reason whereof the masters of vessels are deceived, and many very great loffes have lately happened to ships and veffels employed in the northern navigation, to the great detriment of feveral branches of trade in this kingdom: and whereas it is abfolutely necessary for the fafety of the northern navigation, that two new light-houses should be erected in a proper place nearer to the Spurn Point than the place where the prefent light-houfes ftand: and whereas John Angell, now of Stockwell, in the county of Surrey, efquire, as owner of three fourth parts of the faid light-houses, revenues, duties, and profits, having had frequent applications made to him, or his agents, by the corporations of the Trinity houfes at Deptford Strond, and Kingston upon Hull commonly called Hull, and alfo by the faid Leonard Thompson; and all poffible means having been used to prevail on him to change the fituation thereof, in fuch a manner as that they may answer the good ends and purposes for which they were originally defigned, hath, from time to time, wholly neglected or refufed fo to do, or to contribute his proportion of the expence of taking down and removing the faid prefent light-houses, and of erecting and building others in the flead thereof as aforefaid; whereby, and by petitions to his Majesty for that purpose, and by references thereon, the faid corporations, and alfo the faid Leonard Thompson, have been put to confiderable charges and expences: and whereas the faid Leonard Thompson is ready and willing to take down and remove the faid prefent light-houses, and to erect and build others instead thereof, in fuck place or places near to the present point of the Spurn, and in fuch manner and form as shall be thought most proper and convenient by the faid corporation of the Trinity houfe of Deptford Strond, and under their inspection and direction, upon his being I enabled to borrow and raise money for that purpose, and for repaying to the faid corporations of the Trinity houfes of Deptford Strond and Hull, and him the faid Leonard Thompson refpectively, their faid refpective charges and expences incurred concerning the faid lightboufes, and alfo for defraying the charges of foliciting and obtaining this prefent act; and fo that the three fourth parts of the faid revenues, duties, and profits, belonging to the faid John Angell, may be a redeemable intereft in him, or the perfon or perfons intitled thereto, on his or their paying the whole amount of the faid expences of the faid corporations of Deptford Strond and Hull, and of him the faid Leonard Thompson, and the intereft thereof, and three fourth parts of the expences of obtaining this act, and removing and rebuilding the faid light-houses, and the intereft of fuch three fourth parts, to the perfon or perfons who shall advance and lend the fame, his, her, or their executors, adminiftrators, or affigns; but by reafon of the eftate and intereft which the faid John Angell hath in the faid three fourth parts of the faid lands, light-houfes, revenues, duties, and profits, and by reason that the faid Leonard Thompson is only tenant for life, with fuch remainders over as aforesaid in the faid fourth part of the said premiffes, the purposes aforefaid cannot be effected without the aid and authority of parliament: therefore, for promoting a work fo conducive to the fafety of his Majefty's fubjects, and to remedy fo great a detriment to

trade and navigation; may it please your Majesty, at the humble fuit of the faid Leonard Thompson, that it may be enacted; and be it enacted by the King's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, and by the New lightauthority of the fame, That it fhall and may be lawful to and houfes to be for the faid Leonard Thompson, and other the perfon or persons built, and the who fhall, for the time being, be intitled to his fourth part of old ones taken the duties and profits hereby granted or continued, by and un

der the faid recited will of the faid Edward Thompson; and he and they are hereby authorized and required, with as much fpeed as conveniently may be, after the first day of June, one thousand seven hundred and fixty fix, to erect and build, or cause to be erected and built, two new and fufficient lighthouses, with fuitable offices and conveniencies, at or near the faid Spurn Point, and according to fuch plan and estimate, as the mafter, wardens, and affiftants, of the faid corporation of the Trinity house of Deptford Strond, fhail, by writing under their common feal, fpecify, appoint, and approve of; and, for that purpose, to take down the faid prefent light-houses, and to make use of all or any part of the materials thereof, or otherwise to fell and difpofe of the fame, and to apply the money arifing therefrom towards building fuch new light-houfes; and, in the mean time, and until the faid new light-houses fhall be compleated, to erect and continue two temporary lights, as near as may be to the refpective places where the faid new light-houfes shall, as aforesaid, be appointed to be built; and also to keep fufficient lights and fires burning continually in the nightseason, so as to answer the purposes intended by this act for the benefit of navigation; and, from time to time, to enlarge, contract, alter, or remove, the said new light-houses, or either of them, as occafion may require, with the consent and by the direction of the fame corporation, to be fignified as aforesaid; and for any of the purposes aforefaid, to enter upon and use fuch part or parts of the land at or near the Spurn Point, (be it the foil or ground of the King's most excellent majesty, his heirs, or fucceffors, or of any other perfon or perfons, bodies politick, corporate, or collegiate) as the corporation of the Trinity houfe of Deptford Strond, hall, from time to time, by writing under their common feal, appoint.

