AN ACT to regulate the Payment of certain A.D. 1895. Moneys in aid of the Road Rates in certain

Road Districts and Towns.

[27 September, 1895.]

BE it enacted by His Excellency the Governor of Tasmania, by and

with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1 Out of the Consolidated Revenue Fund there shall be payable Road District the Treasurer in the year One thousand eight hundred and ninety- and Town Board subsidy.

1. To the Trustees of Road Districts to which this Act applies,
and in which a Road Rate of One Shilling in the Pound
shall have been made and levied in accordance with the

provisions of "The Roads Act, 1884," in the year ending 48 Vict. No. 28.
on the Twenty-eighth day of February, One thousand

eight hundred and ninety-six; and

II. To the Boards of Towns to which this Act applies, and in
which a Road Rate of One Shilling in the Pound shall

have been made and levied in accordance with the pro

visions of "The Town Boards Act, 1891," in the year 55 Vict. No. 41.
ending on the Thirty-first day of December, One thousand
eight hundred and ninety-five,

for and towards the construction and repair of Roads, Streets, and
Bridges, other than Main Roads, a sum equal to one-half part of the
amount of money collected by such Rates respectively.

2 A Town Board shall be deemed to have made and levied a Shilling Rate within the meaning of this Act in all cases where there has been levied in any year a Road Rate of not less than Nine Pence, which Rate, together with the Town or Drainage Rate, if any, made and levied in the same year amounts to or exceeds the sum of One Shilling in the Pound upon the annual value of the property within such Town; but any such Town Board shall only be entitled to a subsidy equal to one-half part of the Road Rate levied and collected for the year ending the Thirty-first day of December, One thousand eight hundred and ninety-five.

3 In no case shall there be paid to the Trustees of any Road District or to the Board of any Town a sum greater than one-half part of the proceeds of a Rate of One Shilling in the Pound upon the annual value of the property in such Road District or Town.

(1.) No subsidy shall be payable or paid under this Act to the Trustees of any Road District to which this Act applies unless the Statement and Account for the preceding year of such Trustees, as required by "The Roads Act, 1884," are forwarded to the AuditorGeneral before the Thirty-first day of March, One thousand eight hundred and ninety-six.

(2.) No subsidy shall be payable or paid under this Act to the Board of any Town to which this Act applies unless the Statement and Accounts of such Board for that year, as required by "The Town Boards Act, 1891," are forwarded to the Auditor-General before the last day of February, One thousand eight hundred and ninety-six.

5—(1.) This Act shall apply to every Road District and Town in which a Rate of One Shilling in the Pound has been made and levied during each of the Five years from 1890 to 1894, inclusive, and to the Districts and Towns next hereinafter mentioned, but to no others.

(2.) Where since the year 1890 a Road District has been established or a Town has been proclaimed under and for the purposes of "The Town Boards Act, 1891," and there has been made and levied in such Road District or Town in every year up to and inclusive of the year 1894 a Rate of One Shilling in the Pound, such District or Town shall be included in the provisions of this Act.

AN ACT Supplementary to the Act for A.D. 1895. appropriating certain Sums arising from the Consolidated Revenue Fund to the Service of the Colony of Tasmania for the Year 1895. [27 September, 1895.]

BE it enacted by His Excellency the Governor of Tasmania, by and

with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1 Out of the Consolidated Revenue Fund of the Colony of Tasmania Appropriation. there shall and may be appropriated, issued, and applied, in the manner hereinafter provided, for the service of the Year 1895, for the several purposes specified in the Schedule, any sum or sums of money not exceeding in amount respectively the several sums of money therein specified.

2 The Treasurer shall issue and pay the said several sums Moneys payable to such persons for the purposes hereinbefore mentioned, upon such by Warrant of days and in such proportions as the Governor, by any Warrant under his hand, from time to time, orders and directs; and the payments so to be made shall be charged upon and payable out of the Consolidated Revenue Fund of the said Colony.

3 The said Treasurer shall be allowed credit in his Accounts for any sums of money paid by him in pursuance of any such Warrant as Credit to be given aforesaid; and the receipts of the respective persons to whom the same

AN ACT to further amend "The Rabbits A.D. 1895.
Destruction Act, 1889."

[27 September, 1895.] BE it enacted by His Excellency the Governor of Tasmania, by and

with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1 This Act may be cited as "The Rabbits Destruction Amendment Short title. Act, 1895."

Notwithstanding anything to the contrary contained in Penalties imposed Section Thirty-six of "The Rabbits Destruction Act, 1889," all in Municipality expenses recovered by any Inspector appointed by the Municipal Rabbit Fund or Council of any Municipality under the provisions of "The Rabbits Municipal Fund. Destruction Amendment Act, 1893," and all penalties imposed under 53 Vict. No. 42. the said Act upon any information laid by any such Inspector as aforesaid, shall be paid to the Treasurer of the Rural Municipality within which such expenses or penalties are recovered or imposed.

(2.) If any Municipal Council shall have levied a Rabbit Rate in accordance with the provisions of "The Rabbits Destruction Amend- 57 Vict. No. 22. ment Act, 1893," and shall have created a separate Fund in the books of the Municipal Council as provided by Section Ten of the lastmentioned Act, all such expenses or penalties shall form part of such Fund.

(3.) If any Municipal Council shall not have levied a Rabbit Rate as herein before mentioned, all such expenses or penalties shall form part of the Municipal Fund of the Municipality.

3 This Act and "The Rabbits Destruction Act, 1889," and every Acts to be Act amending the same, save as amended by this Act, shall be read read together. and construed together as one and the same Act.
