CHAPTER XLII.

An ACT for the relief of Robert Coleman and Cyrus Jacobs.

WHEREAS the commissioners appointed to sell the lands of the late John Nicholson, on which the commonwealth had a lien, notwithstanding the act under which the sales were to be made, directed that said lands, should be sold in the county, in which the same were situated, did sell in the borough of Lancaster, lands, which are situate in the county of Berks, whereby the purchasers, were prevented, contrary to the intentions of the legislature, from having a convenient opportunity at the time of sale, to examine the county records, or correctly learn the title: And whereas, Robert Coleman and Cyrus Jacobs, purchased a tract, so sold, on which it appears there was a lien, under mortguage to Isaac Snowden, prior to the lien of the commonwealth, for so large a sum of money, that the commonwealth could have no interest therein: Therefore,

CHAPTER XLIII.

A SUPPLEMENT to an act entitled "An act to provide for the erection of an additional court within the city and county of Philadelphia.

WHEREAS it appears, from the number of causes transferred into the district court of the city and county of Philadelphia, and the accumulation of business therein that the said court will have to sit nine months in every year and whereas, it is just and reasonable that the judges who have to devote so great a part of their time to the duties imposed on them, as to prevent their attending to any other business, should receive a compensation proportionate to their services: and whereas the salaries of the assistant judges of said courts are inadequate to the duties to be performed by them; Therefore,

SECT. I. And be it further enacted by the authority aforesaid, Penalty on defaulters That every person whose name shall be drawn, and who shall have been legally summoned, but who shall not appear before the court, after being called three times, and due proof made by oath or affirmation, of the sheriff or other credible person, that each person so making default, had been lawfully summoned, shall forfeit and pay for such default, in not appearing, any fine not exceeding thirty dollars, that the court may think proper to inflict; and every juror, including those who shall not have appeared as aforesaid, shall forfeit and pay for every default in not answering, when called during the said term, such fine not exceeding five dollars, as the court may think How to be reproper; which fines the court may direct the sheriff to levy covered. and collect in the usual manner, and the said fines when col

CHAPTER XLIV.

An ACT granting an annuity to Henry Pensinger, an old soldier, who lost a leg in the revolutionary war.

SECT. I. BE it enacted by the senate and house of represen tatives of the commonwealth of Pennsylvania, in general assembly met, and it is hereby enacted by the authority of the same, That the state treasurer be, and he is hereby directed to pay to Henry Pensinger, or his lawful attorney, the sum of forty dollars immediately, and the further sum of sixty dollars annually during life, in half-yearly payments, out of any money in the treasury not otherwise appropriated, to commence on the first day of January, one thousand eight hundred and twelve.
