XXXIV. And it is hereby further enacted, That every occupier of any house or tenement within the faid city and liberties, and (in refpect of houfes lett to inmates) every house owner fhall, once in every day, fcrape, fweep, and cleanfe, the foot way all along the front of their respective houses or tenements, or caufe the fame to be fcraped, swept, and cleansed; and, in default thereof, fhall, for every fuch offence, forfeit and pay the fum of two fhillings.

XXXV. And, for the better enlightening the said streets, lanes, fquares, yards courts, alleys, paffages, and places, it is hereby further enacted, That it fhall and may be lawful to and for the faid commiffioners, from time to time, to caufe fuch and fo many lamps to be fet up in fuch places within the faid city, and the liberties thereof, and to be placed in fuch manner, and at fuch distances, as they fhall judge neceffary; and the faid commiffioners fhall order and direct at what time the lights within the same shall be lighted, and how long they fhall continue lighted; and fhall, from time to time, give fuch other orders and directions in the premiffes, as they fhall think needful, for the well and fufficient enlightening the faid city, and the liberties thereof. XXXVI. And it is hereby further enacted, That if any perfon or persons shall wilfully take away, break, or throw down, or damage, any lamp that now is, or hereafter shall be, fet up for enlightening any of the faid ftreets, lanes, fquares, yards, courts, alleys, paffages, and places, or wilfully extinguish the light or lights within the fame, or damage the irons or other furniture thereof; it fhall and may be lawful to and for any perfon or persons whatsoever, who fhall fee fuch offence committed, to seize, as alfo for any other person or persons to affift in feizing the offender or offenders, and, by authority of this act, and without any other warrant, to convey him, her, or them, or to deliver him, her or them, into the cuftody of a peace officer, in order to be fecured and conveyed before fome juftice of the peace of the said city; and such justice shall proceed to examine, upon oath, any witness or witneffes, who shall appear or be produced to give information touching fuch offence (which oath the faid juftice is hereby authorized and required to adminifter) and if the party or parties accused fhall be convicted of fuch offence, either by his, her, or their own confeffion, or upon fuch information as aforefaid; he, fhe, or they, fo convicted, fhall forfeit and pay the fum of twenty fhillings for each lamp fo broken, thrown down, or damaged, or for every light fo extinguished as aforefaid; and, moreover, thall make full fatisfaction to the faid commiflioners, or to fuch person as they fhall appoint to receive the fame, for the damage fo by him, her, or them done as aforefaid; and in cafe fuch offender or offenders shall not, on conviction, pay fuch forfeiture, and make fuch fatisfaction as aforefaid, fuch juftice is hereby required to commit him, her, or them, to the Bridewell of the faid city, there to be kept to hard labour, for any space of time not exceeding one calendar month; and fuch offender or offenders fhall

not be difcharged before the expiration of the time for which he, fhe, or they, fhall be fo committed, unlefs fuch forfeiture and fatisfaction fhall be sooner paid and given.

XXXVII. And it is hereby further enacted, That in cafe any or accidentalperfon or persons fhall carelessly or accidentally break, throw ly, breaking or damaging down, or damage, any of the faid lamps, fo fet up, or hereafter lamps, &c. to be fet up, as aforefaid, or the irons, or other furniture thereof, and shall not immediately, upon demand, make fatisfaction for the damage done thereto; then, and in every fuch case, it fhall and may be lawful to and for any one justice of the peace of the faid city, upon complaint to him or them made by one or more credible perfon or perfons, to fummon before them the party or parties who fhall be complained of for doing such damage as aforefaid; and, upon hearing the allegations and proofs on both fides, or upon the non-appearance of the party or parties fo complained of and fummoned, to award fuch fum or fums of money, by way of fatisfaction for fuch damage, as fuch justice fhall think reasonable; and in cafe of neglect or refufal of the faid party or parties to pay fuch fum or fums of money fo awarded, within three days after demand thereof, to caufe the fame to be levied by distress and fale of his, her, or their goods or chattles, the furplus (if any) arising by such sale, to be paid to him, her, or them.

