to pay said interest and the expenses of collecting and disbursing the same, and shall in like manner provide for the principal of said debentures when they mature.

5 (1) The council of the town of Truro shall annually include in the estimates of the sums required for the purposes of the town of Truro such sum as the council by resolution determines, not, however, in any case to be less than three per cent. of the amount borrowed under this Act, and such sum shall be rated annually upon the property of the ratepayers of the town of Truro liable to taxation, and shall be levied and collected in the same way and with the same remedies as ordinary rates and taxes.

(2) Such sums, when so collected, shall be deposited in some chartered bank in the province of Nova Scotia to the credit of an account to be called "The town of Truro, 1901, loans sinking fund account," and shall with the interest thereon be used for paying off the debentures issued under this Act and for no other purpose.

6. Any member of the said town council who shall move, second, put or support by his vote any motion, resolution, or proposal under or in pursuance of which any portion or the whole of the moneys borrowed under the provisions of this Act, or directed by this Act to be held as a sinking fund, shall be diverted to any other object, shall forfeit his seat in the council, and shall be liable to a penalty of four hundred dollars, to be collected at the instance of any ratepayer who may sue therefor, and one-half of said penalty shall be for the benefit of the person so prosecuting, and the other half shall be paid into the treasury of the said town.

Be it enacted by the Governor, Council, and Assembly, as follows:

Section 2 of chapter 88 of the Acts of 1899 is amended Section 2 of said by striking out the word "twenty" in the second line of amended. said section and substituting therefor the word "thirty."

2. Sub-section 1 of section 5 of the said Act is amended Sub-section 1 of by striking out the word "five" in the fourth line of said amended. sub-section 1 and substituting therefor the words “two and -one-half."

3. Chapter 85 of the Acts of 1898, entitled, "An Act to Chapter 85, Acts authorize the town of Truro to expropriate lands," is hereby amended as follows:

Section 4 of said Act is amended by adding the words. "or cannot be found after diligent inquiry" after the word 'known" in the first line of said section.

8. Notwithstanding the provisions of this Act, nothing herein contained shall prevent the town council from acquiring title to such lands by private arrangement with the owners thereof, and said town council are empowered to accept deeds to the town of any portion of said lands, and to pay such amounts as they consider reasonable value for such lands.".

CHAPTER 92.

An Act relating to a Fire Alarm for the Town of Truro.

Be it enacted by the Governor, Council, and Assembly, as follows:

The town of Truro is hereby authorized to erect, to construct and construct, equip, and maintain an efficient fire alarm service within the town of Truro, such fire alarm service to be operated by electricity.

2. For the purpose of operating such fire alarm service the town of Truro is hereby authorized to string or place all the necessary wires required for operating such fire alarm service upon any telephone or electric lighting poles now standing within the town of Truro, and owned by any person or corporation whatsoever now operating telephone or electric lighting systems within said town of Truro.

3. For the purposes aforesaid the workmen, servants vants. &c., and agents of such town are authorized to said go upon up on poles, after poles and string or place said wires at any time after the passing of this Act, performing the same under the supervision and direction of a person or persons appointed thereto by the person or corporation owning said poles upon receiving the notice herein prescribed, but before going upon said poles for any of the purposes of this Act the town shall give to the person or corporation whose poles it is proposed to go upon, twelve hours' notice of such intention,

indicating the particular poles and the work intended to be done thereon. In cases of sudden breaks it shall only be necessary to give notice sufficient to enable the person or corporation owning the poles to send a supervisor to the spot indicated.

4. 5. Compensation shall be made by the town of Truro to Compensation. all persons or corporations whose poles are used for placing or stringing of wires under this Act, and all damages done to said persons or corporations by the town in placing or stringing of said wires, and compensation for such supervision and direction shall be paid by the said town to such persons or corporations.

7. In case the said town and the said persons or corpo- Arbitration and. rations cannot agree upon the amount of compensation to be paid or the measure of damages to which such persons or corporations are entitled, the same shall be settled by arbitrators to be appointed, one by the said town and one by the person or corporation entitled to such compensation or damages, and the two arbitrators shall choose a third arbitrator, and the award of any two of said arbitrators shall be final and conclusive and binding upon all parties interested, and such award shall be made within thirty days after the matter in dispute shall have been submitted to them. In case either of said parties refuse or neglect to appoint an arbitrator after the other of said parties shall have made such appointment, then upon ten days' notice to do so being given by the other of said parties to the party so neglecting or refusing, such other party may on the expiration of said period of ten days apply to and have such arbitrator appointed by the judge of the county court

CHAPTER 93.

An Act to incorporate the Trustees of Victoria Park, Truro.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. John B. Calkin, Gardner Clish, James D. Ross, Hugh McKenzie, Israel Longworth, David H. Muir, Alexander J. Campbell, all of Truro, in the county of Colchester, the mayor of the town of Truro, ex officio for the time being, and one councillor of the town of Truro, to be appointed annually by the town council of Truro, and their successors, to be appointed as hereinafter provided, are hereby constituted a body corporate under the name of "The Trustees of Victoria Park, Truro.'

2. The lands now vested, or that may hereafter be vested, in the said John B. Calkin, Gardner Člish, James D. Ross, Hugh MacKenzie, Israel Longworth, David H. Muir and Alexander J. Campbell, as trustees of Victoria Park, Truro, are hereby vested in the trustees of Victoria Park, Truro, to be held by such body for the same uses and on the same trusts as such lands are now held.
