act of parliament, the feveral laws now in being relating to the raifing and training the militia within that part of Great Britain called England; have, through ignorance of the law, abfence, or feme unavoidable accident, omitted to take and fubfcribe the faid oaths and ofurance, or otherwife to qualify themselves as aforefaid, within such time, and in fuch manner, as in and by the said acts respectively, or by any other act of parliament in that behalf made and provided, is required, whereby they may be in danger of incurring divers penalties and difabilities: For quieting the minds of his Majesty's fubjects, and for preventing any inconveniences that might otherwife happen by means of fuch omiffions, be it enacted by the King's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, and by the authority of the fame, That all and every perfon or perfons, who fhall, on or before the twenty eighth day 1466, allowed of November, one thoufand feven hundred and fixty fix, take to perfons who and fubfcribe the faid oaths and affurance refpectively, in fuch have omitted cafes wherein by law the faid oaths and affurance ought to have to qualify themfelves, as been taken or fubfcribed, in fuch manner and form, and fuch the faid laws place and places, as are appointed in and by the said act made in direct. the first year of the reign of his faid late majefty King George the First, or by any other act or acts of parliament in that behalf made and provided; and alfo receive the facrament of the Lord's Supper, according to the ufage of the church of England, and make and fubfcribe the faid declaration against tranfubitantiation, in fuch cafes wherein the faid facrament ought to have been received, and the faid declaration ought to have been made and fubfcribed; and take and fubfcribe the oath directed by the faid act made in the eighteenth year of the reign of his late majesty King George the Second, in fuch cafes wherein the faid oath ought to have been taken and fubfcribed, in fuch manner as by the faid act is directed; and alfo, being a deputy lieutenant or officer of the militia, fhall, on or before the first day of August, one thousand seven hundred and fixty fix, leave his qualification in writing with the clerk of the peace, with whom he is, by the faid act made in the fecond year of his prefent Majefty's reign, required to leave the fame; fhall be and are hereby indemnified, freed, and difcharged, from and against all penalties, forfeitures, incapacities, and difabilities, incurred or to be incurred, for or by reafon of any former neglect or omiffion of taking or fubfcribing the faid oaths or affurance, or receiving the facrament, or making or fubfcribing the faid declarations, or taking and subfcribing the faid oath, or leaving his qualification in writing with the clerk of the peace refpectively, according to the above mentioned acts, or any of them, or any other act or acts, is and are and fhall be fully and actually recapacitated and restored to the felves in man fame ftate and condition as fuch perfon or perfons were before ner, and with- fuch neglect or omiffion, and fhall be deemed and adjudged to in the time, have duly qualified him, her, or themselves, according to the appointed, re- above-mentioned acts, and every of them; and that all acts and indemni done or to be done by any fuch perfon or perfons, or by autho

CAP. VI.

An act for extending the provisions of an act made in the last feffion of parliament, for the more eafy and speedy recovery of small debts within the hundreds of Blackheath, of Bromley and Beckenham, of Rokesley otherwife Ruxley, and of Little and Leffnefs, in the county of Kent, to the hundred of Wallington in the county of Surrey.

CAP. VII.

An act to indemnify fuch perfons as bave omitted to qualify themselves for offices and employments; and to indemnify juftices of the peace, deputy lieutenants, and officers of the militia, or others, who have omitted to register or deliver in their qualifications within the time limited by law, and for giving further time for thofe purposes; and to indemnify members and officers in cities, corporations, and borough towns, whofe admiffions have been omitted to be ftamped according to the Several acts of parliament now in force for that purpose, or, having been stamped, have been loft or miflaid, and for allowing them time to provide admiffions duly ftamped.

