DECLARATION respecting Protection to British and Russian

Trade Marks.

Signed at St. Petersburgh, July 11, 1871.

THE Government of Her Majesty the Queen of the United Kingdom of Great Britain and Ireland, and the Government of His Majesty the Emperor of all the Russias, having recognized the necessity of defining and rendering more efficacious the stipulations contained in Article XX of the Treaty of Commerce and Navigation between Great Britain and Russia, signed on the 31st December, 185, the Undersigned, duly authorized to that effect, have agreed upon the following arrangements:

ARTICLE I.

The offering for sale or the placing in circulation of goods bearing counterfeit British or Russian trade marks, wherever fabricated, shall be considered as a fraudu lent operation prohibited within the territory of the two States, and shall be liable in England to the penalties prescribed by the Act of Parliament of 1862, and in Russia to the penalties prescribed by Articles 173-176 and 181 inflicted by Judges of the Peace, and by Articles 1665-1669 and 1671-1675 of the Penal Code (edition 1861).

Such fraudulent operation shall give the right before the Tribunals, and according to the laws of the country where it shall have been proved, to an action for damages, at the suit of the injured party, against those who may have been guilty thereof.

ARTICLE II.

British subjects who may desire to secure to themselves in Russia the proprietorship of their trade marks, shall be bound to register them at St. Petersburgh at the Department of Commerce and Manufac

tures.

In case trade marks should hereafter become subject to registration in England, the same rules shall be applied to Russian as to English trade marks.

La mise en vente ou en circulation de produits révêtus de marques de fabrique Anglaises ou Russes contrefaites en tout pays, sera considérée comme une opération frauduleuse, interdite sur le territoire des deux Etats et passible en Angleterre des peines portées par l'Acte du Parlement de 1862; en Russie des peines édictées par les Articles 173-176 et 181 infligées par les Juges de Paix, et les Articles 1665-1669 et 1671-1675 du Code Pénal (édition 1861).

Elle pourra donner lieu devant les Tribunaux, et selon les lois du pays où la dite opération frauduleuse aura été constatée, à une action en dommages intérêts valablement exercée par la partie lésée envers ceux qui s'en sont rendus coupables.

ARTICLE II.

Les sujets Anglais qui voudront s'assurer en Russie la propriété de leurs marques de fabrique, seront tenus de les déposer à St. Pétersbourg au Département du Commerce et des Manufactures.

Dans le cas où les marques de fabrique en Angleterre seraient dans la suite soumises à l'enregistrement, les mêmes règles seront applicables aux marques de fabriques tant Anglaises que Russes.
