to candles or fidy, cuftom, rate, duty, or other impofition whatsoever, shall foap, allowed, be demanded, collected, received, or taken, upon any tallow, to be imported duty free, for hogs-lard, or greafe, unmanufactured into candles or foap, which fhall be imported into this kingdom; but that all fuch tallow, hogs-lard, and greafe, fhall and may be imported, duty free, for March, 1767; the space of three years from the faid twenty fifth day of March, or at any time thereafter before the end of the then next feffion of parliament; any former law, ftatute, or act or acts of parliament, to the contrary notwithstanding.

II. Provided always, and be it further enacted by the authority aforefaid, That a due entry shall be made of all such tallow, hogs-lard, and greafe, at the custom-house belonging to the port into which the fame fhall be imported, in fuch manner and form, and expreffing the quantities of fuch tallow, hogs-lard, and greafe, as were used and practifed before the making of this and landed in act; and fuch tallow, hogs-lard, and grease, shall be landed in the prefence of the prefence of the proper officer or officers of the customs appointed for that purpose: and if any perfon or perfons, upon the importation of any tallow, hogs-lard, or greafe, fhall not obferve and perform the faid conditions and directions herein beforementioned; every fuch perfon fhall be liable to, and pay, fuch and the fame duties as fuch tallow, hogs-lard, and grease, would have been liable to if this act had not been made; any thing in this act contained to the contrary notwithstanding.

III. And be it further enacted by the authority aforesaid, That if any action or fuit fhall be commenced against any perfon or perfons for any thing done in purfuance of this act, the defendant or defendants, in any fuch action or fuit, may plead General Iffue. the general iffue, and give this act, and the fpecial matter, in evidence, at any trial to be had thereupon; and that the fame was done in pursuance, and by the authority, of this act and if it shall appear to have been fo done, the jury fhall find for the defendant or defendants; and if the plaintiff fhall be nonfuited, or discontinue his action, after the defendant or defendants fhall have appeared, or if judgement fhall be given, upon any verdict or demurrer, against the plaintiff, the defendant or defendants Treble cofts. fhall and may recover treble cofts, and have the like remedy for the fame, as any defendant or defendants hath or have in other cafes by law.

An act for granting an aid to his Majefty by a land tax, to be raised in Great Britain, for the fervice of the year one thousand seven hundred and fixty seven, at 38. in the pound.

An act for giving further time to his Majesty's lieutenants, deputy lieutenants, juftices, and clerks of the peace, and

others, for carrying into execution certain parts of an act paffed in the last feffion, for pay and cloathing of the militia; and for indemnifying fuch lieutenants, deputy lieutenants, and clerks of the peace, and others, who have neglected to carry fuch parts of the said alt into execution.

WHE

HEREAS by an act made in the last feffion of parliament, Preamble, reintituled, An act for applying the money granted in this citing feveral feffion of parliament, for defraying the charge of the pay and claules in act 6 Geo. 3. cloathing of the militia of that part of Great Britain called England, for one year, beginning the twenty fifth day of March, one thousand seven hundred and fixty fix; and for explaining, amending, and rendering more effectual, feveral acts of parliament paffed in the fecond, fourth, and fifth years of the reign of his prefent Majesty, relating to the raising and training the militia within that part of Great Britain called England; it was enacted, That his Majefty's lieutenant, or three deputy lieutenants, for every county, riding, or place, within that part of Great Britain called · England, where the militia was or should be raised, should yearly and every year, on or before the twenty fifth day of December, certify the fame to the clerk of the peace, and when and at what time the fame was first raifed, the number and rank of officers, and the number of private men of the militia, in the year when fuch certificate was made, and the refpective times of fuch militia being trained and exercifed in the year in which fuch certificate is made; which certificate was thereby directed to be by the clerk of the peace, who should receive the fame, delivered to the justices of the peace at their general quarter feffions to be held next after the twenty fifth day of December in every year, on the day on which fuch feffions should be opened, and to be there filed amongst the records of fuch feffions, fo that the true fate of the militia in each county might appear: and it was alfa by the faid act enacted, That in every county, riding, or place, wherein no fuch certificate from his Majefty's lieutenant, or three deputy lieutenants, fhould be delivered to the clerk of the peace as aforefaid, that the clerk of the peace of every fuch county, riding, or place, fhould, and was thereby required, at the general quarter feffions of the peace to be beld next after the twenty fifth day of December in fuch year, to certify under his hand and feal to the juftices of the peace fo affembled at their faid general quarter feffions, on the day fuch feffions fhould be opened, that he had not received from his Majesty's lieutenant of the faid county, riding, or place, or any three deputy lieutenants thereof, any fuch certificate as in the faid act is directed to be by them made; and fuch clerk of the peace is thereby directed to file fuch certificate amongst the records of fuch feffions: and it is also thereby enacted, That in every county, riding, and place, in which no certificate shall be made by his Majesty's lieutenant, or three deputy lieutenants, in manner as therein directed, and the fame should be certified by the clerk of the peace as aforefaid, the juftices of the peace of every fuch county, riding, or place, should, at their faid general quarter feffion of the peace to be held next after the twenty fifth day of December in every year,

