I.

An ACT for dividing certain Towns in the County of Greene.

BE

Paffed March 26th, 1803.

E it enacted by the People of the State of New-York, represent ed in Senate and Assembly, That from and after the firft 1 Monday of April next, all those several parts of the towns of Catfkill, Coxfackie and Freehold, included in the following bounds, viz. Beginning at an oak tree, on the bank of the Peetick creek, near the fulling mill of Ezekiel Benton, in the town of Coxfackie; thence northerly along faid creek, until it interfects the Schoharie turnpike road, at or near the dwelling-house of Calvin Wright; thence wefterly along said turnpike road, until it interfects the weft line of the town of Coxfackie; thence foutherly to where it interfects the Sufquehannah turnpike road, two chains fouth of the dwelling-house of Daniel Crane; thence in a direct line until it interfects the Batavia road, one chain north of the dwelling-houfe of Bildad Hines; thence continuing faid line to the fummit of the Catskill mountains; thence foutherly along the top of faid mountains, until it interfects the line run from the place of beginning, which faid line is fouth fixty degrees weft; thence to the place of beginning; fhall be and hereby are erected into a feparate town by the name of Canton; and the firft townmeeting fhall be held at the dwelling-houfe of Mary Carbine.

II. And be it further enacted, That all those several parts of the towns of Coxfackie and Freehold, included in the following bounds, viz. Beginning on the northwest bounds of the patent of Auguftus Prevoft; thence easterly along the lines of Freehold and Renfelaerville, until it ftrikes the weft line of the town of Coxfackie; thence easterly along the line of Coxfackie and Coeymans, three and an half miles; thence foutherly on a parallel line with the weft line of the town of Coxfackie, until it interfeet the Schoharie turnpike road; thence wefterly along faid turnpike road, until it interfects the weft line of the town of Coxfackie; thence fouth fixty-five degrees and thirty-fix minutes weft, to the middle of Catskill creek; thence up the middle of faid creek, fo far as where a straight line to be drawn from the west line of Auguftus Prevoft's patent, will interfect faid patent of Auguftus Prevost; thence to the place of beginning; fhall be and are hereby erected into a feparate town by the name of Greenfield; and the firft town-meeting fhall be held at the dwelling-houfe of Ell Knowles.

III. And be it further enacted, That all thofe feveral parts of the towns of Catskill and Freehold, lying west and southerly of the fummit of the Catskill mountain, fhall be and are hereby annexed to the town of Windham.

IV. And be it further enacted, That all the remaining parts of the towns of Catskill, Coxfackie and Freehold, fhall continue to be and remain feparate towns, and retain their former names.

V. And be it further enacted, That as foon as may be after the firft Tuesday of April next, the overfeers of the poor and the fupervifors of the faid towns, fhall after due notice being given for that purpofe, by the fupervisors of the faid towns, meet together and apportion the money and poor belonging to the faid towns, previous to the divifion thereof agreeable to the last tax lift, and that each of the faid towns fhall for ever thereafter refpectively maintain their own poor.

An ACT to divide the Town of Fabius, in the County of Onondaga.

Paffed April 4th, 1803.

E it enacted by the People of the State of New-York, represented in Senate and Assembly, That from and after the firfl Monday in March next, all that part of the town of Fabius, in the county of Onondaga, known by the name of Tully, together with all that part of the township of Sempronius, lying eaft of Skeneatelas lake, and diftinguifhed on the map of the furveyorgeneral of this ftate, as will appear on record in the secretary's office, fhall be and the fame is hereby erected into a feparate town by the name of Tully, and the first town-meeting in the faid town of Tully, fhall be held at the dwelling-houfe of Samuel 2 Trowbridge, in faid town; and that all the remaining part of the town of Fabius, fhall be and remain a feparate town by the name of Fabius.

II. And be it further enacted, That as foon as may be after the first Tuesday in March next, the fupervifors and overseers of the poor of the faid towns of Fabius and Tully, on notice being first given by the faid fupervifors for that purpofe, fhall meet together and divide the money and poor belonging to the town of Fabius previous to the divifion thereof, agreeable to the last tax lift, and that each of the faid, towns fhall for ever thereafter refpectively maintain their own poor.

An ACT to amend an Act, entitled "An Act to divide the Counties of

this State into Towns.

Paffed April 2d, 1803.

E it enacted by the People of the State of New-York, represented in Senate and Assembly, That from and after the paffing 1 of this act, all that part of the county of Chenango, comprehending the fecond, third, fourth and fifth of the twenty townships in faid county, fhall be and continue a town by the name of Hamilton, and that fo much of the act, entitled "An Act to divide the counties of this ftate into towns," as refpects the town of Hamilton, shall be and hereby is repealed..