XXXVIII. And it is hereby further enacted by the authority Property of aforefaid, That the property of the pavements, which, at the pavements, &c. time of paffing this act, or at any time or times thereafter, fhall vefted in the be within the faid city or liberties, and all materials and things used or to be used in or about the making or repairing thereof, fhall be, and the fame are hereby vefted in the faid mayor and commonalty, and citizens, of the faid city; and the said commiffioners are hereby authorized and impowered to bring, or cause to be brought, any action or actions, in the name of the faid mayor, and commonalty, and citizens, or to prefer, or order the preferring of, indictments against any person or perfons who fhall steal, take, or carry away, any or any part of fuch materials or things: and if any perfon or perfons fhall wilfully or maliciously deftroy, or otherwife damage or fpoil, any of the faid materials or things, or any of the works done in pursuance of this act, or any part or parts thereof; every perfon or perfons fo offending therein, and being thereof convicted, by the oath or oaths of one or more credible witnefs or witneffes, before any justice of the peace, fhall, for every fuch offence refpectively, forfeit and pay the fum of twenty fhillings for the first time of offending; and the fum of forty fhillings for the fecond and every other time of offending.

XXXIX. And be it further enacted by the authority afore- Commissionfaid, That all lamps which fhall be put out by any perfon or ers to direct perfons, at his or their own private expence, fhall, from and the placing of private lamps. after the commencement of this act, be placed in fuch manner as the faid commiffioners, appointed to put this act in execution, fhall direct.

XL. And

XL. And whereas it would be very convenient to the inhacollected half-bitants of the faid city and liberties, if the rates and affeffyearly, ments, neceffary for paving, cleanfing, and enlightening, the faid ftreets, lanes, fquares, yards, courts, alleys, paffages, and places, and for preventing annoyances therein, were confolidated and made one joint and general fund, to be collected together; be it enacted by the authority aforefaid, That from and after the twenty ninth day of September, one thousand seven hundred and fixty fix, one or more rate or rates, affefïment or affeffments, fhall, twice in every year or oftener, as the faid commiffioners fhall, from time to time, think fit to order, be made, laid, and affeffed, in the several wards of the faid city, by the aldermen, or their deputies refpectively, and the major part of the common council men of each ward, upon all and every perfon and perfons who do or fhall inhabit, hold, occupy, poffefs or enjoy, any land, house, shop, warehouse, cellar, vault, or other tenement, within the faid several wards, and who, by the laws now in being, are liable to be, and, from time to time, shall be actually rated towards the relief of the poor in the respective parishes where he, she, or they, shall respectively live or refide, for raising such competent fum and fums of money as the faid commiffioners fhall, from time to time judge and not to ex- needful and direct; fo as fuch rates or affeffiments do not in any one year exceed, in the whole, the fum of one fhilling and fix pence in the pound of the yearly rents of fuch of the faid lands, houfes, fhops, warehouses, cellars, vaults, or other tenements or hereditaments refpectively, as fhall be fituate in any street, lane, fquare, yard, court, alley, paffage, or place, actually begun and 18. in the to be new paved by virtue and in pursuance of this act; and

one fhilling in the pound of the yearly rents of fuch of the lands, houses, shops, warehouses, cellars, vaults, tenements, or hereditaments respectively, as fhall not be fo fituate; fuch rates refpectively to be from time to time afcertained by the rates at which fuch refpective lands, houses, fhops, warehouses, cellars, vaults, or other tenements, or hereditaments, shall be, from time to time, affeffed towards the land tax.

XLI. And whereas feveral manufactures, trades, occupations, and callings, neceffarily take up and require great room, by reason whereof, the perfons concerned therein are obliged to pay large rents, and it may be a great and intolerable hardfhip upon fuch persons to be rated to the full extent of their refpective rents, towards the purposes of this act; and whereas it may be reasonable to excufe fome perfons from the payment of the aforefaid rates and affeffments, in the whole or in part, on account of their poverty: for relief therefore, in fuch cafes, it is hereby further enacted and declared, That in any of the cafes aforefaid, any person or perfons may apply to the faid commiffioners, by petition in writing, fetting forth the circumftances of his, her, or their cafe, giving notice to the alderman of the ward wherein fuch rate or affeffment shall have been made, or his deputy; and fuch petition fhall be taken into confideration

fideration by the faid commiffioners, at their next public meeting, of which the alderman of the ward, or his deputy, thall have efpecial notice; and if it fhall then appear to the faid commiffioners, upon hearing the faid petitioner or petitioners, that' the faid petitioner or petitioners is or are intitled to relief; it Relief for fhall and may be lawful to and for the faid commiffioners, and owners of they are hereby authorized and impowered, to award to the faid large ware petitioner or petitioners fuch relief as they the faid commiffion- houfes, &c. ers fhall think juft and reasonable.

