ployed as aforefaid, fhall be reasonably gratified for their faid affiftance and trouble, or good fecurity given, for that purpose, to the fatisfaction of the feveral parties that are to receive the fame; and that in cafe after fuch falvage, the commander or other fuperior officer, mariners or owners of such ship or veffel fo faved, as aforesaid, or merchant whofe goods fhall be fo faved, as aforefaid, fhall difagree with the faid officer of the customs, or his deputy, touching the monies deserved by any of the perfons fo imployed, as aforefaid, it fhall be lawful for the commander of fuch fhip or veffel fo faved, or the owner of the goods, or the therchant interested therein, and also for the faid officer of the caftoms, or his deputy, to nominate three of the neighbouring juftices of the peace, who fhall thereupon adjust the quan- Three juftices tum of the monies or gratuities to be paid to the feveral perfons to adjust the acting or being imployed in the falvage of the faid fhip, veffel quantum. or goods; and fuch adjustments fhall be binding to all parties, and fhall be recoverable in an action at law to be brought in any of her Majesty's courts of record, by the refpective perfons to whom the fame fhall be allotted by the faid juftices of peace; and

in cafe it fhall happen, that no perfon fhall appear to make his Goods not claim to all or any the goods that shall be faved, that then and claimed in 12 in fuch cafe, the chief officer of the customs of the nearest port to months, to be the place where the faid fhip or veffel was fo in distress, as aforefaid, fhall apply to three of the nearest justices of the peace, who fhall put him or fome other responsible person in poffeffion of the faid goods, fuch justices of peace taking an account in writing of the faid goods, to be figned by fuch officer of the cuftoms; and if the faid goods fhall not be legally claimed within the space of twelve months next enfuing, by the rightful owner thereof, then publick fale fhall be made thereof, and if perithable goods, forthwith to be fold, and after all charges de- and the monies ducted, the refidue of the monies arifing by fuch fale, with a transmitted fair and juft account of the whole, fhall be tranfmitted to her into the ExMajefty's Exchequer, there to remain for the benefit of the chequer, &c. rightful owner when appearing, who upon affidavit or other proof made of his or their right or property thereto, to the fatisfaction of one of the barons of the coife of the Exchequer, hall upon his order receive the fame out of the Exchequer.

III. any fuch goods, before the fame fhall be taken down in a book or books for that purpose provided by the commander or ruling officer, and the firft officer of the customs, as aforesaid, fuch perfon or perfons fhall, within the space of twenty days, make double fatisfaction to the party grieved, at the difcretion of the two next juftices of peace, or in default thereof, fhall by fuch juftices of peace be fent to the next house of correction, where he fhall continue and be imployed in hard labour by the space of twelve months then next enfuing; and that it shall be lawful for any commander or fuperior officer of the said ship or vessel so in diftrefs as aforefaid, or for the faid officer of the cuftoms, or conftables on board the fame fhip or veffel, to repel by force any fuch person or perfons as fhall, without fuch leave or confent from the faid commander or fuperior officer, or the faid officer of the customs, or his deputy, or fuch conftables, as aforefaid, prefs on board the faid fhip or veffel fo in diftrefs, as aforefaid, and thereby moleft them in the preservation of the faid ship or veffel fo in diftrefs, as aforefaid.

IV. And it is hereby likewise enacted, That in cafe any goods fhall be found upon any perfon or perfons, that were ftolen or carried off from any fuch fhip or veffel fo in diftrefs, as aforefaid, he, fhe, or they, on whom fuch goods fhall be found, fhall immediately, upon demand, deliver the fame to the owner thereof, or to fuch perfon by fuch owner authorized to receive the fame, or in default thereof, fhall be liable to pay treble the value of fuch goods, to be recovered by fuch owner in an action at law to be brought for the fame.

V. And it is hereby moreover enacted, That if any person or perfons fhall make, or be affifting in the making any hole in the bottom, fide, or any other part of any fhip or veffel fo in diftrefs, as aforefaid, or thall fteal any pump belonging to any ship or vessel so in diftrefs, as aforefaid, or fhall be aiding or abetting in the stealing fuch pump, as aforefaid, or fhall wilfully do any thing tending to the immediate lofs or deftruction of fuch fhip or veffel, fuch perfon or perfons fhall be and are hereby made guilty of felony, without any benefit of his, her, or their clergy.

VI, And be it further enacted by the authority aforefaid, That if any action, fuit, or information, fhall be commenced or profecuted against any person or perfons, for any thing that he or they fhall do, or caufe to be done, in pursuance of this act, and executing any of the powers and authorities, or any of the orders or direction therein mentioned, all and every perfon and perfons fo fued in any court whatsoever, fhall and may plead the general iffue, and give this act and the special matter in evidence; and if in any fuch fuit the plaintiff or profecutor fhall become nonfuit, or forbear profecution, or discontinue the fuit, or if a verdict fhall pass against him, or judgment be given against him upon a demurrer, then in any of the faid cafes, the defendant or defendants fhall recover full cofts, for which he and they fhall have the like remedy as where cofts by law are awarded;

Provided nevertheless, if any officer of the cuftoms, or Cuftom house his deputy fo impowered, as above, fhall, by fraud or wilful officer abufing neglect, abuse the truft fo hereby repofed in him, as aforefaid, forfeit treble and shall be convicted thereof in due form of law, fuch officer, damages, and or his deputy, fhall respectively forfeit treble damages to the party difabled. grieved, to be recovered in any action or fuit to be brought in any court of record, and shall from thenceforth be fully disabled and rendred incapable of the fame, or any other imployment relating to the faid customs.

