AN ACT to further amend "The Constitution A.D. 1896.
Act."

[Reserved, 23 July, 1896; Royal Assent proclaimed, 13 November, 1896.]

WHEREAS it is expedient and necessary to further amend The PREAMBLE.

Constitution Act in certain particulars :

Be it therefore enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows

1 This Act may be cited as "The Constitution Amendment Act, Short title. 1896."

2 Section Twelve of "The Constitution Amendment Act, 1885," Repeal. and Sections Two and Three of "The Constitution Amendment Act, 49 Vict. No. 8. 1893," are hereby repealed: Provided this repeal shall not affect any57 Vict. No. 9. thing lawfully done under the authority thereof, nor any rights acquired or liabilities incurred thereunder.

3 The House of Assembly shall consist of Thirty-seven elected House of Members: but no person shall be capable of being elected a Member Assembly to of the House of Assembly who shall not be of the full age of Twentyone years, and a natural born or naturalized subject of Her Majesty, Their qualifior who has not obtained Letters of Denization or a Certificate of cations. 4 This Act and "The Constitution Act" and every Act altering or Acts to be read amending the same shall be read and construed together as one and together. the same Act.

WHEREAS it is deemed desirable to further amend the Law PREAMBLE.

relating to Bankers and to Loans made upon the security of Chattels :

Be it therefore enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1 This Act may be cited as "The Bankers and Loans Act, 1896."

2 If any question shall arise between any person or persons, Company or Companies, and any Bank or Banker as to the right, title, or interest of any one or more of such persons or Companies to or in any sum or money or other property deposited by them, or any one or more of them, or by any other person or persons, Company or Companies in any Bank, or as to the proper person or persons, Company or Companies, to demand and receive or to sign cheques or orders for payment or delivery of such sum or sums of money or other property, such Bank or Banker, or any one of such persons or Companies, may apply by summons or otherwise in a summary way to a Judge of the Supreme Court to determine such question, and such Judge may make such Order with respect to the money or property in dispute and as to the costs of and consequent on the application as he thinks fit, or may direct such

BE it enacted by His Excellency the Governor of Tasmania, by and

with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

Preliminary.

1 This Act may be cited for all purposes as "The Companies Act, Short title.

1896."

2 In this Act the expression "the principal Act" shall mean The Interpretation. Companies Act, 1869.

3 Any Company limited by Shares may, by Special Resolution, so far Power to Commodify the conditions contained in its Memorandum of Association, if pany to reduce authorised so to do by its Regulations as originally framed or as altered Capital. by Special Resolution, as to reduce its Capital; but no such Resolution for reducing the Capital of any Company shall come into operation until an Order of the Court is registered by the Registrar as is hereinafter mentioned.
