Certain fireets

forthwith.

the paffing of this act, one or more rate or rates, affeffment or affeffments, fhall twice in every year, or oftener, if it fhall be thought needful by the faid commiffioners, or any five or more of them, be made, laid, and affeffed, by the faid commiffioners, or any five or more of them, within their respective divifions, of and upon all and every perfon and perfons, who do or fhall inhabit, hold, or occupy any land, houfe, fhop, warehouse, cellar, vault, or other tenement, within the faid ftreets and lanes refpectively, herein before directed and appointed to be in the first place paved; and upon all and every perfon and perfons who do or fhall inhabit, hold, or occupy, any land, houfe, fhop, warehouse, cellar, vault, or other tenement, within all other streets, lanes, and places, comprized within this act, when and fo foon as the fame fhall refpectively be begun to be paved by virtue of this act, in fuch competent fum and fums of money, as the faid commiffioners, or any five or more of them, fhall yearly, and every year, order and direct; fo as fuch rates or affeffments, do not exceed in the whole, the fum of two fhillings in the pound, in any one year, of the yearly rent of fuch lands, houfes, fhops, warehouses, cellars, vaults, and other tenements, within the said streets and lanes refpectively; nor more than one half part of such rates or affeffments, in any one year, of fuch yearly rent, within all wharfs; and the faid courts, yards, alleys, paffages, and places, as aforefaid, inns, and livery ftables, the entrances or gateways only of which faid inns and livery stables, are in the said streets or lanes refpectively.

LII. And whereas the paving of the faid ftreets, lanes, and places, may be light- will neceffarily require a courfe of time to compleat the fame; and ed, watched, whereas it may be found neceffary forthwith to light, watch, and and cleaned, cleanfe, the high fireet, from the fouth end of London Bridge, to the ftones end in Blackman Street, Church Lane, Kent Street, and White Street; and alfo from the west end of Tooley Street to the east end thereof; and also the feveral other fireets, lanes, and places, lying within the faid parish of Saint Olave; and also from the north end of Bermondsey Street, and through Bermondsey Street to the Hand and Marygold, at the fouth end thereof; and alfo the feveral other courts, yards, alleys, paffages, and places, immediately communicating with or adjoining to the fame; be it therefore further enacted by the authority aforefaid, That it shall and may be lawful to and for the faid commiffioners, or any five or more of them, within their refpective districts, to make a rate or rates, twice or oftener in every year, as it shall be found neceffary, upon all and every person and persons who do or fhall inhabit, hold, occupy, or enjoy, any land, house, shop, warehouse, cellar, vault, wharf, or other building or tenement, dead wall, or void space of ground, within or communicating with the faid laft mentioned parish, streets, and places refpectively, in fuch competent fum and fums of money as they the faid commiffioners, or any five or more of them, fhall think fufficient; and shall and may apply the fame in cleansing,

cleanfing, watching, and lighting, the fame ftreets, lanes, and places refpectively, under the powers and authority of this act, although the fame fhall not be begun to be paved by virtue of

this act.

LIII. LIV. LV. And be it further enacted by the authority aforefaid, Rates to be That all rates, made by virtue of this act, fhall be allowed and figned by two figned by two juftices of the peace acting in and for the faid Manner of justices. town or places, who are also hereby impowered and required to recovery. grant a warrant or warrants for collecting and levying the fame; and the faid rates, after the same shall be so allowed and figned by the faid jufticcs, fhall be collected half yearly by such perfon or perfons as the faid commiffioners, or any five or more of them, fhall, by writing under their hands and feals, appoint: and if any person or persons shall refuse, neglect, or omit, to pay the fum or fums of money, which he, she, or they, fhall be rated or affeffed, for the fpace of ten days after perfonal demand made thereof, or demand in writing left at the place of abode or occupation of fuch perfon or perfons; then, and in every fuch cafe, it fhall and may be lawful for the faid collector or collectors, and he and they is and are hereby authorized and required to levy the fum by diftrefs and fale of the goods and chattles of fuch perfon or perfons fo neglecting, refufing, or omitting, to pay the fame and in cafe no fuch goods or chattles can be found to be fo diftrained; or in cafe fuch goods and chattles fhall be locked up or fecured, or removed from the faid collector or collectors, fo that he or they cannot diftrain the fame; then, and, in either of the faid cafes, upon information thereof given to the faid juftices, or any two justices of the peace for the faid county or borough, it shall and may be lawful for fuch juftices, and they are hereby required to commit the offender or offenders to the common gaol or house of correction for the faid county or borough, there to remain, VOL. without bail or mainprize, for any time not exceeding the space of one month, or until the payment of fuch rate or affeffment, and reasonable charges occafioned by the non-payment thereof.

