Precinct bonds

AN ACT to provide for the certification, registration and payment of precinct bonds.

Be it enacted by the Legislature of the State of
Nebraska :

SECTION 1. Whenever the holder of precinct bonds, issued under any law of this state for the purpose of the erection of bridges wholly within the limits of a county, shall present the same to the auditor and secretary of state, together with duplicate statements of the question of submission, notice and proof of publication, return of votes for and against, duly certified by the county clerk, it shall be the duty of said officers to examine said bonds and statements, and if they be satisfied that such bonds are in all respects in due form and been properly issued, to enter that fact upon the records of their respective offices, together with said statements, and thereupon the secretary and auditor shall place their joint certificate upon said bonds, and the auditor shall register the same in his office, such certificate showing that

such bonds were issued pursuant to law, the data filed with such officers being the basis of such certificate.

SEC. 2. Upon the registration of such bonds Auditor's it shall be the duty of the auditor to certify 7 Neb. 492. that fact to the proper county board, and there- 413. upon, said board shall, at the usual time of levying taxes in each year, levy a tax upon all the property of the proper precinct, sufficient to pay the annual interest on said bonds, and the principal thereof in accordance with the terms of the proposition under which said bonds were issued. Taxes so levied shall be collected by the county treasurer as other taxes are collected, and the amounts due on said bonds paid to the holder thereof.

CHAPTER 9.

AN ACT to authorize the sale of refunding bonds of pre-
cinct, and to provide for registering and certifying the
same. And all other precinct bonds that are or have been
legally issued and are not now in litigation.

in the state of Nebraska, and in case an exchange of said refunding bonds cannot be effected, the county commissioners are hereby authorized to sell said refunding bonds from time to time, at not less than their face value, in such sums as may be necessary to create a fund for the redemption of the outstanding bonds aforesaid, and the money realized from the sale of said refunding bonds shall not be expended or used for any other purpose than for refunding said outstanding bonds.

SEC. 2. It shall be the duty of the auditor of state to register such substituted bonds, and of the secretary and auditor of state to certify the same, and a tax to pay the interest and principal thereof shall be levied in the same manner as is now provided by law or the constitution in the case of other precinct bonds.

SEC. 3. That the county clerk of each county shall certify under the seal of the county to the auditor, the number, amount, and description of each bond cancelled, or to be cancelled and refunded, and the amount due thereon for principal and unpaid interest,, and thereupon the auditor is authorized to register a similar amount of refunding bonds, but in no case shall the auditor register any refunding bonds in excess of the amount so certified to him by the county clerk as aforesaid; and that said bonds shall be entitled to registration as aforesaid, in the order that they are presented to the auditor.

SEC. 4. That the registration provided for in this act shall apply to all refunding bonds

already issued, or to be issued in conformity with the provisions of this act. And all other precinct bonds that are, or have been legally issued, and are not now in litigation.

CHAPTER 10.

AN ACT to provide for the taking of a census, and to define the duties, powers and liabilities of officers, citizens, companies and corporations relative thereto.

Be it enacted by the Legislature of the State of
Nebraska:

SECTION 1. That a census of the population, when taken wealth and industry of Nebraska shall be taken

on or for the date of June first, eighteen hundred and eighty-five.

SEC. 2. Such census shall be taken under Superintend the direction of a superintendent, to be ap-ment and pointed by the governor, according to the schedules and forms of enumeration required by act of congress for the taking of the tenth census of the United States, and shall in all other respects conform thereto except as herein otherwise specially provided. Said superintendent shall, immediately upon receiving his appointment, procure copies of blank forms and schedules as prepared by the superintendent of the tenth census of the United States, and cause a

sufficient number of copies thereof to be printed and sent to enumerators of the census

or before the fifteenth day of May, 1885, together with such other full, complete and ample instructions as will insure accurate and complete returns; Provided, That facts and statistics required by such schedule to be obtained from railroad corporations, express companies, telegraph companies, telephone companies and insurance companies of this state shall be obtained by the superintendent direct from such companies as of date June 1, 1885, or for the fiscal year of such corporations or companies having its termination nearest to said day of June; and to this end, each and every one of such companies and corporations, by its officers and agents, shall, on or before the first day of August following, file with said superintendent duplicate schedules of such facts and statistics according to forms and schedules furnished by such superintendent, one copy of which shall be kept by said superintendent, and the other copy, duly authenticated by him, forwarded with other schedules and returns to the secretary of the interior of the United States as hereinafter provided; and each and every company or corporation required by this act to furnish such information, which shall fail so to do in manner and form and within the time required by this act, shall forfeit and pay the sum of five thousand dollars, to be recovered by civil action in the name of the state, to be brought by the attorney general; and each and every company or incorporation, incorporated