II. And, to the end that thofe purposes may be better attained, and that the management of the faid light-houses may not be neglected or badly conducted; be it hereby further enacted by the authority aforefaid, That from and after the erecting and building the faid light-houfes, the fame fhall, from time to time, and at all times thereafter, be fubject to the vifitation and inspection of the faid corporations of the Trinity houfes of Deptford Strond and Hull, for the time being, or either of them, who may enter into the fame, and examine whether they are well and sufficiently repaired and maintained, fo as to answer the purposes aforesaid; and shall and may leave notice or warning in writing, with the

keeper or keepers of the faid light-houfes, requiring fuch defects or wants of reparations, as fhall be found therein, to be remedied and amended within forty days from the delivery of fuch notice or warning as aforefaid.

III. And be it further enacted by the authority aforefaid, Trinity house That in cafe the faid light-houses, to be erected purfuant to of Hull to fee that they are this act, fhall be at any time not kept duly lighted and properly properly atattended; it shall and may be lawful for the corporation of the tended. Trinity house of Hull, to examine into fuch neglects, and effectually to remedy the fame; and alfo to depute and appoint fome fit and proper perfon or perfons to enter into the faid light-houses, or either of them, with full power and authority to remain therein, until fuch neglects fhall be remedied in fuch manner as the faid corporation fhall think neceffary; and the owner or owners of fuch light-houfes fhall, and they are hereby required to pay and fatisfy the faid corporation all fuch charges and expences as fhall be thereby incurred; and in default of payment thereof, within one month after the fame shall be demanded of the faid owner or owners for the time being, it fhall and may be lawful for the collector or collectors of the duties by this act directed to be received, to pay and fatisfy the fame to the faid corporation, and is and are hereby declared to be indemnified for fo doing; any thing herein contained to the contrary notwithstanding.

IV. And be it further enacted by the authority aforefaid, Duties. That from and after the erecting and compleating the faid new light-houses, according to the faid plan, and the kindling and placing lights therein, for the benefit of navigation; the faid Leonard Thompson and John Angell, according to the proportionate fhare, eftate, and intereft, which they now refpectively have in the faid prefent light-houses; and the duties granted by f the faid recited letters patent, and the perfons who fhall, for the time being, after their several deceases, be intitled to the fame, and their agents, collectors, and deputies, or other perfon or perfons by them appointed, may (fubject nevertheless to fuch mortgage and mortgages as fhall be made thereof, by virtue of the power herein after given) from thenceforth collect, have, and take, of and from the feveral perfons, who are now or hereafter may be liable to pay the fame, the several and refpective duties which have been ufually taken and collected by and under the faid patents before recited, and no others.

V. And, to the intent the faid duties may be truly answered and Method for paid, be it further enacted by the authority aforefaid, That no fecuring paycuftomer, collector, comptroller, furveyor, fearcher, or waiter, nor any of their respective clerks, within any of his Majesty's ports, havens, creeks, or harbours, belonging to the northern coafts aforefaid, or elsewhere; nor any captain, lieutenant, or other officer belonging to them, or any of them; nor any warden, port reeve, or keeper, of any of his Majesty's faid ports, roads, harbours, and havens; nor any wharfinger, porter, or harbourer, belonging to the water-fide; nor any officer of the

cuftomers belonging to his Majefty, or to his heirs and fucceffors, now being, or which for time hereafter shall be in the faid ports, harbours, roads, creeks, havens, and places; fhall any of them at any time hereafter take or receive any entry or cocquet, or give, make, or certify any cocquet, return, or victualling bill, or difcharge or permit any goods or ftores to be laid on land, or difcharged or fhipped, out of or from any of the faid fhips, or fuffer any fhips or other veffels trading or liable to the payment aforefaid, to pass by or from them without a ticket or note under the hand writing of the perfon or perfons in whom the faid duties are vefted by this act refpectively, his, her, or their agents or deputies, teftifying the payment of the faid feveral allowances and fums hereby refpectively granted.

VI. And be it further enacted by the authority aforefaid, That every collector and collectors, or any other perfon or perfons authorized and deputed by the perfon or perfons in whom the faid duties are hereby vefted, fhall and may, for the better management and collection thereof, have a place in all cuftomhoufes in the ports and places where the fame are or shall be collected.