HEREAS divers perfons who, on account of their offices, Preamble, replaces, employments, or profeffions, or any other caufe or citing the feoccafion, ought to have taken and fubfcribed the oaths, or the affurance, veral qualify. respectively appointed to be by fuch perfons taken and fubfcribed, in and ing acts of by an act made in the first year of the reign of his late majesty King

George the Firft, of glorious memory, intituled, An act for the 1 Geo. 1, further fecurity of his Majesty's perfon and government, and the fucceffion of the crown in the heirs of the late princefs Sophia, being proteftants; and for extinguishing the hopes of the pretended prince of Wales, and his open and fecret abettors; or to 13 Car. 2, have qualified themselves according to an act made in the thirteenth year of the reign of King Charles the Second, intituled, An act for the well governing and regulating corporations; or to have qualified 25 Car. 2, themfelves according to another act made in the twenty fifth year of the reign of King Charles the Second, intituled, An act for preventing the dangers which may happen from popish recufants, by receiving the facrament of the Lord's Supper according to the ufage of the church of England, and making and fubfcribing the declaration against tranfubftantiation therein mentioned; or according to another act made in the thirtieth year of the reign of King Charles the Second, 30 Car. 2, intituled, An act for the more effectual preferving the King's perfon and government, by difabling papists from fitting in either house of parliament; or according to another act made in the eighteenth year of the reign of his late majefly King George the Second, intituled, An act to amend and render more effectual an act paffed in the fifth year of his prefent Majefty's reign, intituled, An act for the further qualification of justices of the peace; or according to another act made in the fecond year of the reign of his prefent Ma- and 2 Geo. 3. jefty, intituled, An act to explain, amend, and reduce into one

fions, or entries of admiffions as aforefaid duly ftamped, are and fhall be hereby confirmed and qualified to act as member or members, officer or officers, of fuch cities, corporations, and borough towns refpectively, to all intents and purposes, and shall and may hold, and enjoy, and execute the fame, or any other office or offices into which he or they hath or have been elected, notwithstanding his or their omiffion, or the omiffion of any of and they are their predeceffors in fuch cities, corporations, or borough towns, thereupon in- as aforefaid, and fhall be indemnified and difcharged of and from demnified,&c. all incapacities, difabilities, forfeitures, penalties, and damages,

V. Provided always, That when and as often as any member or members, officer or officers, of any city, corporation, or borough town, fhall defire to have his or their admiffions, or the entries of their admiffions as aforefaid, renewed or confirmed in manner aforelaid, the mayor or other chief magistrate of fuch city, corporation, or borough town, fhail, and he is hereby required in every fuch cafe, upon notice given to him by any one or more member or members, officer or ofa hall is to be ficers, of any fuch city, corporation, or borough town refpecfummoned for tively, to fummon a hall, common council, or other proper granting co- publick meeting, within ten days after fuch notice given to him, pies, and confirming fuch for the purpofe of admitting or granting copies, or renewing and confirming the admiffions, or the entries of the admiffions, of fuch perfons as aforefaid.

CAP. VIII.

An act for punishing mutiny and desertion; and for the better payment of the army and their quarters.

