PROSECUTIONS FOR FINES.

110. Fines prosecuted by indictment or action on the case-officers ordering parade on days of election-neglecting to certify compensation listacting as an officer after appointment in the army-disobedience to orders in case of tumult, &c.-neglect by mayor and aldermen or selectmen, to provide arms-appointing meetings for elections on inspection days-neglect to provide powder for reviews-neglect to make returns of military stores-neglect to appropriate exempt money-neglect to examine compensation list, or draw orders-fines incurred by towns for refusals and neglects-having in possession certain articles belonging to the Commonwealth.

111. Fines prosecuted by commander of regiment or battalion-refusing to give notice in a company without officers-refusal of clerk of such company to return roll-refusal of mayor and aldermen or selectmen to return list of such company-for quitting platoon, or company, on regimental parade.

112. Fines prosecuted by captain, brigade major, or judge advocate-for refusal to perform the duties of clerk-fines incurred by members of brigade band-by sentence of court martial-costs against judge advocate to be paid by county treasurer.

113. Fines in company without officers.

114. Fines prosecuted by clerk-fines for absence, or disobedience in case of riot,
&c.-by musicians-for giving false information, by parents, guardians,
or masters-all fines not otherwise provided for, to be recovered by
clerk-information, when and where filed-form of information-when
information is filed, summons to be issued-form of summons-plead-
ings-what is sufficient evidence for the prosecution-secondary evi-
dence-clerk may be a witness-exemptions and excuses for infirmity,
how proved-captain may be a witness-execution, when issued-form
of execution-amendments of complaint-when no costs against com-
plainant-appeals when allowed-complaints by other officers.
115. Imprisonment on execution.

COURTS MARTIAL.

117. Complaint to be in writing, and to specify the offence—offences to be tried within one year.

118. Defendant to be put under arrest-not to resign while under arrest-copy of charges to be delivered ten days before trial-if not delivered, court may adjourn.
