Be it enacted by the Governor, Council, and Assembly,

as follows:

1. Chapter 80 of the Acts of 1893, an Act entitled, "The County of Cumberland Sewers Act," is amended as follows-1. The words "open or covered as a majority in interest may direct," in the thirteenth line of the twentyninth section of said chapter, are struck out.

2. The said chapter may be cited as "The Cumberland Sewers Act."

CHAPTER 95.

An Act to authorize the Municipality of Cumberland to borrow money to build a Jail, and to pay for the build- · ing erected on the County Farm in the year 1900.

Be it enacted by the Governor, Council, and Assembly, as follows:

The municipality of the county of Cumberland is hereby empowered to borrow money upon the credit and funds of the municipality a sum of money not to exceed fifteen thousand dollars for the purpose of building a county jail in Amherst and equipping the same, and paying for the building erected on the asylum property at Pugwash in A. D., 1900, and the equipment for the said building.

3. 6. (1) In order to provide a sinking fund for the pay- Provision for ment of the debentures authorized to be issued under this Act, the municipal council shall annually include in the estimates of the sums required for the purposes of the said municipality such sums as may by resolution be determined by the municipal council, not, however, to be less than one per cent. of the amount borrowed under the provisions of this Act, and such sum shall be rated and collected in the same manner and with the same remedies as other rates and taxes in said municipality are rated and collected.

(2) Such sums, when collected, shall be deposited in some chartered bank in the province of Nova Scotia to the credit of an account to be called "The Cumberland county jail, 1901, sinking fund account," on deposit, bearing interest, and such sums shall be used for payment of the

debentures issued under the provisions of this Act, and for no other purpose.

(3) Any member of the said municipal council who shall move, second, put or support by his vote any motion, resolution or proposal under or in pursuance of which any portion or the whole of the moneys borrowed under the provisions of this Act, or directed by this Act to be held as a sinking fund, shall be diverted to any other object, shall forfeit his seat in the council, and shall be liable to a penalty of four hundred dollars, to be collected at the instance of any ratepayer who may sue therefor, and onehalf of said penalty shall be for the benefit of the person so prosecuting, and the other half shall be paid into the treasury of the said municipality.

The municipality of Cumberland, in the province of Nova Scotia, will pay the bearer hereof, at the office of the treasurer of said municipality in Amherst, the sum of . . dollars, in.... ..years, from the date hereof, and interest for the same at a rate of........ per cent. per annum, payable yearly.

2. The council shall add to the general assessment of Council the said town for the current year,. (1901) such sum as the general assess council may by resolution determine, for the payment of the said cost of the said vaccination, provided that said sum shall not exceed the said sum of one thousand dollars, and such sum shall be rated upon the property of the ratepayers of the said town liable to taxation, and shall be rated, levied and collected in the same manner and with the same remedies as ordinary rates and taxes.

An Act to enable the Town of Amherst to Borrow Money in aid of its Fire Department.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The town council of the town of Amherst is hereby authorized to borrow upon the credit of the town a sum of money not exceeding eleven hundred and fifty dollars in the whole to defray the expenditure heretofore incurred, or to be incurred in the future, in purchasing a hook and ladder waggon and a hose cart for the better equipment of the fire service of the said town.

2. For the purpose of effecting such loan the said town council is empowered to make and issue from time to time,. as the council deems expedient, the town's debentures in the form in the schedule to this Act, bearing interest at such rate as the town council shall determine, not exceeding however five per centum per annum, payable half-yearly, and redeemable in ten equal annual payments, beginning with the year 1902. Such debentures shall be issued for such sums as the council by resolution determines, and shall be signed by the mayor and clerk of the town, and sealed with the corporate seal of the town.

3. The town council shall annually add to the amount to be rated and levied on the town of Amherst a sum sufficient to pay the annual interest upon the said deben-tures, including any deficiency from any previous year, and shall collect such sum in the same manner and with thesame remedies as other annual rates and taxes.

4. The town council shall also, in each year in which any debenture or debentures become payable, add to the amount to be rated and levied upon the town of Amherst a sum sufficient to pay off such debenture or debentures as provided in section 2, and to pay the expenses of collectingand disbursing the same, and such sum shall be rated upon the property within the town of Amherst liable to taxation,. and shall be collected in the same manner and with the same remedies as other rates and taxes.

5. Inasmuch as the ratepayers of the said town have in the manner by law provided already authorized the town to apply to the legislature for leave to borrow said moneys and to issue the town's debentures therefor under the provisions of this Act, it shall not be necessary to convene any additional meeting of the said ratepayers, eitherunder the provisions of the Towns' Incorporation Act or under this Act, as a condition precedent to the issuing of the said debentures or the doing of any matter or thing by this Act authorized.
