HER Majesty the Queen of the United Kingdom of Great Britain and Ireland, and the Republic of Nicaragua, being desirous to maintain and improve the relations of good understanding which happily subsist between them, and to promote the commercial intercourse between their respective subjects and citizens, have deemed it expedient to conclude a Treaty of Friendship, Commerce, and Navigation, and have for that purpose named as their respective Plenipotentiaries, that is to say:

Her Majesty the Queen of the United Kingdom of Great Britain and Ireland, Charles Lennox Wyke, Esquire, Companion of the Most Honourable Order of the Bath, Her Britannic Majesty's Envoy Extraordinary and Minister Plenipotentiary on a Special Mission to the Republics of Central America;

Su Magestad la Reina del Reino Unido de la Gran Bretaña é Irlanda, y la República de Nicaragua, deseosas de mantener y mejorar las relaciones de buena inteligencia que felizmente existen entre ellas, y de promover el comercio entre sus respectivos subditos y ciudadanos, han juzgado conveniente concluir un Tratado de Amistad, Comercio, y Navegacion, y con ese objeto nombrado como sus Plenipotenciarios, á saber:

Su Magestad la Reina del Reino Unido de la Gran Bretaña é Irlanda, al Caballero Charles Lennox Wyke, Socio distinguido de la muy Honorable Orden del Baño, Enviado Extraordinario y Ministro Plenipotenciario de Su Magestad Británica, en Mision Especial á las Repúblicas de Centro-America ;

sident of the Republic of Nicaragua, Don Pedro Zeledon, Minister for Foreign Affairs;

Who, after having communicated to each other their respective full powers, found in good and due form, have agreed upon and concluded the following Articles:

ART. I. Her Majesty the Queen of the United Kingdom of Great Britain and Ireland recognizes the sovereignty and independence of the Republic of Nicaragua. Consequently, there shall be a perfect, firm, and inviolable peace and sincere friendship between Her Britannic Majesty and the Republic of Nicaragua, in all the extent of their possessions and territories, and between their subjects and citizens respectively, without distinction of persons or places.

II. The two High Contracting Parties being desirous of placing the commerce and navigation of their respective countries on the liberal basis of perfect equality and reciprocity, mutually agree that the citizens of each may frequent all the coasts and countries of the other, and reside therein, and shall have the power to purchase and hold all kinds of property which the laws of the country may permit any foreigners, of whatever nation, to hold, and to engage in all kinds of trade, manufactures, and mining, upon the same terms with subjects or citizens of other countries. They shall enjoy all the privileges and concessions in these matters which are or may

Quienes, despues de haberse comunicado sus respectivos plenos poderes, y de encontrarlos en buena y debida fornra, estipularon y concluyeron los Articulos siguientes:

ART. I. Su Majestad la Reina del Reino Unido de la Gran Bretaña é Irlanda reconoce la soberania é independencia de la República de Nicaragua. En consequencia habrá paz perfecta, firme, é inviolable, y sincera amistad entre Su Majestad Británica y la República de Nicaragua, en toda la extension de sus posesiones y territorios, y entre sus súbditos y ciudadanos respectivamente, sin distincion de personas ni de lugares.

II. Las dos Altas Partes Contratantes, deseosas de establecer el comercio y la navegacion de sus respectivos paises sobre bases liberales de perfecta igualdad y reciprocidad, mutualmente convienen en que los ciudadanos de cada una puedan frecuentar y habitar todas las costas y paises de la otra, en que puedan comprar y tener toda clase de propiedad que las leyes del pais permitan tener á los estrangeros de cualquier nacionalidad, y ocuparse en toda clase de comercio, manufactura, y mineria, en los mismos terminos que los súbditos ó ciudadanos de otros paises.

En lo relativo á estos objetos, gozarán de todos los privilegios y concesiones acordadas, ó que

The ships of war and PostOffice packets of each Contracting Party respectively, shall have liberty to enter into all harbours, rivers, and places within the territories of the other, to which the ships of war and packets of other nations are or may be permitted to come; to anchor there, and to remain and refit; subject always to the laws of the two countries respectively.

The High Contracting Parties further engage that neither will grant any favour to any other nation, in respect of commerce and navigation, which shall not immediately become common to the other Contracting Party.

III.* (Suppressed.)