LVI. Provided always nevertheless, and be it further enacted by the authority aforefaid, That the rates to be affessed upon the inhabitants and occupiers of fuch wharfs, fhall not exceed one half of the rates which fhall be affeffed upon fuch lands, houfes, fhops, warehouses, cellars, vaults, and other tenements, as fhall be new paved by virtue of this act.

LVII. And whereas many houfes within the faid ftreets and other places are, by the feveral owners or proprietors thereof, lett out in lodgings or tenements to divers tenants, whereby it will be difficult to rate and affefs fuch houses, or to recover fuch rates and assessments when made; for remedy whereof, be it further enacted by the Where houses authority aforefaid, That it thall and may be lawful to and for are lett out in the faid commiffioners, or any five or more of them, from time to time, and at all times, when they meet to make a rate in owners are to purfuance of this act, to rate and affefs the owner or owners of fuch houfes or tenements as fhall be lett to, or occupied by, two or more tenants; which rate and affeffment fhall be paid by one or more of the tenants or occupiers of any part or parts of fuch houfes and in cafe any occupier or occupiers of any part of fuch houfes or tenements fhall refufe to pay the fame; then, the faid rate and affefiiment fhall be levied by diftrefs and fale of the goods of him, her, or them, fo refufing to pay the fame; and fuch occupier or occupiers of fuch tenements refpectively, is and are hereby required and authorized to pay fuch fum and fums of money, as thall be fo rated or affeffed on the owner or owners of fuch houfes, in pursuance of this act, and to deduct the fame out of the rent thereof; and the owner or Owners, proprietor or proprietors thereof, are hereby required to allow fuch deductions and payments, upon the receipt of the refidue of their rents; and every fuch tenant, paying fuch rate or rates, affeffment or affeffments, fhall be acquitted and difcharged for fo much money as the said rate or rates, affeffment or affeffments, fhall amount unto, as if the fame had been actually paid to fuch perfon or perfons to whom his, her, or their rent fhould have been due and payable.

LVIII. Provided always, and be it further enacted by the authority aforefaid, That it fhall and may be lawful for the faid commiflioners, or any five or more of them, from time to time, compounded to compound with the owner or owners, proprietor or proprietors, of any fuch houfes, or any other houfes within the faid ftreets and places, the annual rent or value whereof shall be under twenty pounds, for the rate by this act authorized to be laid upon fuch houses; so as in fuch compofition there be not remitted to any fuch owner or owners, proprietor or proprietors respectively, more than one third of the rate by this act laid upon fuch houfes refpectively.

LIX. And be it further enacted by the authority aforefaid, That in cafe it fhall fo happen, that any of the lands, houfes,

fhops, warehouses, cellars, vaults, or other tenements, or any part or parts thereof, within the faid ftreets and places, or any or either of them, fhall, at any time from and after the making of the faid rate or rates, affeffment or affeffments, be empty, untenanted, or unoccupied; that then, and in every fuch cafe, owners to be one half of the faid rate or rates, affeffment or affeffments, or charged only the one half of fuch other rates as may be affeffed by virtue of the rates, this act, thall be paid by the owner or proprietors of fuch lands, houfes, fhops, warehouses, cellars, vaults, or other tenements; and in cafe of non-payment thereof, fuch lands, houfes, fhops, and the prewarehouses, vaults, cellars, or other tenements, fhall be, and miffes to rethe fame are hereby made a fecurity for and chargeable with main a fecurity.