XLII. Provided always, That if the alderman, or his deputy, Appeal may or the major part of the common council men of fuch ward, be made. fhall think fuch award unjuft or unreasonable, or if the party or parties concerned fhall think him or herself, or themselves, ag* grieved by fuch award; it fhall and may be lawful to and for any of them to appeal from fuch award to the court of mayor and aldermen of the faid city, who fhall finally determine whether the said petitioner or petitioners is or are intitled to any and what relief in the premiffes.

XLIII. And, in order to ascertain the rates and affeffments Power to exto be made by virtue of this act, be it further enacted by the amine poors authority aforefaid, That the feveral aldermen of the faid city, rates, and land tax for their refpective deputies, shall and may, and they are hereby books. authorized and impowered, to caufe any of the books of affeffment of the land tax, within their respective wards, and alfo any of the books of affeffment of the rates towards the relief Iof the poor, within the respective parishes of the fame wards, to be brought before them, and to take copies of fuch books, or any part thereof, as they fhall think fit, without fee or reward: and if any perfon or perfons, in whofe cuftody or power any of the faid books fhall be, fhall refufe or neglect to attend the faid aldermen, or their deputies, with fuch book or books, or to permit them to take copies thereof as aforefaid; then, and in every fuch cafe, every perfon who fhall fo refufe or neglect, fhall, for every fuch offence, forfeit and pay the fum of forty fhillings.

XLIV. And it is hereby further enacted, That the alderman, Duplicates of or his deputy, and the major part of the common council men the rates to for the time being, in each ward within the faid city or liberties, be made, &c. are hereby required to fet down in writing, and fign two duplicates of the rates and affeffments, which they fhall, from time to time, make by virtue of this act for the purposes aforefaid, in which thall be expreffed the names of the collectors who fhall be appointed to collect the fame; one of which duplicates fhall, within ten days next after the making thereof, be depofited, by the beadle of the faid ward, in the office of the chamberlain of the faid city of London, where the fame fhall remain; and every citizen of London, liable to be rated by virtue of this act, fhall and may have free access thereto at all convenient times, and be permitted to infpect the fame without fee or reward.

poses aforefaid, it is hereby further enacted, That it shall and may be lawful to and for the alderman, or his deputy, with the major part of the common council men of each ward, at the court of wardmote to be holden upon or near the feast day of Saint Thomas the Apoftle for the choice of ward officers, to return to the said wardmote the names and places of abode of a competent number of fubftantial inhabitants of fuch ward; of whom so many as the faid alderman, or his deputy, and the major part of the faid common council men, fhall think fit and direct, not exceeding half the number of perfons fo returned, fhall be chofen and appointed, at the faid wardmote to be colCollectors to lectors of the rates and affeffments, which fhall be made in purfuance of this act, for one whole year, from the faid feast day of Saint Thomas the Apoftle to the fame feast day then next following, and fo yearly, and from year to year: and the faid collectors for the time being are hereby authorized and required, in the respective wards for which they fhall be fo chofen collectors, to collect and receive, from time to time, fuch rates, affeffments, and fums of money, as fhall be due and payable by virtue of this act, of and from all perfons liable to pay the fame; and all perfons who by virtue of this act fhall be charged therewith, or be liable thereunto, are hereby required to pay fuch rates or affeffments unto fuch refpective collectors for the time being accordingly; fuch collectors, from time to time, giving receipts for the fame gratis, if thereunto required, and which they are hereby enjoined to do upon request: and every fuch collector, who shall be chofen by virtue of this act, shall, at the wardmote at which he thall be fo chofen as aforefaid, or within the space of twenty days then next ensuing, before the alderman of the ward for which he shall be so chofen collector, or his deputy, take and fubfcribe the following oath; or, being one of the people called Quakers, make and fubfcribe the following folemn affirmation, for the true and faithful execution of the faid office.