Preamble. Number of forces 17,306, including 2,513 invalids. After 24 March 1766, during the continuance of this act, every officer and private man, who thall mutiny or defert, &c. or lift in any other regiment, &c. or fhall be found fleeping on, or fhall defert, his poft, or hold illegal correfpondence with the enemies of his Majefty, or shall strike, or disobey his fuperior officer; fhall fuffer death or fuch punishment as a court-martial fhall inflict. The King may grant a commiflion to hold a court-martial, &c. Courts-martial may inflict corporal punishment for immoralities, &c. General court martial not to confift of less than 13; and the prefident to be a field officer, or officer next in feniority, not under the degree of a captain. May administer an oath to witneffes. Officers to be fworn. The oath. The oath. The judge advocate to be sworn. The oath. In sentences of death, nine officers to concur, &c. Hours of trial. Deferter may be adjudged to ferve in any corps abroad for life, or a term of years; but returning without leave before expiration of fuch term, he thall fuffer death. The party tried, intitled to a copy of the sentence and proceedings of the court-martial. Original proceedings, &c. of courts-martial to be tranfmitted to the judge advocate general in London, &c. None to be tried a fecond time for the fame offence, except in case of appeal. This act not to exempt foldiers from ordinary process. Penalty on falfe certificates to excufe foldiers from mutters. Penalty on officers making falfe multers, &c. Fictitious names allowed by his Majesty's order upon the mufter-rolls, for the maintenance of officers widows, not to be conftrued a false muster. Mutter-mafter to give notice of mufter to mayor, &c. Penalty on mustermafter neglecting fo to do, Mufter-rolls to be figned by the mayor, &c. Dragoons, &c. and their borfes, to be billeted in the fame houfe. Manner of changing men and horfes. Claufe relating to a foldier's fettlement for his wife and children. Officers, &c. to be quartered in Scotland as the laws in force at the union direct. No paymaiter, &c. to make deductions out of officers or private mens pay. Exceptions. Treasury may iffue out the money due for clothing every two months. Paymasters to deduct the off reckonings. Officers to give notice to innkeepers of subsistence-money in their hands. Rates of fubfiftence to be paid to innkeepers, &c. for foldiers quarters. Penalty on officers not paying fubfiftence-money. On nonpayment of quarters, the officer to make up accounts, &c. No mufter in Westminster, &c. but in the prefence of two or more juftices. Conftables, &c. may billet foldiers in Weftminster, &c. Petty conftables, &c. to quarter foldiers in their respective divifions. Conftables, &c. to deliver lifts at quarter feffions, on oath, of inhabitants, and foldiers quartered in their respective divifions; to be infpected without fee. Copies of fuch lifts to be wrote by the clerk, at 2 d. per theet, containing 150 words. Penalty on default. Penalty on giving defective lifts. How to be levied. This act to extend to Jerley, &c. Multer-rolls to be closed on day of muster, and returned to the paymaster of the forces, &c. Penalty. Juftices may order constables to provide carriages. Rates for carriages. Penalty on officers forcing waggons to travel more than one day's journey, &c. Penalty on conftables, &c, neglect. Treasurers of the county to repay the conftables extraordinary charges. The money for thofe purposes how to be raised. No waggon, &c. to carry above 30 hundred weight. Carriages in Scotland how to be provided. Soldiers wives, &c. not to be quartered without confent. Penalty. Penalty on officers or foldiers deftroying the game. How the account of every regiment fhall be kept. Penalty on paymatters, &c. Penalty on colonels. Non-commiffion officer embezziling foldier's pay, &c. to be reduced, &c. Juftices may commit deferters. Reward for taking up deferters. Penalty on perfons concealing deferters, or buying their arms, clothes, &c. Penalty on officer breaking open house without warrant. His Majefty impowered to make articles of war. None to be adjudged of life or limb, but for crimes expreffed to be fo punishable by this act. Deferters beyond fea, &c. may be tried here or in Ireland. This act to extend to deferters, &c. in Ireland, &c. Perfons acquitted by the civil magiftrate, may only be cafhiered by a court-martial. Perfons accufed of capital crimes, &c. to be delivered over to the civil magiftrate, &c. Paymafters, &c. to account with executors. Perfons fued may plead the general iffue. Treble cofts. All fuits to be brought in fome of the courts of record at Westminster or Dublin, or the court of feflion in Scotland. Continuance of this act. Penalties against the act George 1. where to be fued for. No volunteer liable to procefs, unlefs for fome criminal imatter, or unless for a real debt of the value of 101. Oath of the debt to be made before a judge, and a memorandum thereof marked on the back of the process. Plaintiff may file a common appearance. Penalty on taking money to excufe any perfon from quartering; or victuallers refufing to quarter foldiers. Jultices may order conftables to give an account of the

number of foldiers quartered, &c. How the troops are to pay in paffing over ferries in Scotland. Claufe for relief of perfons haftily lifting themfelves. Perfons refusing the said relief, to be proceeded against as if duly lifted. Offences against former mutiny acts punishable by this act. None liable to be tried or punished for offences against former acts unless committed within three years; except for defertion. Officers, &c. of the trains of artillery fubject to this act. American troops, acting in conjunction with British forces, liable to the fame martial laws. Officers and foldiers of the American troops fent over to Great Britain, to be quartered and billeted as the British forces, and under the fame regulations and penalties. Where any corps beyond feas fhall be relieved in order to return home, fuch of the men as fhall choofe may be inlifted, and incorporated with thofe appointed to remain; the occafion of quitting fuch former corps to be recited in the inlifting certificate. This act not to extend to the militia farther than is directed by the militia laws. As often as it shall be neceffary, officers of the land and marine forces may fit in conjunction upon courts-martial; taking rank according to the feniority of their commiffions CAP. IX.

An act for granting an aid to his Majefty by a land tax to be raised in Great Britain, for the fervice of the year one thousand feven hundred and fixty fix.

Preamble. 2,037,8241. 153. and 11d. to be raised in Great Britain. 1,989,170 l. 14 s. and 9 d. to be raised in England, in one year, from 25 Mar. 1766. Perfonal eítates (except defperate debts, ftock on land, houfhold goods and loans to his Majesty) to pay 4s. in the pound. Employments of profit (except military officers of the army or navy) to pay 4s. per pound. Penfions and annuities out of the exchequer, &c. to pay, &c. Lands, tenements, mines, &c. to be charged with equality and indifference, &c. Lands, &c. fubject to rent-charges, annuities, &c. Commiffioners of the land tax for the year 1763, to put this act in execution. Commiffioners to meet on or before the 30th of April, 1766, as by the act 4 W. & M. and may fubdivide themselves, &c. A lift of the commiffioners to act in each divifion, to be given to the receiver-general. Commiffioners to fummon fit perfons to be affeffors, who are to appear before them in 8 days; and then to give them a charge. Perfons abfenting, or refufing to ferve, forfeit, not exceeding 51. nor less than 40 s. Affeflors to be two at leaft, and fufficient inhabitants. Affeffments to be brought in at a day and place prefixt. The full fum charged to be affeffed. A certificate of the affeffment to be brought in, with the collectors names. Affeffors, &c. neglecting their duty, to be fined not above 401. Affeffors to deliver one copy of the affeffments to the commiffiouers. Duplicates thereof to be figned, &c. and one delivered to the collectors, &c. with warrant for collecting. Commiflioners required to give collectors notice at what time and place the appeal of any perfon who shall think himself aggrieved, by being over-rated, may be heard and determined. A duplicate in parchment to be delivered, together with the names of the affeffors and collectors to the receiver general; and one to the remembrancer's office, by 8 Aug. 1766, or 20 days after (all appeals firft determined.) Remembrancer to give receipts gratis on penalty of rol. The rates to be levied on the parties or premiffes, and to be paid to the receivers-general, &c. The money collected to be paid to the receiver-general, or deputies; and they to give commiffioners notice. Collectors not obliged to travel above 10 miles. Removal or death of receiver general to be notify'd to the commiflioners. 497,467 l. 13 s. and 8 d. 1q. for the first quarterly payment, to be paid to the receivers by 24 June, 1766. The fecond payment by 29 Sept. 1766. The third payment by 25 Dec. 1766. The last payment by 25 March, 1767. Receiver-general within a month after receiving the full fum charged, to give the commiffioners a receipt which fhall be a full discharge for payment. Receiversgeneral within 20 days to pay the monies into the exchequer. Receiver geLeral allowed 2 d. in the pound. Collectors to have 3 d. in the pound. Commiffioners clerks to have three halfpence in the pound. Collectors may levy by diftrefs in cafe of refufal of payment.