* Article III was as follows "The High Contracting Parties agree that in regard to the coasting trade, the ships, subjects, and citizens of each shall enjoy, in the dominions and territories of the other, the same privileges, and shall be treated in all respects in the same manner, as national vessels and as native subjects and citizens."

en lo sucesivo se acuerden, á los súbditos ó ciudadanos de cualquier pais, y en la navegacion, comercio, y manufactura, gozarán de los derechos, privilegios, y exenciones de que gozan ó en lo futuro gozaren los súbditos ó ciudadanos naturales, sometiendose á las leyes establecidas, á que esten sujetos los súbditos ó ciudadanos naturales del pais. Los buques de guerra y paquetes correos de cada una de las Partes Contratantes, respectivamente, tendrán libertad de entrar en todos aquellos puertos, rios, y lugares del territorio de la otra, á que es ó en lo sucesivo fuere permetido llegar á los buques de guerra y paquetes de otras naciones; de echar anclas, permanecer, y repararse; siempre sujetos á las leyes de los dos paises respectivamente.

Las dos Altas Partes Contratantes se comprometen además, á que ninguna de ellas concederá favor alguno ó otra nacion, relativo al comercio y á la navegacion, que inmediatamente no se haga comun á la otra Parte Contratante.

III.* (Suprimido.)

"Las Altas Partes Contratantes convienen en que, con relacion al cabotage ó comercio costanero, los buques, los súbditos y ciudadanos de cada una, en los dominios y territorios de la otra, gocen de los mismos privilegios, y sean tratados bajo todos aspectos de la misma manera, que los buques nacionales y que los súbditos y ciudadanos naturales."

IV. The Contracting Parties likewise agree, that whatever kind of produce, manufacture, or merchandize can be, from time to time, lawfully imported into the British dominions in British vessels, may also be imported in vessels of the Republic of Nicaragua; and that no higher or other duties upon the vessel or upon her cargo shall be levied and collected, whether the importation be made in vessels of the one country or of the other; and in like manner, that whatever kind of produce, manufacture, or merchandize can be from time to time lawfully imported into the Republic of Nicaragua in its own vessels, may be also imported in British vessels; and that no higher or other duties upon the vessel or upon her cargo shall be levied or collected, whether the importation be made in vessels of the one country or of the other.

And they further agree, that whatever may be lawfully exported or re-exported from the one country in its own vessels to any foreign country, may in like manner be exported or re-exported in the vessels of the other country; and that the same bounties, duties, and drawbacks shall be allowed and collected, whether such exportation or reexportation be made in British vessels, or in vessels of the Republic of Nicaragua.

V. No higher or other duties shall be imposed on the importation into the British dominions of any article the growth, pro

Las Partes Contratantes convienen asimismo, en que cualquier clase de producto, manufactura, ó mercancia, que pueda ser de vez en cuando legalmente importada á los dominios Británicos en buques Británicos, pueda tambien ser importada en buques de la República de Nicaragua; y que no se impondrán ni exigirán otros ó mas crecidos derechos sobre el buque o sobre su carga, bien se haga la importacion en buques del un pais ó del otro; y de la misma manera, que cualquiera clase de producto, manufactura, ó mercancia que de vez en cuando pueda ser legalmente importada á la República de Nicaragua en sus propios buques, pueda tambien ser importada en buques Británicos; y que no se impondrán ni exigirán otros ó mas crecidos derechos sobre el buque ó sobre su carga, ora se haga la importacion en buques del un pais ó del otro.

Y ademas convienen en que cualquiera cosa que pueda ser legalmente exportada ó reexportada del un pais en sus propios buques, á cualquier pais extrangero, de la misma manera pueda ser exportada ó reexportada en buques del otro pais; y que se concederán y exigirán los mismos premios, impuestos, y rebajas, ya se haga la exportacion ó re-exportacion en buques Británicos ó en buques de la República de Nicaragua.

V. No se impondràn otros ó mas crecidos derechos á la importacion á los dominios Británicos, de cualquier artículo de vegeta

No prohibition shall be imposed upon the importation of any article the growth, produce, or manufacture of the territories of either of the two Contracting Parties into the territories of the other, which shall not equally extend to the importation of the same or the like article being the growth, produce, or manufacture of any other country: nor shall any prohibition be imposed on the exportation of any article from the territories of ither of the two Contracting Parties to the territories of the other, which shall not equally extend to the exportation of the same or the like article to the territories of all other nations.

VI. No duties of tonnage, harbour, pilotage, lighthouse,
