made, with a special covenant for fecuring the

fame.

Of an estate by a husband to his fecond wife, made after marriage in confide-

ration of her portion, subject to a charge for his daughter by his first wife,

with power to make leafes; habendum from his death for her life.

Appointment and grant by an intended hufband to an intended wife of a join-

ture, in confideration of her covenanting to levy a fine, &c. when of age

by her guardian's confent, of her eftate, &c. to feveral ufes, &c. with a

provifo to be void if no fuch fine, &c be levied.

Of a jointure (pursuant to a power in a will) by the intended husband after his

death, for his wife for her life; and a demife to trustees for a term of years,

of the premiffes appointed for fecuring an annuity for her feparate ufe; and

a charge on lands to provide for daughters, and a covenant (purfuant to an

agreement that the wife's portion is in fatisfaction of legacies, &c.) for the

hufband to make a release, and to ratify partitions of an estate.

By a husband to increase his wife's jointure, (purfuant to a power in a will to

fettle a jointure in proportion to his wife's portion) part of her portion being

before paid, as to which the hufband had made a fettlement, and now to

enable him to receive the reft, fettles an annuity, chargeable on woods and

wood-grounds, on her, with provifo on non-payment to cut down wood and

receive rents, &c.

Of an annuity to the separate ufe of the wife, (out of premiffes devifed and
fettled to feveral ufes) chargeable neverthelefs with the payment of her
debts, and containing powers to retain interest of money
for payinent. 163

Appointments by Wives.

Appointment by a feine covert of a freehold eftate to her husband for his life,

to take effect immediately after her decease.

Of an annuity chargeable on his eftate, &c. and a release of the arrears, &c.

thereof, and an appointment of an eftate of inheritance to the ufe of him, his

heirs and affigns for ever.

By a wife to the heir and executor of a trustee in truft, after her decease to the

ufe of her husband, (whom the married by confent pursuant to her mother's

will) of lands and South-fea stock and annuities.