II. And be it further enacted, That all that part of the faid 2 county of Chenango, bounded northerly by Cazenovia, weft by the weft bounds of the county, foutherly by a line beginning at the fouthwest corner of a tract of land commonly called De Ruyter township; thence easterly to the weft line of the tiventy townfhips; thence north to the fouthwest corner of township number feven; thence eaft to the foutheast corner thereof; then north by the weft line of Sherburne and Hamilton, fhall be and continue a town by the name of De Ruyter. And whereas part of the towns of Seneca and Jerufalem, as the fame are defcribed in the act, entitled "An Act for dividing the counties of this ftate into towns," paffed 7th April, 1801, is included within the bounds of the county of Cayuga: Therefore,

III. Be it further enacted, That fo much of the county of 3 Cayuga as is included within the towns of Seneca and Jerufalem, as defcribed in the faid act, be and the fame is hereby annexed to the county of Ontario; and fo much thereof as is included within the faid town of Jerufalem fhall be and the fame is hereby annexed to the town of Vernon, and the refidue thereof fhall belong to the town of Seneca.

IV. And be it further enacted, That it fhall be lawful for the fu- 5 pervifors of the county of St. Lawrence, and they are hereby authorized to receive the monies fubfcribed by the inhabitants of the faid county, for building a court-houfe and gaol on the east

fide of the mouth of the Ofwegotchie river, oppofite to the old 6 barracks; and to apply fuch monies for building the faid courthouse and gaol in fuch manner as they or the majority of them fhall judge most for the intereft of the faid county, and fhall account for the expenditures of the faid money, with the judges of the court of common pleas for the faid county.

V. And be it further enacted, That as foon as the faid fuperviTors, or a majority of them, fhall by writing under their hands certify to the fheriff of the faid county, that the gaol hereby authorized to be built, is fit for the reception of prifoners, it fhall and may be lawful for the faid fheriff, after filing the faid certifi cate in the office of the clerk of the faid county, to remove the prifoners into the faid gaol; which gaol thereafter fhall be the 8 gaol of the faid county and that as foon as the faid court-house is finifhed fufficiently, fo as to be comfortable for holding court, and a certificate thereof by the faid supervisors, or a majority of them, delivered to the judges of the faid court, and filed in the clerk's office, fhall thereafter be the court-houfe for the faid county, to all intents and purposes.

VI. And be it further enacted, That until further order of the legiflature it shall not be necessary for the fheriff of the faid county to give bonds to the people of this ftate for a larger fum than four thousand dollars, himself in one thousand dollars, and fix fureties in five hundred dollars each.

An ACT establishing an Allowance to the Commissioner of Excise in the City and County of New-York, and for other Purposes therein

Paffed February 22d, 1803.

E it enacted by the People of the State of New-York, represented in Senate and Assembly, That from and after the paffing of this act, the commiflioner of excife for the city and county of New-York, for the time being, fhall be entitled for his services to the fum of five hundred dollars per annum, instead of the compenfation now allowed by law, which it fhall and may be lawful for him to retain out of the monies which shall or may come in2 to his hands from the duty of excife aforefaid: And further, that the faid commiffioner fhall keep an account of the perfons to whom licences fhall be granted in the faid city and county, and of the fums by each of the faid perfons paid therefor, and file the fame with the chamberlain of the faid city on or before the last day of April in every year, instead of the time at prefent directed by law.

E it enacted by the People of the State of New-York, represented in Senate and Assembly, That from and after the first day I of October next, the city of New-York fhall be and hereby is divided into nine wards, in the manner following, that is to fay The firft ward fhall begin in the middle of Pearl-ftreet, at the 2 place where it is interfected by Pine-ftreet, and run from the said point of interfection along the middle of Pine-street to and across the Eaft river, in the fame direction to low water mark on Naffau island, and then along Nassau island shore at low water mark unto the fouth fide of Red-hook, and then across the North river fo as to include Nutton island, Bedlow's ifland, Bucking island and the Oyster islands, to low water mark on the weft fide of Hudfon's river, or fo far as the bounds of this ftate extend there, and up along the weft fide of Hudson's river, at low water mark, or along the limits of this ftate, to a place due weft from the middle of the west end of Thames-street; then due east to the middle of Thames-ftreet; then along the middle thereof to the middle of Broadway; then along the middle thereof to a place oppofite to the middle of Pine-street; then along the middle thereof to the place of beginning.

The fecond ward fhall begin at the foutheasterly corner of the first ward, and run along the easterly bounds thereof, across the Eaft river, to and along the middle of Pine-street, to the middle of Naffau-ftreet; then along the middle of Naffau-ftreet to a point oppofite the middle of George-ftreet; then along the middle of George-ftreet to and along the middle of Gold-ftreet, to the middle of Ferry-ftreet; thence along the middle of Ferry-ftreet and Peck-flip, on a direct line across the Eaft river, to Nassau island, at low water mark; then along Naffau island, at low water mark, to the beginning.

The third ward fhall begin on the weft fide of Hudfon's river, at the northwefterly corner of the firft ward; thence due eaft along that line acrofs Hudfon's river to the middle of Thamesfreet; then along the middle thereof to the middle of Broadway; then along the middle of Broadway, to a place oppofite to the middle of Pine-ftreet; then along the middle of Pine-ftreet to and along the middle of Naffau-ftreet, to a place opposite to the middle of Murray-ftreet; then to and along the middle of Murray-ftreet to Hudfon's river, and then continuing the fame courfe across Hudson's river to low water mark on the weft fide
