Amendment.

Additional powers to lease, connect

railroad tracks of the Morris and Essex Railroad Company, of the Northern Railroad Company of New Jersey, the Erie Railway, or the New Jersey Railroad and Transportation Company, even with the grade of the said railroads, but above or below the said grades so as to clear the locomotives and cars run, or to be run, on the said railroads, unless by consent in writing, under the corporate seal of such railroad company whose track shall be crossed.

2. And be it enacted, That the second section of the supplement to said act, approved March third, eighteen hundred and sixty-two, be amended by striking out the words "one hundred and fifty thousand dollars," and inserting the words "twenty-five thousand dollars per mile."

3. And be it enacted, That it shall be lawful for the said company, if they see fit and so choose to do, to hire or lease or consolidate to, connect or consolidate with any other road, the company of such other road being willing so to unite, and to make contracts and engagements with any other corporation, or with individuals, for transporting and conveying any kind of goods, produce, merchandise, freight or passengers, and to enforce the fulfilment of such contracts.

4. And be it enacted, That all acts and parts of acts inconsistent with the provisions of this act be and the same are hereby repealed, and that this act shall take effect immediately.

CHAPTER CXLV.

An Act to divide the township of Bordentown into two Election Districts.

1. BE IT ENACTED by the Senate and General Assembly of township into the State of New Jersey, That the township of Bordentown, in the county of Burlington, shall be divided into two election districts, viz. All that part of said township lying west of the Main street, in the city of Bordentown, and the Bordentown and Columbus Turnpike to the southerly line of said township, shall hereafter be called the first district of said township, and

2. And be it enacted, That the registers and inspectors of How elections elections elected last November shall preside at and conduct the elections in each of the above described districts, to be held in March, eighteen hundred and sixty-eight; and the clerk of the township shall act as clerk for the district in which he lives, and the inspectors or judges of election of the other district shall appoint some person, who shall be a legal voter in the district, to act as clerk of said board, who shall be entitled to the same fees as the other clerks, and that this rule shall apply to all subsequent elections to be held in said districts so far as it regards the clerks.

3. And be it enacted, That at the elections to be held in Judges of March, eighteen hundred and sixty-eight, and at each succeeding March election, three persons shall be elected as judges of election for each election district for the term of one year, who shall possess the powers, be required to perform the duties, and be subject to the liabilities as other judges or inspectors of election, according to the general laws of the state of New Jersey as they now are or may hereafter be, and said judges so elected shall act as judges of all elections to be hereafter held in said districts; and the said judges and clerks compensation shall receive two dollars and a half per day for their services; and the said judges of election shall procure a place for holding all elections in each election district, of which place and time of holding elections they shall give at least two weeks' notice in five public places in said district.

CHAPTER CXLVI.

A Further Supplement to "An Act relative to Commissioners for taking the Acknowledgment and Proof of Deeds," approved April fifteenth, eighteen hundred and forty-six.

1. BE IT ENACTED by the Senate and General Assembly of the State of New Jersey, That it shall and may be lawful to appoint four commissioners for taking the acknowledgment and proof of deeds in the town of Newton, in the county of Sussex, and the borough of Belvidere, county of Warren, and four commissioners in each ward and township in the county of Passaic.

2. And be it enacted, That so much of the act to which this is a supplement as is inconsistent with or contrary to the provisions of this act, be and the same are hereby repealed. 3. And be it enacted, That this act shall take effect immediately.

CHAPTER CXLVII.

An Act to provide for the appointment of Commissioners to devise plans and make estimates for the opening, construction, and maintenance of one or more prominent avenues or highways in the county of Hudson.

WHEREAS, it is represented that certain roads, streets and highways in the county of Hudson may be so altered, widened and improved, that the same in connection with other grounds that may be taken for public highway purposes, will form one or more prominent thoroughfares in said county for purposes of recreation, pleasure and business and that it is expedient and desirable that one or more such prominent thoroughfares should be established in said county; and whereas it is further represented that said desired

1. BE IT ENACTED by the Senate and General Assembly of Appointment the State of New Jersey, That upon application made by the stoners to de board of chosen freeholders of the county of Hudson, in the public ave manner hereinafter directed, to the circuit court in and for' the said county, the said court shall appoint seven judicious persons, being freeholders and residents of said county, to be commissioners under this act, whose duty it shall be to inquire, ascertain and report as hereinafter directed, concerning the expediency of laying out, opening and constructing in the county of Hudson, one or more prominent public avenues, roads or throughfares, that shall be of greater width and require other proceedings and regulations than are now provided by law for the laying out, opening and maintaining of public roads and avenues or streets in this state, and that shall afford better facilities for recreation and pleasure to persons who may wish to travel upon the same with teams, carriages, on horseback, on foot or otherwise, for purposes of business or for pleasure and recreation or either; and the said conmissioners shall proceed to devise plans and general specifications for the location, width, manner of construction, maintenance, preservation, regulation and use of any such improvements, and also the mode in which the land and materials necessary for opening, constructing and maintaining the same ought to be acquired; they shall also estimate as nearly as they can, the cost of the land to be taken for the laying out of such improvements, also the cost of materials that shall be necessary to construct the same, together with the costs of construction and completion thereof; they shall also furnish an estimate of the probable annual expense for the proper maintenance, superintendence, repairs and ornamenting of any such public thoroughfare, avenue or road, as they shall recommend under this act, and of the grounds, promenades and walks pertaining thereto; the said commissioners shall keep a record of their proceedings and shall furnish in writing to the board of chosen freeholders of said county, on or before the fifteenth day of December next, a detailed report concerning the matters submitted to their investigation by this act, together with the proper drawings, plans and illustrations

adopted by them; the said commissioners shall also designate in their said report what further legislation will in their opinion be necessary and proper to carry into effect such plan or plans as they have adopted, and they may prepare a suitable bill for that purpose, to be submitted to the legislature; and it shall be the duty of the said board of chosen freeholders to transmit such report, drawings, plans and illustrations to the legislature on or before the first day of February, eighteen hundred and sixty-nine.

2. And be it enacted, That the said commissioners may in devising said plan and location for said improvement, include therein any roads or streets, or parts thereof already laid out opened or dedicated in said county, that may be advantageously included in said improvements, or be altered or widened so as to be adapted to the same.

3. And be it enacted, That the said commissioners shall so construct any plan adopted by them for said improvements, that the same shall not be inconsistent with, or necessarily require the alteration of the grades lawfully established in any parts of said county, for streets, by the proper municipal authorities.

4. And be it enacted, That the commissioners provided for engineers, &c. by this act, may employ one or more competent engineers, surveyors, draftsmen and other agents as they may require for accomplishing the duties assigned to them by this act, and the said commissioners and the persons employed by them as aforesaid, may at all proper times enter upon and survey any lands or waters in said county, in order to determine upon the proper locations, grades and construction of said improvements, and to make any examinations proper to accomplish the object of their appointment.

5. And be it enacted, That each of the said commissioners shall be paid for his services the sum of five dollars for each day he shall be actually engaged in the duties of his appointment; and every engineer, surveyor, draftsman or other person employed by said commissioners for the purpose contemplated by this act shall receive such compensation or wages for his services, as the said commissioners shall have agreed to allow for the same.

6. And be it enacted, That the said compensation for the servicees of the said commissioners, and of all persons employed by them pursuant to this act, shall be paid by the board of chosen freeholders of the county of Hudson, who shall include
