CHAPTER 157.

An Act to Amend the Act to Incorporate the Pictou Gas
Light Company, Limited.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 1 of chapter 110 of the Acts of 1885 is hereby Section 1, cap. 110, Acts of 1885, amended by striking out all the words after the word amended as "limited" in the fourth line thereof and substituting therefor the following words :

The objects of the company shall be and include

(a) The supplying the town of Pictou and the inhabitants thereof with gaslight and electric light, and for the transaction of all business connected therewith or incidental thereto.

(b) The erection, purchase, lease, hire, possession, use of, and letting of factories, stations, laboratories, houses or tenements; also the purchase, lease, exercising, letting or re-selling any patent or other right.

(c) The purchase, manufacture, hire, working, letting out, or selling, any engine, dynamos, machinery, wires, lamps, insulators, carbons, or other apparatus, materials, or chemicals employed in or any way connected with or conducive to the manufacture, generation, distribution, or employment of electric, galvanic, or magnetic currents, either for lighting or heating, or as a motive power, or for any other useful

(d) The manufacturing, distributing, and supplying of electric, galvanic, or magnetic currents, and all materials and apparatus for the application of the same for lighting,

heating, or motive power, or for any other useful or mechanical purpose.

(e) The doing of all such acts and things as shall in anywise be connected with or incidental to the carrying out or attainment of the said objects, or any of them.

2. Section 3 of said Act is hereby amended by inserting the word "five" after the word "twenty" in the sixth line thereof.

3. By and with the consent of the town council of the town of Pictou, the company shall have power and authority to erect and place in, upon and over the streets, highways, public squares, and other necessary places in the town of Pictou, poles and other suitable standards and supports, and to place, extend, string or otherwise put wires and cables. thereon for the transmission of electric currents for each and all the purposes hereinbefore mentioned; and also to open, break up, excavate and dig up the streets, sidewalks, bridges, drains, gutters and soil within the limits of the town of Pictou, and to lay down, place and put within and underneath the same all such pipes, wires and other works as the company shall deem necessary for carrying its purposes into effect, and from time to time to make, alter, repair or remove the same, or any part or parts thereof; and also to do all such acts and things as the company shall deem necessary for carrying into effect the purposes. of the company, doing as little damage as may be in the execution of the said powers hereby conferred Provided, that in the town of Pictou the poles erected by the company in the streets, and the excavating and digging in the said streets for the purpose of erecting the same, and of placing wires, pipes and other necessary works and things, shall be done under the supervision of the mayor, or an officer to be chosen and appointed by the town council of the said town, and subject to his approval, and in conformity with necessary and reasonable regulations, to be made by the town. council, for the protection of the lives and property of the citizens, and for securing to the public the right of travelling upon and using the streets of the town.

The company shall have power from time to time to enter into any contract or contracts with the town council of the town of Pictou for the lighting of the streets of said town, or any part thereof, or for other purposes; and to enter into contracts with any person or persons, or corporations, for the lighting of houses, buildings, or other places,

by means of electric currents, and for the supplying of motive power for any and all purposes, and for the providing, sale or lease of lamps, wires, fixings and other things, and for the repair and maintenance thereof, in such manner and upon such terms as may be agreed upon between the company and the said town, persons and corporations.

5. 6. No wires, lamps, fittings and other things supplied or Wires, lamps placed by the company upon the premises owned or occu-empt from dispied by any town, municipality, person, or corporation, under the powers and privileges conferred upon the company by this Act, or under any lease or agreement entered into by the company in carrying out the objects for which it is incorporated, shall be liable or subject to distress or lien for rent or taxes due by the owner or occupant of the said premises or otherwise, nor to seizure under execution, warrant or other process of law.

7. If any person supplied with electricity or gas by the Power to stop company fail or neglect to pay the rent, toll, or contract electricity where price for the same, or if any person having in possession any fixtures belonging to the company, fail or neglect to pay the rent, toll, or contract price for the same, the company may stop the supply of gas or electricity from entering the premises of such person, and may remove and take away all such fixtures, and recover the amount due from such person up to such time, together with the expenses of cutting off and removing the same, in any competent court, notwithstanding any contract to furnish for a longer time. Upon and at any time after the expiration of any contract for the supplying of gas or electricity, or of the renting of any such fixtures or apparatus, the company may enter into or upon the premises where the said fixtures are and remove the same, doing no more damage to the premises

Power to remove than is necessary. Before the company shall be at libertyfixtures, &c. to remove any of its fixtures and apparatus from the premises of any person for the non-payment of rent or otherwise, they shall first give three days' notice of their intention so to do.

8. Every person who unlawfully or maliciously cuts or ciously cutting injures any electric wire or work with intent to cut off any supply of electricity; every person who wilfully removes,. destroys or damages any pillar, post, plug, lamp, wire or other work of the company for supplying electricity or gas; or who wi'fully extinguishes any of the public lamps or lights; or wastes or improperly uses any of the electric current supplied by the company; and every person who lays or suspends, or causes to be laid or suspended, any wire to communicate with any wire belonging to the company without its consent; or fraudulently uses any lamp, wire,. heater, engine or machinery other than such as has been approved or provided by the company; or of larger dimensions than he has contracted to pay for; or keeps the lights burning for a longer period than he has contracted to pay for; or otherwise improperly uses such electric current; or supplies any other person with any part thereof supplied to him by the company; shall for each such offence be liable to such penalty as may be imposed under the " Nova Scotia Convictions' Act."

9. The company shall have power to make, accept, draw,. indorse, issue and negotiate bills of exchange, promissory notes, drafts, cheques and orders for the purpose only of facilitating its business. Such negotiable instruments to be made, accepted, drawn indorsed and issued on behalf of the company by the president and secretary for the timebeing.

10. No shareholder whose shares are fully paid up shall be liable for any debt contracted by the company, or for any loss or liability incurred by, or claim or demand against the company; and no shareholder shall be liable for the debts or liabilities of or the claims or demands against the company to a greater amount in the whole than the amount of stock held by him, deducting therefrom the amount actually paid thereon, unless he shall have rendered himself liable for a greater sum by becoming surety for the debts of the company; but no shareholder who may have transferred his interest in the stock of the company shall cease to be liable for any contract of the company entered into before the date of such transfer, so as any action in respect thereof shall be brought within six months after such transfer.

Chapter 137 of the Acts of 1898, and all Acts in Act amended by amendment thereof, are hereby amended by striking out the changing name words Nova Scotia Iron and Steel Company, limited," wherever they occur in said Acts, and by inserting in lieu thereof the words Nova Scotia Steel and Coal Company, limited," and the name of the said company shall hereafter be "Nova Scotia Steel and Coal Company, limited."