rate and affefs the fum of five pounds per man upon fuch county, riding, or place, in fuch and the fame manner, according to fuch and the Jame proportions upon every town, parish, and place, within each refpective county, riding, or place, to be collected, levied, received, and atcounted for, in fuch manner and by fuch means as the county rates bad been ufually, or might, by an act made in the twelfth year of the reign of his late majefty King George the Second, intituled, An act for the & 12 Geo. 2. more eafy affeffing, collecting, and levying the county rates, or by the acts of the fecond, fourth, and fifth years of his present Majefly's reign, for explaining, amending, and enforcing, the feveral laws relating to the raifing and training the militia within that part of Great Britain called England, be affeffed, collected, levied, received, and accounted for; which faid payment of five pounds per man was thereby declared to be in full difcharge for the neglect and failure of not having raifed and trained the militia for fuch county, riding, er place, for the year then next preceedings and the treasurer or treaJurers of the county, riding, or place, who fhould receive the faid five pounds per man, was and were thereby required to pay the fame to the receiver general of the land tax for fuch county, riding, or place, within one calendar month after he or they should have received the fame; and the refpective receivers general of the land tax were thereby required to give a receipt for the fame to the perfon paying such money, whofe receipt was to be a fufficient difcharge for fuch payment; which faid receiver general of the land tax was thereby required, within ten days after the receipt thereof, to certify the fame to the lord high treafurer, or the lords commiffioners of his Majefty's treasury for the time being, and pay the fame into the receipt of his Majesty's Exchequer, in the fame manner as he is required to pay the land tax; for the payment of which money fo paid to the receiver general, or into the Exche quer, no fee or gratuity was to be given: and whereas it was by the faid act alfo enacted, That fuch clerks of the peace of each respective County, riding, or place, fhould, within fourteen days next after the general quarter feffions of the peace to be held after the twenty fifth day of December yearly, tranfmit to the lord bigh treasurer, or the commiffioners of his Majefty's treafury for the time being, and also to the receiver general of the land tax for fuch county, riding, or place, a copy, figned by fuch clerk of the peace, of every certificate which fhould bave been delivered in pursuance of the faid act; and in cafe no fuch certificate should have been delivered in, then fuch clerks of the peace were to certify to the lord high treasurer, or to the commiffioners of his Majefty's treasury, and alfo to fuch receiver general, that no fuch certificate, from his Majefty's lieutenant, or any three deputy lieutenants, had been received by him, and that he had certified the fame to the justices of fuch general quarter feffions; and should also certify what proceedings were had at fuch general quarter feffions, in relation to the affeffing and rating the Jaid fum of five pounds per man, where the militia fhould not have been railed in the faid year one thousand feven hundred and fixty fix: and whereas feveral of his Majesty's lieute tenants, deputy lieutenants, clerks of the peace, juftices of the peace, treafurers of counties, and receivers general of the land tax, through ignorance of what was required ofthem by the herein before recited part

IV. And it is hereby further enacted, That in every county, riding, and place, in which no certificate (hall be made, on or before the faid twenty fifth day of March, one thousand seven hundred and fixty feven, by his Majefty's lieutenant, or three deputy lieutenants, in manner as therein and herein directed, and the fame fhall be certified by the clerk of the peace aforefaid, the justices of the peace for every fuch county, riding, or place, fhall, at their faid general quarter feffion of the peace to be held next after the twenty fifth day of March, one thousand seven hundred and fixty feven, rate and affefs the sum of five be made, &c. pounds per man upon fuch county, riding, or place, in such and the fame manner, according to fuch and the fame proportions upon every town, parish, and place, within each respective county, riding, or place, to be collected, levied, received, and accounted for, in fuch manner, and by such means, as the county rates have been usually, or may, by an act made in the twelfth year of the reign of his late majesty King George the Second, intituled, An act for the more eafy affeffing, collecting, and levying, the county rates; or by the acts of the fecond, fourth, and fifth years of his prefent Majefty's reign, for explaining, amending, and enforcing, the feveral laws relating to the railing and training the militia within that part of Great Britain called England, be affeffed, collected, levied, received, and accounted for; which faid payments of five pounds per man fhall, and is hereby declared to be, in full discharge for the neglect and failure of not having raised and trained the militia for fuch county, riding, or place, in and for the year one thousand seven Treafurer of hundred and fixty fix; and the treasurer or treasurers of the pay the fame county, riding, or place, who fhall receive the faid five pounds to the receiver per man, is and are hereby required to pay the fame to the regeneral of the ceiver general of the land tax for fuch county, riding, or place, Jand taxi within one calendar month after he or they shall receive the fame; and the respective receivers general of the land tax are hereby required to give a receipt for the fame to the perfon paying fuch money, whofe receipt fhall be a fufficient discharge for fuch payment; which faid receiver general of the land tax is hereby required, within ten days after the receipt thereof, to certify the fame to the lord high treasurer, or the lords commiffioners of his Majefty's treasury for the time being, and pay the fame into the receipt of his Majesty's exchequer, in the fame manner as he is required to pay the land tax; for the pay
