CHAPTER CLXVI.

An ACT authorizing Bethuel Vincent, guardian of the minor daughters of Peter Housel, deceased, to sell a house and lot of ground in Milton, in the county of Northumberland, the property of the said minors.

WHEREAS Peter Housel of Milton, in the county of Northumberland, died intestate, seized in his demesne as of fee, of a certain house and lot of ground in the town of Milton aforesaid, and it appears that the buildings on said lot are in a decaying state, being of wood, and out of repair, are not in a situation to rent for near the interest of the money which would arise out of an advantageous sale, which it appears the guardian of the said minors has now a good prospect of making, provided he be authorized to sell: Therefore,

SECT. I. CHAPTER CLXVII.

An ACT authorizing the courts of quarter sessions of Butler and Mercer counties, to direct a review of parts of certain state roads therein mentioned.

SECT. I. An ACT for the relief of Susanna Burras.

SECT. 1. BE it enacted by the senate and house of representatives of the commonwealth of Pennsylvania in general assembly met, and it is hereby enacted by the authority of the same, That

CHAPTER CLXIX.

An ACT dissolving the marriage of Elsa Middough, and Levi
Middough.

WHEREAS it appears to the legislature, that Elsa Vangorden was, on the eighteenth day of December, one thousand seven hundred and ninety-five, joined in marriage to Levi Middough, with whom she lived about fourteen years, in which time she had five children; that during the time the said Elsa continued to live with the said Levi, he treated her in a most cruel and inhuman manner, by beating her, and at different times threatening to take her life, so that she was often obliged to fly to her neighbours for protection, and it also appears that the said Elsa is a woman of good moral character: And whereas, it would be cruel in the extreme to oblige a woman to live with a man that has continued so inhumanly and barbarously to treat her: Therefore,

SECT. I. Be it enacted by the senate and house of representatives of the commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the marriage contract entered into by the said Elsa Middough and Levi Middough, her husband, be, and the same is hereby declared to be null and void, and they are hereby set free and discharged from the marriage contract, and all duties arising under the same, as fully and absolutely as if they had never been joined in marriage; but nothing herein contained shall But not to af- be construed to affect or render illegitimate any children born fect, &c. any of the said Elsa during the coverture.

CHAPTER CLXX.

An ACT authorizing the sale of the real estate of John Hannab, deceased.

WHEREAS it has been represented to the legislature, that John Hannah, late of the township of Antrim, and county of Franklin, died intestate, leaving neither widow nor issue, and at the time of his death was seized in his demesne, of and in a certain piece of ground situate in the township and county aforesaid, containing eighty-three acres and one hundred and nine perches, which land descended to his four sisters, to wit, Sarah, wife of James Morrow, Elizabeth, wife of Henry Morrow, Jane, wife of John Wherey, and Anne, wife of Samuel Adams; and whereas it appears that Anne, wife of Samuel Adams, has since deceased, leaving her fourth part of said estate to be divided amongst her six children, four of whom are yet minors; and as it appears that the said estate is annually sinking by reason of taxes and depredations, it would be much to the benefit of all parties concerned it should be sold, and the shares of the minors put out to interest for their maintenance and education: Therefore,

SECT. I. Be it enacted by the senate and house of representatives of the commonwealth of Pennsylvania, in general assembly met, and it is hereby enacted by the authority of the same, That The adminisit shall and may be lawful for James Morrow and Henry trators of the Morrow, administrators of the estate of John Hannah, de- estate of John Hannah, de ceased, either by public or private sale, to sell and convey all ceased, authe right, title, and interest, which the said John Hannah had, thorized to at the time of his decease, to a lot or piece of land, containing eighty-three acres and one hundred and nine perches, being and situate in Antrim township, Franklin county, and the sale and conveyance made by the said James Morrow and Henry Morrow, to any purchaser or purchasers, shall be as good and available in law, as if the same had been made by the said John Hannah, the intestate in his lifetime, the proceeds of which sale shall go in the same manner and proportion, and to the same persons or their legal representatives, as it would have done agreeably to the provisions of the intestate law, had not this act been passed: Provided, that before the said James Proviso. Morrow and Henry Morrow shall proceed to sell the said lands, they shall enter into bonds with sufficient surety, to be approved of by the orphans' court of the county of Allegheny, for the due execution of the trust hereby reposed in them, and for the faithful appropriation of the proceeds of the sale. CHAPTER CLXXI.

An ACT to authorize the governor to appoint commissioners to lay out a state road, beginning at the Burnt Cabins in Bedford county, thence to Waterford in Mifflin county, thence either to the mouth of Fishing creek, or to Clark's ferry, in Cumberland county.

SECT. I. And be it further enacted by the authority aforesaid, That the said commissioners shall receive each, two dollars for every day they shall be necessarily employed in the service aforesaid, together with a reasonable compensation for the hands necessarily employed in surveying, chaining, and marking the lines of the aforesaid road; and the expense that may commission- be so incurred in laying out and marking the same in each of the several counties through which it may pass, shall be paid by the counties respectively, on warrants drawn by the county commissioners of each, on the treasurer thereof, in favour of the commissioners to be appointed as aforesaid.