VIII. And it is hereby further enacted, That this act, and Act to comthe feveral claufes herein contained, fhall take effect from mence 1 Aug. and after the first day of August in the year of our Lord one 1714. and to thousand seven hundred and fourteen; and that for the better times in the obferving of the fame, this act fhall be read four times in the year on Sunyear in all the parish churches and chapels of every fea-port days in featown, and upon the fea-coaft in this kingdom, upon the Sun- port towns. days next before Michaelmas-day, Chriftmas-day, Lady-day, and Midfummer-day in the morning, immediately after the prayers, and before the fermon.

IX. Provided always, and it is hereby enacted, That neither Claims to this act, nor any thing herein contained, fhall any ways extend wreck faved. to deprive, or any ways prejudice her royal Majefty, her heirs or fucceffors, or any claiming under them, or any of them, or any patentee or grantee of the crown, or any lord or lords of any manor or manors, or other perfon whatsoever, of or in relation to any right which they, or any of them refpectively have, or fhall have, or lawfully may claim to any wreck or wrecks, or any goods that are or fhall be flotfam, jetfam or lagan, but that fuch refpective rights fhall be enjoyed in as full, ample, and beneficial a manner, in every refpect, as if this act had never been made.

X. Provided, That this act fhall continue in force for the space Continuation of three years, and from thence to the end of the next feffion of parliament, and no longer. Made perpetual by 4 Geo. 1. 6. 12.

CAP. XIX.

An act to explain a clause in an act of parliament of the tenth year of her Majesty's reign, for laying several duties upon all fope and paper made in Great Britain, or imported into the fame; and upon chequered and striped linens imported; and upon certain filks, callicoes, linens and fluffs, printed, painted or stained; and upon several kinds of Stampt vellum, parchment and paper; and upon certain printed pamphlets and advertisements; for raising the fum of eighteen hundred thousand pounds by way of a lottery; and for other purposes in the faid all mentioned, fo far as the faid at relates to lawns, canvas, buckrams, barras, and Silefia neckcloths.

HEREAS in and by an act passed in the tenth year of her prefent Majefty's reign, intituled, An act for laying feveral duties upon all fope and paper made in Great Britain, or imported into the fame; and upon chequered and striped linens imported; and upon certain filks, callicoes, linens and stuffs, printed, painted or stained; and upon several kinds of stampt vellum, parchment and paper; and upon certain printed papers, pamphlets and advertisements; for raising the fum of eighteen hundred thousand pounds by way of a lottery, towards her Majefty's fupply; and for licenfing an additional number of hackney chairs; and for charging certain stocks of cards and dice; and for better fecuring her Majefty's duties to arife in the office for the ftamp-duties by licences for marriages and otherwise; and for relief of perfons who have not claimed their lottery tickets in due time, or have loft Exchequer bills, or lottery tickets; and for borrowing money upon stock (part of the capital of the South Sea company) for the ufe of the publick: it was enacted, That there should be raifed, levied, collected and paid, to and for the ufe of her Majefty, her heirs and fucceffors, for and upon all chequer ed and friped linens, and upon all linens, and upon all linens printed, painted, flained or dyed, after the manufacture, or in the thread and yarn before the manufacture, in any foreign parts, which at any time or times, within or during the term of thirty-two years, to be reckoned from the twentieth day of July one thousand feven hundred and twelve, fhould be imported or brought into the kingdom of Great Britain, and might lawfully be used or worn there (over and above all other cuftoms, fubfidies and duties imposed upon, or payable for the fame) a duty of fifteen pounds for every one hundred pounds of the true and real value thereof, to be paid by the importers respectively; and also, that all and every printers, painters, flainers, dyers, drapers, mercers, upholders, traders and dealers refpectively, having on the faid twentieth day of July, one thousand feven hundred and twelve, in his, her, or their euftody or poffeffion, or in the custody or poffeffion of any other perfon or perfons, for his, her or their use, benefit or account, any flock or quantity of fuch chequered or ftriped linens, or of such printed, painted, stained

or

or dyed filks, callicoes, linens, or fuch stuffs, as aforesaid, being for fale, either wholesale or retail, fhould yield and pay to her Majefty for the fame, fo much money as one half-part of the rates and duties by the faid act impofed on the like refpective commodities, after the commencement of the faid act, should amount unto; the faid half-part for the faid flocks to be paid within three months after the said twen tieth day of July aforefaid; and whereas fome doubts have arisen whether lawns, linens ftriped or chequered, being all white, and neckcloths having fripes at the end only; as also barras striped or chequered, and buckrams are liable by the faid act to the above mentioned duties; be it enacted and declared by the Queen's moft excellent Lawns, Silefia majesty, by and with the advice and confent of the lords fpiritual neckcloths, and temporal and commons, in this prefent parliament affem- barras, canbled, and by the authority of the fame, That all lawns, and vas, and buckftriped or chequered linens, being all white, and neckcloths chargeable by striped at the end only; and also barras, or packing canvas and 10 Ann. c. 19. buckrams, were not charged, or intended to be charged by the f. 66. faid recited act, upon the importation thereof, with any of the duties by the fame act granted; any thing in the faid recited act contained to the contrary thereof notwithstanding.

An act to explain and make more effectual an act passed in the tenth year of her prefent Majefty's reign, for preventing abufes in making linen cloth, and regulating the lengths and breadths, and equal forting of yarn, in each piece made in Scotland, and for whitening the fame.
