CHAPTER 98. An Act to amend Chapter 81 of the Acts of 1891, entitled Chapter 81, Acts of 1891, amended. Proceedings in case of expro. priation. Be it enacted by the Governor, Council, and Assembly, as follows: 1. Chapter 81 of the Acts of the legislature, passed in the year 1891, entitled, "An Act to provide for supplying the town of Amherst with water," is hereby amended as follows: "Whereas, the pumping station of the said Amherst water works, constructed under the provisions of the Act hereby amended, has been erected above navigation upon the banks of the Nappan River, in the county of Cumberland; and whereas it may be necessary for the town to acquire title to the lands bordering on either side of the said river above the site of the said pumping station; therefore "The town of Amherst is hereby empowered to acquire by purchase or by expropriation proceedings under the provisions of the said Act, all or any of the said lands on either side of the said river above the pumping station as aforesaid for the purpose of increasing the efficiency of its water system. In the event of expropriation proceedings becoming necessary, the town council of the said town is hereby invested with all the powers given by sections 3, 4 and 5 of the Act hereby amended." 2. Before taking proceedings to expropriate any of said lands the said town council shall furnish the Provincial Secretary with a statement and plan containing a description of the land sought to be expropriated, and shall satisfy the Governor-in-Council that the said land is actually required by the said town for the purposes of this Act, and shall obtain from the Governor-in-Council an order declaring that the same may be expropriated under the said Act as hereby amended. Any member of said council who shall move or second, or put or support by his vote, any motion, resolution or proposal under or in pursuance of which any portion or the whole of the moneys so directed to be held as a sinking fund shall be diverted to any other object, shall forfeit his seat in the council, and shall be liable to a penalty of four hundred dollars, to be collected at the instance of any ratepayer who may sue therefor, and one-half of said penalty shall be for the benefit of the person so prosecuting, and the other half shall be paid into the treasury of the said town.