VII. And whereas it is reafenable that a proper fatisfaction and recompence should be made to William Conftable, of Burton Conftable in the county of York efquire, or to fuch other person or perJons who now is ar are, or hereafter shall be, owner or owners of the foil or ground whereon fuck new intended light-houfes, fuitable offices or conveniencies, shall or may hereafter be built; be it therefore enacted by the authority aforefaid, That the duties hereby granted or continued, fhall for ever hereafter be charged and chargeable with and fubject and liable to the payment of the fum of one hundred pounds yearly, clear of all taxes and deductions whatsoever, unto the faid William Conftable, his heirs or affigns, or other owner or owners of fuch foil or ground for the time being, his, her, or their heirs or affigns, by four equal quarterly payments; fuch payments to be made by the collector or collectors of the faid duties at Kingston upon Hull, for the time being, out of the first monies that fhall come to his or their hands; the first payment thereof to be made on the twenty fifth day of December, one thousand feven hundred and fixty fix; and in default of payment of the faid yearly fum, or any part thereof, for the space of twenty days next after the days appointed for payment thereof, it fhall and may be lawful to and for the faid William Conftable, his heirs or affigns, or the owner or owners of the foil or ground for the time being, or his, her, or their heirs and affigns, to recover by action of debt in any of his Majesty's courts of record at Westminster, from the faid collector or collectors of the faid duties within the port of Kingston upon Hull aforefaid, fo much of the faid yearly fum as fhall remain unpaid as aforefaid, together with all cofts and charges attending the recovery of the fame: but in cafe there fhall be no collector of the faid duties at the faid port of Kings fon upon Hull, or there fhall not be fufficient money in his or

their hands arifing from the faid duties to anfwer fuch purposes; then it fhall and may be lawful to and for the faid William Conflable, his heirs and affigns, and fuch other owner or owners as aforefaid, from time to time, and his, her, and their heirs and affigns, to collect, have, and take, the duties by this act authorized to be received by the proprietors of the faid duties, of fuch perfons, and in fuch manner, as the fame are herein before authorized to be collected and taken, until therewith or otherwise all fuch arrears, together with the cofts and charges attending fuch collection, fhall be fully paid and satisfied.

VIII. And, to the end that the completion of fo neceffary a work Powers to raise may not be obstructed by the faid John Angell's perfifting in his re- money on fufal to co-operate with the faid Leonard Thompson therein, and credit of the for the enabling the faid Leonard Thompson, or other perfon or * persons who shall come into poffeffion of his share and intereft in the faid premiffes, to discharge and reimburse to the faid corporations of the trinity houfes of Deptford Strond and Hull, and to him the faid Leonard Thompson refpectively, the expences which they and he have refpectively been put to on the occafions aforefaid, and to discharge the expences of foliciting and obtaining this prefent act; (all the faid expences to be afcertained and allowed by the commiffioners berein after named, or any three or more of them) and to raise money fufficient for the taking down the faid prefent light-houfes, and erecting and building the faid temporary lights and new light-houses, according to the plan and eftimate of the faid corporation of the trinity houfe of Deptford Strond, as herein before directed (and in and by which - plan and estimate the fum of money for that purpose shall be fixed and aftertained under the common feal of the fame corporation) be it hereby further enacted by the authority aforefaid, That it shall and may be lawful to and for the faid Leonard Thompson, or other perfon or persons in poffeffion of his faid fourth part, to borrow and raise any fum or fums of money, not exceeding in the whole the amount of the aforefaid expences and estimate afcertained in manner as aforefaid; and for fecuring the repayment of the faid fum or fums of money fo to be borrowed, with intereft for the fame, to grant, mortgage, lease, or demife, the ground, which fhall be affigned in manner aforefaid, for erect. ing the faid light-house thereon, together with the light-houses which fhall be erected thereon, with their appurtenances, and the duties, and profits, hereby granted, unto fuch perfon or perfons as fhall advance and lend the fame refpectively, for any term or number of years, not exceeding five hundred years; fo as fuch grant or demise be made with a provifo or condition to be void, or with an exprefs covenant to be furrendered, as to the three fourth parts of the faid John Angell, upon payment by him, or other the perfon or perfons who for the time being thall be intitled to the fame, of the whole amount of the faid expences of the said corporations of Deptford Strond and Hull, and of him the faid Leonard Thompson, and the intereft thereof, and three fourth parts of the expences of obtaining this act, and removing and rebuilding the faid light-houses and temporary lights, and
