21. The town council shall have full power and authority By-laws, rules from time to time to make such ordinances, rules, by-laws and regulations. and regulations as such council shall deem requisite and necessary for regulating the proportion of the cost of construction, maintenance and repairs of the sewers of the town, to be paid and borne by the town, and the proportion thereof to be paid and borne by the owners of the real estate drained into, or by any hy-law of the town required to be drained into any such sewers, and it shall be the duty and within the power of the council to define by bylaw or other regulation what real estate and property are liable for the payment of the special charges and rates herein referred to, and also generally from time to time to make such by-laws, ordinances, rules and regulations as may be necessary or expedient for regulating the construction, repair, management, use, connections with and maintenance of the drains and sewers of the town, and may enforce observance of such by-laws, ordinances, rules and regulations by attaching penalties thereto under the general authority given to town councils in that behalf by the Towns' Incorporation Act. The said by-laws, ordinances, rules and regulations, when passed by the town council and approved by the Governor-in-Council, shall have the force of law and be as valid and effectual as if the same and each of them were incorporated in and formed part of this Act. The production of a copy of said by-laws, o approved, purporting to be certified under the hands of the mayor and town clerk, and the seal of the town of Lunenburg, shall be sufficient proof thereof in any court of justice.

Provision re- 22. In carrying on the work of constructing a sewerage of existing drains, system for the town of Lunenburg, under the authority of this Act, or any by-law made in pursuance thereof, the town council, its engineers, contractors, officers, servants or workmen, may cut, stop, remove or stop up any existing sewers, drains or other water-courses in or under the streets, lanes or thoroughfares of the town, and shall replace existing drains, sewers or water-courses by new sewers, drains or water-courses, and no claim for damages shall be payable, nor shall any action at law be maintainable against the town by any person or persons, for so cutting, stopping or closing up any such existing sewer, drain or watercourse, or for any other claim or matter in any way connected with or arising out of the construction of such sewerage system from the date of the commencement of the work thereon under the authority of said chapter until its final completion.

23. Notwithstanding anything in this Act contained, the town of Lunenburg shall have power to grant permission to any person or persons to open the streets for the purpose of laying private sewers or drains, and shall have power to regulate the construction, repair, use and maintenance and use of such private drains or sewers. And they shall also have power to assist in the construction of such sewers or drains as the town council may determine. And the said town council shall also have power, by resolution, to declare that any person or persons so constructing private sewers or drains in all respects in accordance with the specifications established by the said council, shall be exempted from the operation of any general sewerage Act hereinafter adopted by the ratepayers,

24. For the purpose of effecting the said loan or such how received and portion or portions thereof as may be necessary, the said council is empowered to make and issue from time to time, as the council may deem expedient, the town's debentures in the form specified in schedule "A" to this Act, bearing interest at such rate as the town council shall determine, not exceeding four per centum per annum, payable half yearly and redeemable at a period or periods not exceeding thirty years from the issue thereof, and each such debenture shall be issued for the sum of one hundred dollars or some multiple thereof. The money borrowed by virtue of this Act shall be paid into the hands of the treasurer of the said town, and by him paid out as the said town council shall by resolution determine, for the purposes mentioned in the first, second, third and fourth sections of this Act, and for no other purpose.

26. 27. 28. In order to provide a sinking fund for the payment Sinking fund. of the debentures authorized to be issued under this Act for the water and electric lighting services, the town council shall annually include in the estimates of the sums required for the purposes of the said town, such sum as may by resolution be determined by the town council, not however to be less than one per cent of the amount borrowed under the provisions of this Act for these purposes, and such sum shall be rated and collected in the same manner and with the same remedies as other rates and taxes in said town are rated and collected.

(2) Such sums, when collected, shall be deposited in some chartered bank in the province of Nova Scotia, to the credit of an account to be called "The Lunenburg water and electric lighting, 1901, sinking fund account," on deposit,

bearing interest, and such sums shall be used for payment of the debentures issued under the provisions of this Act and for no other purpose.

(3) Any member of the said town council who shall move, second, put or support by his vote any motion, resotion, or proposal under or in pursuance of which any portion or the whole of the moneys borrowed under the provisions of this Act, or directed by this Act to be held as a sinking fund, shall be diverted to any other object, shall forfeit his seat in the council, and shall be liable to a penalty of four hundred dollars, to be collected at the instance of any ratepayer who may sue therefor, and one-half of said penalty shall be for the benefit of the person so prosecuting, and the other half shall be paid into the treasury of the said town.

Be it enacted by the Governor, Council, and Assembly, as follows:
