part of one or more houfe or houses, building or buildings, at houfes numbered. or near each end, corner, or entrance, of each of the faid ftreets, lanes, fquares, yards, courts, alleys, paffages, or places, the name by which each refpective ftreet, lane, fquare, yard, court, alley, paffage, or place, is properly or ufually called or known; and may also cause every house, fhop, or warehouse, in each of the faid ftreets, lanes, fquares, yards, courts, alleys, paffages, and places, to be marked or numbered, in fuch manner as they fhall judge moft proper for distinguishing the fame and if any perfon or perfons fhall wilfully and maliciously destroy, pull down, obliterate, or deface, any fuch names, descriptions, marks, or numbers, or any part thereof, or caufe or procure the fame to be done; every perfon fo offending, fhall, for every fuch offence, forfeit and pay the fum of forty fhillings,

XXV. And it is hereby further enacted, That no perfon or Form of the perfons fhall, without authority from the faid commiffioners, pavement not alter, or caufe to be altered, the form of the pavement of the to be altered. faid streets, lanes, fquares, yards, courts, alleys, paffages, and places, which fhall be new paved or repaired by the said commiffioners, or in any way incroach thereon; upon pain that every perfon fo offending fhall, for every fuch offence, forfeit and pay the fum of five pounds, over and above the expence of relaying and reinftating the fame, according to the directions of the faid commiffioners; the faid forfeitures and expences to be recovered by action of debt, bill, plaint, or information, in any of his Majesty's courts of record, in the name of the faid mayor, and commonalty, and citizens, of the faid city of London, to be commenced within fix calendar months next after the commiffion of fuch offence; in which action or fuit, no protection, effoin, or wager of law, or more than one imparlance, shall be allowed.

XXVI, And it is hereby further enacted, That after the ex- Pavements to piration of twelve calendar months next after the paffing of this be repaired on act, if any two housekeepers within the faid city and liberties complaint. fhall make complaint in writing, under their hands, to the said commiffioners, of any defect or want of repair in any of the pavements of any of the faid ftreets, lanes, fquares, yards, courts, alleys, paffages, or places, either before or after the fame fhall have been new paved or repaired by virtue of this act; then, and in every such case, the faid commiffioners fhall forthwith caufe the pavement fo complained of to be infpected by their furveyor; and if the fame fhall, by him, be found defective, and fo reported to be, to the faid commiffioners, upon oath (which oath the faid commiffioners are hereby impowered to adminifter, unless fuch defect fhall appear to arife from a defect in some water pipes lying under fuch pavement) they the faid commiffioners fhall forthwith give orders to their contractor or contractors, paviour or paviours, to repair the fame: and if the contractor or paviour of the faid commiffioners, to whom fuch order fhall be given, fhall not, within four days next after the receipt thereof, repair the faid defective pavement; then,

and in every fuch cafe, the faid contractor or paviour shall forfeit and pay the fum of twenty fhillings for every day that the faid defective pavement fhall remain unrepaired after the expiration of the faid four days.

XXVII. And it is hereby further enacted, That when and fo often as any pipe or pipes, belonging to any of the water companies, who furnish any part of the faid city and liberties with water, and which now lie, or fhall hereafter be laid, unter pipes are der ground, in any of the faid ftreets, lanes, fquares, yards, courts, alleys, paffages, or places, fhall happen to break, burft, or decay, fo as to require reparation, the furveyor of the faid commiffioners for the time being, or fuch other perfon or perfons as the faid commiffioners fhall appoint for that purpose, fhall forthwith give, or caufe to be given, notice thereof in writing, to the paviour of the water company to whom he apprehends the faid pipe or pipes to belong, who is hereby required to take up the faid pavement, and open the ground at or near the place where fuch reparation fhall appear to be wanting: and if the faid paviour fhall, upon taking up fuch pavement, and opening fuch ground, discover that the pipe or pipes fo broken, burst, or decayed, does not, or do not, belong to the water company whofe paviour he is; then, and in every fuch cafe, he fhall forthwith give, or caufe to be given, notice thereof in writing, to the paviour of the company to whom the faid pipe or pipes fhall appear to belong; in which case, such laft mentioned paviour is hereby required, upon demand, to make fatisfaction for the taking up fuch pavement, and opening fuch ground, to the paviour giving notice as aforefaid; and the paviour of fuch water company to whom the faid pipe or pipes fhall belong, is hereby required to caufe or procure the faid pipe or pipes to be repaired, and afterwards to fill up the faid ground within four days next after fuch notice to him given; and as foon as fuch pipe fhall have been fo repaired, and the ground fo filled up, he fhall give, or caufe to be given, notice thereof in writing, to the paviour or contractor for the time being of the faid commiffioners: and if the paviour of any of the faid water companies, to or for whom fuch notice fhall be given or left at his laft place of abode, fhall, by the space of four days next after the giving or leaving fuch notice as aforefaid, refufe or neglect to take up fuch pavement, and open fuch ground; or if, upon difcovering that the pipe or pipes fo broken, burst, or decayed, doth not, or do not, belong to the company whose paviour he is, he fhall refufe or neglect to give immediate notice thereof in writing to the paviour of the company to whom the faid pipe or pipes doth or do belong; or if the paviour of the water company to whom fuch pipe or pipes fhall belong, fhall, by the space of four days next after fuch notice given to him, or left at his laft place of abode, refuse or neglect to caufe or procure fuch pipe or pipes to be amended and repaired, or afterwards to fill up the ground fo taken up, or to give fuch immediate notice of his having fo done, to the pa

viour or contractor of the faid commiffioners for the time being; then, and in every fuch cafe, the perfon or perfons fo refpectively refufing or neglecting fhall, for every fuch offence, feverally forfeit and pay the fum of five pounds: and if any pipe or pipes, not belonging to any of the water companies, fhall happen to break, burft, or decay, as aforefaid, in any of the faid ftreets, lanes, fquares, yards, courts, alleys, paffages, or places; then, and in every fuch cafe, the refpective owner or owners thereof fhall forthwith cause the ground over the fame to be opened, and fuch pipe or pipes to be repaired, and notice thereof in writing to be given to the clerk, for the time being, of the faid commiffioners; or, in cafe of refufal or neglect fo to do, fhall, for every fuch offence, forfeit and pay the fum of forty fhillings: and if any pavement shall be broken or taken up, for the purpose of making, repairing, or altering, any vault, or drain, or for any other purpose whatsoever; then, and in every fuch cafe, the perfon or perfons fo breaking or taking up the faid pavement, or caufing the fame to be fo broken or taken up, fhall, as foon as the nature of the work will permit, cause the ground to be filled up, and notice thereof in writing to be given to the clerk, for the time being, of the faid commiffioners; or in cafe of refufal or neglect so to do, shall, for every fuch offence, forfeit and pay the fum of forty fhillings: and the faid clerk of the faid commiflioners fhall forthwith, up! on every fuch notice, as aforefaid, given to him, or left at his laft place of abode, tranfmit fuch notice, or cause the same to be tranfmitted to the paviour or contractor of the faid commiffioners for the time being; and if the faid clerk shall refuse or neglect, by the space of two days next after any fuch notice as aforefaid given to him, or left at his laft place of abode, to transmit such notice, or to caufe fuch notice to be transmitted to the faid paviour or contractor for the time being of the faid commiffioners; or if fuch paviour or contractor, to whom any fuch notice as aforefaid, fhall be fo tranfmitted, fhall by the space of two days next after the tranfmitting of fuch notice to him as aforefaid, refuse or neglect to relay and repair the pavement fo broken up; then, and in every such case, the perfon fo refusing or neglecting, fhall forfeit and pay the fum of twenty fhillings, for every day fuch pavement fhall continue unrelayed or unrepaired, after the expiration of the said two days.

XXVIII. And it is hereby further enacted, That the feveral Paviours of and respective paviours now employed, or hereafter to be em- the water ployed, by the faid water companies refpectively, within the companies to faid city or liberties thereof, fhall, within the space of thirty their names, give notice of days next after the paffing of this act, or within three days next &c. after they shall be refpectively appointed paviours to fuch company or companies, give notice in writing to the clerk for the time being of the faid commiffioners, of their respective names and places of abode, and of the name of the refpective company whofe paviours they are, and of the refpective district to

which they are appointed and in like manner, the clerk for the time being of the faid commiffioners fhall, within the refpective times aforefaid, give notice to the refpective paviours of the said several water companies, of the names and places of abode of the paviour or paviours, contractor or contractors, for the time being, of the faid commiffioners; and if any of the faid paviours, or the clerk of the faid commiffioners for the time being, thall neglect to give fuch notices within the refpective times aforefaid, each of them fhall, for every fuch offence, feverally forfeit and pay the fum of twenty fhillings.

XXIX. Provided always, and it is hereby further enacted and panies to pay declared, That the charges and expences of relaying the pavethe expence ment, which fhall be broken or taken up for the purposes of of new laying repairing or amending any fuch pipe or pipes, fhall be reimburfed and paid to the faid commiflioners, or to fuch perfon as they fhall appoint to receive the fame, by the clerk or treasurer for the time being of the refpective water companies to whom fuch pipe or pipes fhall belong; or if the fame fhall not belong to any of the faid water companies, then by the refpective owner or owners thereof; and the charges and expences of relaying the pavement which fhall be broken or taken up for the purposes of new making, repairing, altering, cleansing, or emptying, any fewer, drain, or vault, or of making any new or additional grates, or of repairing and altering any old grates, shall be defrayed and paid by and out of fome rate or rates, to be made or affeffed by virtue or in purfuance of the faid act of the twenty fecond and twenty third years of the reign of King Charles the Second; or by the perfon or perfons who fhall take up the faid pavement, or any part thereof, or caufe the fame to be taken up for any of the purposes aforefaid: and if fuch clerk or treasurer to any of the faid water companies, or the respective owner or owners of fuch pipe or pipes, liable to reimburfe and pay fuch charges and expences, fhall refufe or neglect to pay the fame within ten days next after demand thereof in writing, figned by the clerk of the faid commiffioners, and left at their refpective dwelling-houses, or laft places of abode, together with a bill to be annexed to fuch demand, containing an account of fuch' charges and expences; then, and in every such case, the money fo expended fhall and may be recovered by the faid commiffioners, of and from the perfon or perfons fo liable thereto, by action or actions of debt, bill, plaint, or information, in any of his Majesty's courts of record at Westminster, in the name of the mayor, and commonalty, and citizens, of the faid city of London, to be commenced within three calendar months next after fuch demand refpectively; in which action or fuit, no effoin, protection, or wager of law, or more than one imparlance, fhall be allowed.

XXX. XXXI. And, for the more easily obtaining of water in cases of fire, it is hereby further enacted, That the feveral water com- Lifts of the panies, who fhall fupply any of the inhabitants of the faid city turncocks to with water, fhall from time to time give notice in writing to houfholders. the faid commiffioners, of the names and places of abode of their respective turncocks, diftinguishing the districts to which they respectively belong; and the faid commiffioners shall yearsly caufe to be printed and distributed through every ward within the faid city and liberties, to and amongst the feveral householders within the fame, a lift of the names and places of abode of the several turncocks of the district or districts within which every fuch ward refpectively fhall lie.

they fhall think proper; and alfo any pump or pumps, to be and pumps, erected in or near fuch places; and alfo any pumps now standing for the purpose of watering the faid streets, or for any other purpose, to be removed or altered; and to defray the expences thereof out of the monies to be raised by virtue of, and for the purposes of this act.

XXXIII. And, for the more effectually cleansing, and keeping clean, and duft holes, the faid freets, lanes, fquares, yards, courts, alleys, paffages, and places, erected. it is hereby further enacted by the authority aforefaid, That it fhall and may be lawful to and for the faid commiffioners to caufe any number of moveable or fixed duft boxes, duft holes, or conveniencies, wherein duft and afhes, or other filth, may be depofited for the scavengers or rakers, to be erected and placed in fuch parts of the faid streets, lanes, fquares, yards, courts, alleys, paffages, and places, as they fhall judge neceffary; and all and every the occupier and occupiers of houfes or tenements, within the said city and liberties, are hereby required, daily and every day, to cause all their duft, ashes, and other filth, to be depofited in the faid duft boxes, duft holes, or other conveniencies, or else to keep the same in their respective houses or tenements, with the appurtenances, until the fame fhall be removed and carried away by the refpective rakers, to be in this behalf appointed; and in cafe any fuch occupier of any house or tenement, within the faid city or liberties, fhall depofit, or cause to be depofited, any ashes, duft, or other filth, in any part of the said streets, lanes, fquares, yards, courts, alleys, paffages, and places, except in fome of the duft holes, duft boxes, or other conveniencies, fo to be erected or made as aforefaid; then the perfon fo offending fhall, for every fuch offence, forfeit and pay the fum of ten hillings..
