CHAPTER CXLIV.

A SUPPLEMENT to an act, entitled "An act authorizing the governor to purchase from Farrand, Hopkins, Zantzinger, and company, five hundred copies of Purdon's abridgment of the laws of Pennsylvania, and to provide for the distribution thereof."

SECT. I. BE it enacted by the senate and house of represen tatives of the commonwealth of Pennsylvania, in general assembly met, and it is hereby enacted by the authority of the same, That the governor of this commonwealth is hereby authorized to draw his warrant on the state treasurer, in favour of Farrand, Hopkins, Zantzinger, and company, for the sum of two thousand two hundred and fifty dollars, as soon as the said firm, shall have delivered to the secretary of the commonwealth, five hundred copies of Purdon's abridgment of the laws of Pennsylvania, which the governor was required to purchase, by the act to which this act is a supplement.

CHAPTER CXLV.

An ACT to dissolve the marriage contract between Jacob Zinn, junior, and Eve his wife.

WHEREAS it appears that Jacob Zinn, junior, was married to a certain Eve Ermel, on the fifteenth day of November, one thousand eight hundred and eight, and that the said marriage took place in consequence of the said Eve having taken an oath before Henry Reim, esq. of Lancaster

county, on the eleventh day of November, in said year, charging the said Jacob with being the father of a child, with which she was then pregnant, it further appears that the said Eve did on the seventh day of the same month, of the same year, appear before Peter Nagle, esquire, of Berks county, and on her oath did declare and say, that Jacob Sando was the father of a child of which she was then pregnant, from all which it appears that the said Jacob Zinn was by intimidation and fear, and in the years of his minority, under the age of eighteen years, compelled to enter into the marriage contract, contrary to his own free will and consent, and in consequence of the oath of a person, which in the nature thereof cannot be true: Therefore,

dissolved.

SECT. I. CHAPTER CXLVI.

An ACT enabling Henry Manifold and Andrew Clarkson, of York county, to make and execute a deed of conveyance for a certain tract of land.

BE it enacted by the senate and bouse of representatives of the commonwealth of Pennsylvania, in general assembly met, and it is bereby enacted by the authority of the same, That Committee of Henry Manifold, and Andrew Clarkson, of Chanceford township, Joseph Maniin the county of York, be and they are hereby authorized and fold, a lunatic, empowered to make and execute, a sufficient deed or deeds of sell his real conveyance, to William Douglass of said county, for a tract of estate land sold as the property of Joseph Manifold, a lunatic; which deed or deeds of conveyance shall be as good and valid in law, to all intents and purposes, as if the said Joseph Manifold had sold and conveyed the same while of sound mind and memory; Provided, that the said Henry Manifold, and Andrew Clarkson, To enter into recognizance, shall, before they proceed to convey the estate of the said Joseph

Manifold, enter into recognizance, with sufficient security, before the court of common pleas of York county, that all the monies arising from the sale of the said tract of land, shall, after paying the just debts of the said lunatic, be so disposed of, as will be most beneficial for him and his family.

CHAPTER CXLVII.

An ACT enabling the governor to incorporate a company, for making an artificial road from the Philadelphia and Lancaster turnpike road, at or near Kennedy's tavern in the county of Lancaster, through Lititz to the town of Manheim, in said county.

SECT. I. Be it enacted by the senate and house of represen tatives of the commonwealth of Pennsylvania, in general assembly met, and it is hereby enacted by the authority of the same, That Commission Nathaniel Lightner, David Woods, Christian Hess, Christian ers appointed. Mathias Tshudy, Samuel Ensminger, and Peter Hensleman, of
the county of Lancaster, be and they are hereby appointed com-
missioners, to do and perform the several duties hereinafter men-
tioned, that is to say, they shall, on or before the first of June next,
procure one or more books, and enter therein as follows; "We
whose names are hereunto subscribed, do promise to pay to the
president, managers and company, of the Manheim and Lititz
turnpike company, the sum of fifty dollars for each and every
share of stock in the said company set opposite to our respective
names, in such manner and proportions, and at such times as shall
be determined by the said president and managers, in pursuance
́of an act of the general assembly of this commonwealth, entitled
"An act enabling the governor to incorporate a company, for
making an artificial road from the Philadelphia and Lancaster
turnpike road at or near Kennedy's tavern in the county of Lan-

SECT. III. And be it further enacted by the authority aforesaid, That the commissioners aforesaid, as soon as conveniently may be after the said letters patent shall be sealed and obtained, shall give notice in two or more of the newspapers, printed in the borough of Lancaster, of a time and place by them to be appointed, not less than twenty days from the publication of the first notice; at which time and place the subscribers shall proceed to organize the said corporation, and shall choose by a majority of votes of the said subscribers, then present, by ballot, to be delivered in person or by proxy duly authorized, one president and ten managers, one treasurer, and such other officers as they shall think necessary to conduct the business of the said company for one year, and until such other officers shall be duly chosen; and the managers so chosen, and their successors, shall and may make Of by-laws, such by-laws, rules, orders and regulations, not inconsistent with

the constitution and laws of the United States, or of this commonwealth, as shall be necessary for the well ordering the affairs of the said company; and generally have like powers, authorities, and privileges, necessary for carrying on and completing the said turnpike road; and be subject to all the duties, qualifications, restrictions, penalties, fines and forfeitures, and be entitled to like tolls and profits, in proportion to the distance as are given and granted to the president, managers and company, of the Gap Who shall be and Newport turnpike road; Provided, that no toll be demanded or taken from any person passing or re-passing from one part of his or her farm to another, or to and from any place of public worship, or funeral, to or from the militia on days of training; And provided also, that if the company shall not proceed to carry on the said work in three years after the passing of this act, or shall not within ten years after the passing of this act, complete the said road according to the true intent and meaning of this act, then and in either of these cases, all and singular the rights liberties and franchises hereby granted to the said company, shall revert to this commonwealth.