LX. And, to the end the faid rates may be more effectually col- Tenants and lected and received, be it further enacted, That all and every occupiers to tenant or tenants, occupier or occupiers of lands, houfes, fhops, pay the rates. warehouses, cellars, vaults, or other tenements, are and fhall be liable to pay the whole of fuch rates, when no compofition fhall have been made as aforefaid, to the receiver or receivers to be appointed by the faid commiffioners, as herein is directed; and in cafe of fuch payment, fuch tenant or tenants, occupier or occupiers, fhall be at liberty, and is and are hereby authorized to deduct and detain out of his, her, or their rent, fuch proportion of fuch rates as he, she, or they, thall refpectively pay, on account of the feveral owner or owners, proprietor or proprietors, of fuch lands, houfes, fhops, warehouses, cellars, vaults, or other tenements, and thall be hereby faved and kept harmless from any further payment of any fuch rate or rates, to any perfon or perfons to whom any fuch rent or rents fhould or ought to be paid.

LXI. LXII. LXIII. meeting houses, schools, warehouses, hospitals, prisons, and all other public buildings whatsoever, and all dead walls, and void spaces of ground, fituate and being within either of the said streets and other places, at a rate to be fettled by five or more of the faid commiffioners, not exceeding fix pence for every square yard belonging to every fuch parish church, church yard, chapel, meeting house, school, warehouse, hofpital, prison, and other public buildings whatfoever, dead wall, and void space of ground; the rate or rates, affeffment or affeffments, to be made and paid for fuch parish churches, chapels, and church yards, to be paid by the respective church or chapel wardens; and the rate or rates, affeffment or affeffments, to be made and paid for fuch meeting houses, fchools, warehouses, dead walls, and void fpaces of ground, fhall be paid by the owner or owners, proprietor or proprietors, thereof; and the rate or rates, affeffment or affeffments, to be made and paid for fuch hofpitals, prisons, and other public buildings, fhall be paid by fuch person and perfons, officer and officers, as are now liable to pay for paving, cleaning, lighting, and watching, the faid ftreets, in refpect of fuch hofpital, prifon, or other public building refpectively. LXIV. And be it further enacted by the authority aforesaid, That where any person or persons, who hath or have been rated and affeffed by virtue of this act, fhall quit his, her, or their dwelling-house, warehouse, fhop, vault, cellar, or tenement, whereupon fuch rate or affeffment has been made, before he, the, or they, fhall have paid the fame, and fhall afterwards refuse to pay the fame when due, and demanded by the perfon or perfons authorized and appointed to collect and receive the fame; that then, and in every fuch cafe, it fhall and may be lawful to and for the faid receiver or receivers, collector or collectors, and every or any of them, by warrant under the hands and feals of any two or more juftices of the peace acting in and for the faid town and places, which warrant the said juftices are hereby authorized and required to grant, in any place within the faid borough of Southwark, or county of Surrey; or, out of the limits thereof (such warrant being first backed or counterfigned by fome magiftrate in the county, city, or liberty, where the diftrefs is to be made) to diftrain the goods and chattles of fuch perfon or perfons fo neglecting or refufing, and the fame to fell, rendering the overplus, if any fuch fhall be, after deducting the reasonable charges and expences of fuch diftrefs and fale, to the owner of such goods and chattles demanding the fame.

Perfons payLXV. And be it further enacted, That all and every perfon ing this rate, or perfons paying the rates and affeffments by this act laid, withexempted. in the faid ftreets and places refpectively, fhall be, and they, and every of them, is and are hereby exempted and difcharged from the charge and expence of paving, cleanfing, lighting, or watching the faid streets, and all other streets and places within their respective parishes, wherein any part of the said streets, courts, yards, lanes, alleys, and other places refpectively are fituate;
