CHAPTER XXXIII.

An ACT for the relief of James Meloy.

WHEREAS it appears, that James Meloy, late sheriff of Cambria county, by an unavoidable accident, when on his way to the seat of government, in the year one thousand eight hundred and eight, was prevented from making the return of the election, for electors of president and vice-president of the United States, in the time prescribed by law, by reason of which the accounting officers were not authorized to settle the account of said Meloy, for making said return: For remedy whereof,

SECT. 1. Be it enacted by the senate and house of representatives of the commonwealth of Pennsylvania, in general assembly met, and it is hereby enacted by the authority of the same, That the Account of J. accounting officers, be, and they are hereby authorized and required to settle, and pay the account of the said Meloy, for making the aforesaid return, in the same manner, and on the same conditions he would have been entitled to, had he made the said return, in the time prescribed by law.

CHAPTER XXXIV.

An ACT to incorporate Loller academy, in the village of Hatborough, in the county of Montgomery.

WHEREAS Robert Loller, late of the county of Montgomery, deceased, by his last will and testament, devised a considerable portion of his estate to Nathaniel B. Boileau, in trust, for the erection of a suitable building for an academy, near the village of Hatborough, and also for keeping the said building in repair and paying the salaries of such teachers as the trustees of the said academy, when incorporated, should employ: And whereas, the said Nathaniel B. Boileau has erected a suitable building, agreeably to the testament and last will of the said Robert Loller, and prays an act of incorporation, to enable him to perfect the generous intention of the said deceased: Therefore,

SECT. II. And be it further enacted by the authority aforesaid, That the first trustees of Loller academy shall consist of the following persons, to wit: Nathaniel B. Boileau, Nathaniel Irwin, Thomas B. ty, to take and hold, to them and their successors, for the use of said academy, lands, tenements, hereditaments, goods and chattels of what kind, nature, or quality soever, real, personal or mixed, by the gift, grant, bargain, sale, conveyance, assurance, will, devise, or bequest of any person or persons whomsoever, capable of making the same; and all and every the estate, real, personal, and mixed, given, granted, and vested by the said last will and testament of the said Robert Loller, deceased, to, and in the said Nathaniel B. Boileau, and all the buildings, and improvements made by the said Nathaniel B. Boileau, be, and the same are hereby transferred, set over, and vested in the said trustees, and their successors forever; and the said trustees and their successors, are hereby empowered to erect such other buildings, and make such other improvements, as may be found necessary for said institution; and generally to do and perform all and singular, the matters and things which shall be lawful for them to do, for the well being of the said academy, and the due management and ordering the affairs thereof.

SECT. III. And be it further enacted by the authority aforesaid, That the said trustees, and their successors, shall have full power and authority to use one common seal; and the same to alter and renew at their pleasure.

SECT. IV. And be it further enacted by the authority aforesaid, That the said trustees shall hold their first meeting at the said Academy, on the second Monday of February, eighteen hundred and twelve, a majority of whom shall constitute a quorum to transact the business of the said academy; particularly of making and enacting ordinances, by-laws and regulations, for the government of said academy; of electing and appointing a master and tutors; of agreeing with them for their salaries, and of removing them; of appointing a treasurer, secretary, managers, and other necessary officers, for taking care of the funds, and managing the concerns of the corporation; and determining and transacting all matters and things, necessary to be de

SECT. V. CHAPTER XXXVII.

An ACT to enable William Scott, and John Galloway, administrators, with the will annexed, to the estate of Archibald Scott, deceased, to sell and convey a certain tract of land therein mentioned.

WHEREAS it appears that Archibald Scott, late of east Huntingdon township, Westmoreland county, on the seventh day of December, one thousand eight hundred and four, duly made and published his last will and testament, and therein did order his plantation to be sold by his executors, for the best price to be gotten for it; and that the monies thence arising, should be appropriated for the maintenance of his widow, the support and education of his children; some of whom are yet minors; that the said testator died without nominating any executors of said testament; that said Archibald Scott, at, and immediately before his decease, was seized in fee of a certain plantation, situate in the township and county aforesaid, containing one hundred and twenty-six acres, more or less, and which is the same plantation directed by his will to be sold: and it further appears that William Scott and John Galloway, became administrators, with the will annexed, of the said Archibald Scott, deceased: and whereas, the said administrators have represented to the legislature, that although the circumstances of the family, as well as the directions given in the will, require a sale to be
