CHAPTER XL.

A further SUPPLEMENT to an act entitled; " An act to prevent the exportation of Bread and Flour not merchantable, and for repealing at a certain time all the laws heretofore made for that purpose.

WHEREAS by the third section of a further supplement to the above recited act, passed the fifteenth day of March, one thousand eight hundred, it was made lawful to pack flour made of rye, and Indian corn, in white oak casks, but no provision was made therein for packing the same in red oak casks; For remedy whereof,

SECT. I. Be it enacted by the Senate and House of Representatives of the commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That from Flour & may and after the passing of this act, it shall be lawful for millers and bolters to pack any flour of rye or Indian corn in strong tight puncheons, to be well made of good seasoned red oak, with pine or other heads suitable for molasses casks, and to be bound and tightened with sixteen good and sufficient hoops, two of which, at least, shall be of iron, that is to say, the second from, each chine to be well secured with four nails in each chine hoop, and three wooden plugs or pegs at the upper edge of each upper bilge hoop, and to be of the same dimensions as the white oak cask referred to in the aforesaid supplement, to contain eight Tare to be mark- hundred pounds neat weight, having the tare or weight of the cask marked on it, and branded before it leaves the mill, bolting Brand to be affix-house or place where the same shall have been packed, with the number 1. 800. A SUPPLEMENT to the act entitled, "An act to enable the administrators of Mark Deary, late of the borough of Pittsburgh, deceased, to convey a certain lot of ground to the purchaser thereof.

WHEREAS the legislature of the last session did pass an act to enable the administrators of Mark Deary, deceased, to convey to his brother Francis Deary a certain lot of ground in the borough of Pittsburg; And whereas it appears that an error as to the number of said lot was inserted in the act, by which the intention of said administrators has been defeated; For remedy whereof,

SECT. I. Be it enacted by the Senate and House of Representatives of the commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the Administrators administrators mentioned in the act to which this is a supplement, of Mark Deary be, and they are hereby authorized to convey in fee simple, a vey, &c. lot on Virgin Alley, number four hundred and fourteen, in the general plan of the town of Pittsburg, to Francis Deary, as fully and effectually as they are authorized to convey the lot in the act to which this is a supplement.

CHAPTER XLII.

An ACT to enable the administrators of James Scott, late of the borough of Gettysburg, deceased, to convey a certain lot of ground therein described, to George Lashells.

WHEREAS it appears that James Scott, late of the borough of Gettysburg, in the county of Adams, deceased, did in his life time sell unto a certain Dixon Greer, a lot of ground in the said borough of Gettysburg, and received full payment for the same, of which sale there is no written evidence, and that the said Dixon Greer did afterwards sell the lot aforesaid to George Lashells, and received the purchase money in full, but could not make a title therefor as there exists no deed to him from the said James Scott, nor any written evidence of contract by which his administrators might, upon application to the court, be authorized to complete the title; Therefore,

SECT. I. Be it enacted by the Senate and House of Representatives of the commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That Ro bert Hays and John McConaughy, administrators of the estate of James Scott, deceased, be and they are hereby authorized and empowered by a sufficient deed or deeds in law, to convey, release and assure to George Lashells, his heirs and assigns, a lot of ground in the borough of Gettysburg, in the county of Adams, situate on the north side of Middle-street, numbered one hundred and forty-four, with all the right, title, interest, property and estate whatsoever, which the said James Scott had in his life time to the said lot of ground, with the appurtenances, which deed or deeds when executed by the said administrators, shall be as good and effectual in law, to all intents and purposes, as if the said James Scott had fully executed his contract aforesaid, and conveyed said lot of ground to the purchaser in his lifetime.

An ACT supplementary to an act entitled " An act to enable the governor to incorporate a company to make an artificial road from the east end of Perkiomen bridge, in the county of Montgomery, passing through Pottsgrove and by the White Horse tavern, in Amity township, to the borough of Reading in Berks county.

SECT. I. BE it enacted by the Senate and House of Representatives of the commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That John Clement Stocker, William Allibone, Joseph E. Howel, Mark Richards, John Vaughan, Jeremiah Piersol and George W. Morgan, of the city of Philadelphia; Thomas Norton James Hart, William West and John Barclay, of the Northern Liberties; John M. Price, Samuel Mechlin, junior, and Jacob Rex of Germantown; Samuel Maulsby, Daniel Hitner and Matthias Shively, of Montgomery county; George Douglass, Matthew Brooke, John Brower, Conrad Fegar and Lewis Reese, of Berks county, be and they are hereby appointed commissioners who shall have like powers, and be subject to like duty as those already appointed by the act to which this is a supplement.

An ACT confirming the title of Fames French, an alien, a man of colour, to a piece of land in the county of Chester.

SECT. I. BE it enacted by the Senate and House of Represen tatives of the commonwealth of Pennsylvania, in General Assembly

met, and it is hereby enacted by the authority of the same, That the Title of James title of James French, of the township of New London, in the tain tract of land County of Chester, (an alien, a mán of colour,) to a certain tract of land containing nineteen acres, three quarters and thirty perches, situate in the township aforesaid, is hereby confirmed as far as the same may be deficient on account of the said James French being an alien, and any conveyance or assurance which he may make of the premises shall be, to all intents and purposes as good and sufficient as if the said James French had been a citizen of the United States, at the time he acquired the tract or piece of land aforesaid.

CHAPTER XLV.

An ACT to authorize John Umstead to erect a mill-dam in the river Schuylkill, in the county of Montgomery.

WHEREAS John Umstead of the county of Montgomery, proprietor of an island in the river Schuylkill known by the name of "Pennebecker's island," and also of a tract of land including the eastern bank of said river, opposite to the island aforesaid, has requested from the legislature permission to make a dam from said island to the eastern bank aforesaid, for the purpose of erecting a mill or other water works; And whereas a dam has been heretofore erected by the commissioners for improving the navigation of said river from the eastern shore above the said island extending to the head of the same, in order to turn the water into and deepen the channel on the west side of the island. And as it therefore appears that a compliance with the wishes of the said Umstead will not injure the navigation of the river or obstruct the passage of fish, but will be an advantage to the public as well as to the individual; Therefore,

SECT. I.
