IN obedience to the instructions contained in your Lordship's telegram of yesterday's date, I have the honour to transmit herewith copies of the notes addressed by Mr. Layard to Señor Sagasta, on the 11th of June and 13th of October, 1870, relative to the case of the "Tornado." YOUR Excellency's predecessor in the Department for Foreign Affairs, Señor Martos, informed Her Majesty's Government, by a note of the 29th of last October, that the Spanish Government proposed to give 1,500l. compensation to the sufferers of the "Tornado," to be distributed as Her Majesty's Government should think proper. The Earl of Clarendon lost no time in communicating to the representative of the officers and crew of that vessel the intention of the Spanish Government, but his Lordship has only been able to obtain from them during the present month a decisive answer as to whether he was prepared, on behalf of his clients, to reject or accept the sum thus offered to them. Mr. Forbes Campbell has now, however, stated his willingness to accept, unconditionally, the money in question. I am therefore instructed by the Earl of Clarendon to state to your Excellency that Her Majesty's Government are prepared to receive the 1,500l. for the purpose for which it is intended, on the understanding stipulated for by the Spanish Government, viz., that the payment of that sum to Her Majesty's Government should completely put an end to any kind of reclamation based on the capture of the "Tornado." Some doubt having arisen as to whether, in Señor Martos' note, the term "crew" ("los tripulantes") was intended to include the officers as well as the men of the "Tornado," and a question on this point having been raised by Mr. Forbes Campbell, I am further instructed by the Earl of Clarendon to express to your Excellency the hope that the Spanish Government will not object to allow the officers as well as the men to be included in the common term "crew" ("tripulantes "), among whom the money is to be divided.
