CHAPTER 86.

An Act to amend Chapter 85, of the Acts of 1899, entitled,
"An Act to authorize the Town of Sydney Mines
to Borrow Money for School purposes."

(Passed the 4th day of April, A. D., 1901).

SECTION 1. Section 1 of said chapter amended.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 1, of chapter 85 of the Acts of 1899, is chapter amendhereby amended by striking out the word "three" in the ed third line thereof, and substituting therefor the word 'thirteen." Also by striking out the word "two" in section 1, of chapter 85 of the Acts of 1889, and substituting therefor the words a school house or."

CHAPTER 87.

An Act relating to Certain Streets in the Town of

Be it enacted by the Governor, Council, and Assembly, as follows:

1. From and after the passing of this Act all those Certain streets in portions of certain streets in Louisburg, in the county of burg closed and Cape Breton hereinafter more fully described, a plan of stopped against which is on file in the office of the clerk of the municipality of Cape Breton County, shall be permanently closed and stopped up against travel by any person or persons, whether on foot or with vehicles, or in any manner whatsover, viz. : All that portion of Front Street or Shore Street in Louisburg aforesaid, beginning at the western side line of the property of the Dominion Coal Company, limited, and extending eastwardly to the eastern side line of the

Gardiner property, so called; and also all that portion of a road or street extending from the shore of Louisburg harbor to the northern side line of the low level railway tracks of the Dominion Coal Company's railway.

2. The said Dominion Coal Company, limited, shall in ized to open and lieu of the portions of the said streets or roads so permanently closed and stopped up, forthwith provide, lay out, construct, and dedicate a road forty feet wide from the main road, so called, in Louisburg aforesaid, from a point at or near the office of the said company, to the said Front or Shore Street at or near the lands of J. N. Spencer or James McPhee, according to the tracing of the same as. shown on the plan mentioned in section 1 of this Act.

3. So soon as the Dominion Coal Company, limited,. tioned in section shall provide, lay out, construct and dedicate the road described in section 2 of this Act, the town of Louisburg shall convey to the Dominion Coal Company, limited, the portion of the street in the town of Louisburg described in the first section of this Act; and so soon as the deed conveying to the Dominion Coal Company, limited, the lands described in the first section of this Act is executed by the town of Louisburg, the land described in the first section of this Act, and in said deed, shall become absolutely vested in the Dominion Coal Company, limited, in fee simple, free from all claims whatsoever. A copy of the plan referred to in the first section of this Act shall be attached to said deed.

CHAPTER 88.

An Act to provide for Supplying the Town of Glace Bay with Electric Light.

Be it enacted by the Governor, Council, and Assembly,

as follows:

2. It shall be lawful for the town council, from time to Power to open time, for the purposes of this Act, to open or obstruct the poles. roads, streets or highways within the town, and to keep any such road, street or highway open or obstructed for such reasonable time as may be necessary; and the council is hereby empowered to erect and place upon and along the streets and other necessary places in the town of Glace Bay, poles or any other necessary supports, with insulated wires thereon, for the transmission of electric currents for such purposes as herein indicated.

In the event of any damage being done in the execuhow appointed. tion of the work, the person sustaining such damage shall be entitled to receive such compensation as shall be mutually agreed upon, and in case no such agreement can be made, at the request in writing of such party, the same shall be settled by three arbitrators, one of whom shall be appointed by such party, one by the town council, and a judge of the Supreme Court shall appoint the third arbitrator, and the arbitrators so appointed shall proceed to determine the damages, if any, and award the same to be paid to the party aggrieved, whose award or the award of any two of them, shall be final and conclusive, and therenpon the town shall pay and satisfy within six months the full amount of such award. The cost of such inquest shall be taxed or allowed by the judge of the Supreme Court at the same rate as in the cases of ordinary inquests before sheriffs.

4. The expense of conveying the electric current for supplying the light to houses, buildings or establishments, which are to be supplied with light under this Act from the main, and the wiring thereof, shall be borne by the owner or the town, as the council may deem proper.

5. The council shall employ and pay a competent engineer to make plans and specifications for the installation of the electric light system, and to duly inspect the

same.

6. The town council may from time to time, at such times as they may deem expedient, improve, extend or enlarge the electric light system of the town, or make repairs, erect poles, and do all things necessary to afford a sufficient supply of light.

7. For the purpose of raising the necessary funds to issue debentures, obtain for the town of Glace Bay the said electric light system, and to carry into effect the work contemplated by this Act, the town council are hereby authorized and empowered to make and issue from time to time or otherwise, as they may deem expedient, debentures in the form specified in schedule "A" to this Act, bearing interest at a rate not exceeding four per centum per annum, payable half yearly, and redeemable at periods not exceeding thirty years from the date of issue thereof, provided that the whole amount of such debentures shall not exceed the amount of thirty thousand dollars. Such debentures shall not be issued for a less sum than one hundred dollars each, and shall be signed by the mayor and town clerk of the town of Glace Bay.

8. The moneys accruing from the annual income of the Money accruing electric light system from whatever source shall be appro- come, how appropriated and applied in the first place to discharge the current priated and expenses incurred in management and working of the said electric light system, including the necessary fuel for the power station, payment of the salary of the engineer and other necessary officials and servants employed in and about the said electric light system, the wear and tear of the same, and every other matter and thing connected with or incidental to the maintenance of the said system, so that the same shall be always in efficient state to furnish an ample supply of light for the purposes mentioned in this Act; and in the next place, towards the payment of the half-yearly interest of the debentures issued under the authority of this Act, and in case the whole income shall not be sufficient for the purposes above mentioned, the deficiency shall be made good by an annual assessment under the provisions of this Act or any by-law made under the authority of this Act.

9. The town council of the town of Glace Bay shall General powers have full power to supply the town and its inhabitants, as with respect to well as persons and bodies corporate residing and being light. within the town limits, from the system constructed under this Act and Acts in amendment hereof, with electric light for lighting the streets of the town, and for the various other purposes contemplated by this Act, upon such terms as the town council may impose, and shall have full power to make, and from time to time repeal, alter or amend all such ordinances, by-laws, rules and regulations as such council may deem requisite and necessary for regulating the conditions under which the inhabitants of the town and others shall make use of the light supplied by means of the said system, the supply of light, and the price to be paid therefor to the town; for preventing injury to any poles, cross-arms, wires, insulators, lamps, engines, boilers, dynamos, alternators or other machinery, stock or material of or in any way belonging to or connected with the said system; and also regarding any other thing which it may be necessary or expedient to regulate for the providing and carrying out of the objects of this Act or any amendment hereof. The town council may enforce such by-laws, rules By laws.. and regulations by affixing penalties for the violation. thereof, and may provide that in default of payment thereof, any such penalty may be levied by distress and sale of the goods and chattels of the offender, and may enact in and by any such by-law, in case of such offender being other than a body corporate, that such offender may,
