Limitation of actions.

VIII. And be it further enacted by the authority aforefaid, That if any action or fuit fhall be commenced against any pa fon or perfons for any thing done in pursuance of this act, the fame thall be commenced within fix months after the fact committed, and not afterwards; and the defendant or defendant General Iffue. in fuch action or fuit fhall and may plead the General life, and give this act, and the special matter, in evidence, and the the fame was done in purfuance and by the authority of this act; and if it fhall appear fo to be done, or that fuch action a fuit fhall be commenced after the time before limited for bring ing the fame, that then the jury shall find for the defendant of defendants; and upon a verdict for the defendant, or if the plaintiff or plaintiffs fhall be nonfuited, or difcontinue his, her, or their action or fuit after the defendant or defendants fhall have appeared; or if, upon demurrer, judgement shall be giv en against the plaintiff or plaintiffs, the defendant or defendants Treble cofts. fhall and may recover treble cofts, and have the like remedy for the fame as any defendant or defendants hath or have in any other cafes by law.

An alt for improving the navigation of the river Lee, from the town of Hertford to the river Thames; and for extending the faid navigation to the flood-gates belonging to the town mill, in the faid town of Hertford.

WHEREAS
7HEREAS by an at paffed in the twelfth year of the reign
of his late Majefty, intituled, An act for afcertaining, pre-
ferving, and improving, the navigation of the river Lee, from
the town of Hertford to the town of Ware, in the county
Hertford; and for preferving and improving the faid river from
the faid town of Ware, to the new cut or river made by the
mayor, commonalty, and citizens of London; and for enabling
the governor and company of the New River the better to fup-
ply the cities of London and Westminster, and the liberties and
fuburbs thereof, with good and wholfome water, several poweri
were granted to trustees therein and thereby appointed, for prefere-
ing and improving the navigation of the faid river Lee: And where
as the powers thereby granted have been found to be infufficient ts
anfwer the good purpofes thereby intended: And whereas by an e
paffed in the thirteenth year of the reign of Queen Elizabeth, -
tituled, An act for the bringing of the river Lee to the north fide

Lewis Wefton, Benjamin Wellington, Peter Walley, Ifaac Vhittington, Bouchier Walton, Edward Woodcock, Arthur Warren, Fofbua Winter, Ralph Winter, John Weyland, Edward Woodcock lerk, Charles Whitworth, Jofeph Wilcocks, Thomas Winfpear, he honourable Charles York, Thomas Yate, M.D. the lord mayor, ourt of aldermen, and recorder of the city of London for the me being, the comptroller of the works and revenues of Lonon Bridge for the time being, the mayor and recorder of the orough of Hertford for the time being, the governor deputy overnor, and treasurer, of the new river company for the time eing, fhall be, and they are hereby appointed trustees for the haking, extending, improving, and maintaining the navigaon of the faid river Lee, from the flood gates belonging to he town mill in the town of Hertford to the river Thames, and nd for putting this act in execution; and that the faid truf- Their power. ees, or any five or more of them, fhall be, and they are herey authorized and impowered, from time to time, at their difretion, to cleanse, scour, deepen, enlarge, or straighten the hannel or courfe of the faid river Lee; and alfo to fet out, open, ake, and maintain, all or any of the new cuts or canals, here1 after fpecified and defcribed to communicate with the faid ver Lee, and to be used for the faid navigation; and also to renove all obftructions and impediments whatsoever to the faid avigation; and alfo to build, erect, fet up, and make over or in he faid channel or courfe of the faid river, and the new cuts, nd canals aforefaid, and upon the lands and grounds adjoinng or near to the fame, fuch and fo many bridges, locks, aunches, flood gates, pens of water, weirs, ftanks, weigheams, cranes, or other engines of the like kind, as they thall hink neceffary or convenient for the faid navigation, and from ime to time to alter and repair the fame; and also to set out nd make towing-paths, or haling-ways upon any of the ands or grounds aforefaid, for towing, or drawing with men, r horfes, or other cattle, boats, or other veffels ufing the said avigation; and alfo to dig, take, and carry away, clay, gravel, tone, or other materials, proper for carrying on the faid works, nd to be used and expended only in the faid works, in and from ny of the lands and grounds aforefaid (excepting only gardens, orchards, yards, parks, paddocks, inclofed lawns, and avenues o houfes planted with trees;) and to carry and convey timer and all other materials for the faid works upon, through, and over, the lands or grounds of any perfons what oever, o the respective places where the faid works respectively are. ntended to be made, and to place, lay, and manufacture, the aid materials on the lands or grounds adjoining or near to uch respective places; and generally to do and perform all acts, natters, and things, which the faid truftecs, or any five or
