the royal hofpital at Greenwich, and for the further benefit the officers thereof, and for the preferving her Majefty's harbour moorings, it was (among other things) enacted, That the fum of four thousand money. pounds out of the fares of the feveral captors of prizes, by virtue of her Majefty's declaration of the first of June one thousand feven hundred and two, which should remain uncalled for within the times by the faid act limited for the payment of the fame, fhould be applied for or towards the payment of certain rewards for taking or defroying hips of war or privateers of the enemy, during the late war, to and among the flag officers, captains, and other officers and companies of her Majefty's fhips of war, their executors or adminifirators, entitled thereunto by virtue of the faid declaration, in fuch proportion as by the faid declaration is directed, if the fame fhould be decreed to them by the high court of admiralty, and lifts of the fhips entitled to fuch rewards by fuch decree, should be tranfmitted to the receiver or receivers of prizes, and the fame should be claimed, and afterwards demanded to be paid within the respective times for the faid feveral purposes limited by the faid act; and that if the feveral fums fo to be decreed and demanded for fuch rewards fhould amount in the whole to more than four thousand pounds, then the faid four thousand pounds fhould be divided among the feveral claimers, by way of average, in proportion to their respective interests, to be adjusted by the receiver or receivers of prizes, or perfon or perfons appointed for the fame: and whereas lifts of the perfons on board fome of the fhips, entitled to fuch rewards, at the time of the taking or destroying fuch ships of war or privateers of the enemy, during the late war, for which the fame became due, have never been tranfmitted unto the receiver or receivers of prizes, the fame not having been fufficiently provided for in the faid act, by reafon whereof the receiver or receivers of prizes have been unable to adjust the proportions belonging to feveral claimers of fuch rewards, and to make diftribution of the faid four thousand pounds according to the faid act; for remedy, &c.

LXIX. And be it enacted by the authority aforefaid, That Appropriaall the money lent, and to be lent to her Majefty upon one act tion of the feof this feffion of parliament, intituled, An act for granting an aid to her Majefty, to be raised by a land tax in Great Britain, for the feflion. fervice of the year one thousand feven hundred and fourteen, and fo much money (if any fuch be) of the tax thereby granted, as fhall arife and remain after all the loans made or to be made upon that act, or thereby transferred or directed to be transferred thereunto, and the intereft thereof, and the charges thereby allowable for raifing the faid tax, fhall be fatisfied, or money fufficient fhall be referved to difcharge the fame; and all the monies lent, or to be lent unto her Majefty, upon the duties of malt, mum, cyder and perry, charged and continued by another act of this feffion of parliament, for the fervice of the 12 Ann. flat., year one thousand feven hundred and fourteen; and fo much c. 3.

money of the faid duties of malt, mum, cyder and perry thereby granted or continued, as fhall arife and remain after all the loans made or to be made upon that act, or thereby transferred or directed to be transferred thereunto, and the intereft thereof, and the charges thereby allowable for raifing the faid duties thereby granted, fhall be fatisficd, or money fufficient fhall be referved to difcharge the fame; and all the furplus or unappropriated monies, which fhall arife and be paid into the Exchequer, for the ufe of the publick, from and after the twelfth day of June one thoufand feven hundred and fourteen, until all the provifions of money intended by this act for the ufes and purposes herein after mentioned fhall be fatisfied, and all the monies which, over and above the allowances for prompt payment, and other allowances directed by this act, fhall arife, of or for the faid contributions, not exceeding the fum of one million four hundred thousand pounds in this act mentioned, shall be appropriated for or towards the feveral uses, intents and purposes herein expreffed, fubject nevertheless to fuch restrictions as are herein after prefcribed; that is to fay, it is hereby enacted and declared, That out of all or any the aids or fupplies by this act provided, as aforefaid, there thall and may be iffued and applied the fum of feven hundred forty five thousand feven hundred pounds and three pence, for defraying the charges of the ordinary of her Majefty's navy, including half-pay to feaofficers, and for victuals, wages, wear and tear of the navy, and victualling thereof, performed and to be performed, and for fea-fervice in the office of ordnance, performed and to be performed; and any further fum not exceeding three hundred thousand pounds, towards fatisfying the debt due for feamens wages, and to the yards, and for the debt due to the marines; Sea chaplains. and any further fum not exceeding three thousand pounds, to Vide 3 Geo. 1. be equally diftributed among the chaplains that ferved in the fleet during the late war, and are not otherwise provided for; Guards and and any fum not exceeding three hundred eighty fix thousand garrifons in four hundred twenty feven pounds feventeen shillings and ten Great Britain, &c, pence, for maintaining guards and garrifons in Great Britain, Jerfey and Guernsey, together with two independent companies in North Britain, for one year, from the twenty fourth day of December one thousand seven hundred and thirteen, to the twenty fifth day of December one thousand seven hundred and fourteen; and any fum not exceeding fifty four thousand fix hundred forty five pounds one fhilling and three pence, for Forces at Mi- maintaining her Majefty's forces and garrifon at Minorca for the fame year; and any fum not exceeding thirty four thoufand eight hundred fifty fix pounds fourteen fhillings and nine pence half-penny, for maintaining her Majefty's forces and garrifon at Gibraltar for the fame year; and any fum not exceeding twenty thousand one hundred and feventy pounds one fhilling NewYork, &c. and fix pence, for maintaining four companies at New York, four companies at Annapolis Royal, four companies for Placentia, one company at Bermudas, and the garrifons of Annapolis Royal and

LXX. Provided always, and it is hereby enacted and declared, That no appropriation, or other matter or thing in this act contained, fhall obftruct or hinder any payment or payments, which, by and in pursuance of an act made in the ninth year of her Majefty's reign, intituled, An ac for making good deficiencies, and fatisfying the publick debts; and for erecting a corporation to carry on a trade to the South Seas, and for incouragement of the fibery; and for liberty to trade in unwrought iron with the Jubjects of Spain, and to repeal the acts for regiftring feamen, and of her Majefty's charter grounded thereupon, are or shall be required and authorized to be made by the treasurer or paymafter of the navy for the time being, or by any other perfons to be intrufted with the publick monies for the fervice of the navy, out of fuch publick monies, tallies, orders, or parliamentary fecurities in their hands or power respectively, as are or shall thereby be charged or chargeable to make good any deficiency or deficiencies to the corporation erected in pursuance of the act lait mentioned, called by the name of the governor and company of merchants of Great Britain trading to the South Seas, and other parts of America, and for incouraging the fishery, or to their treasurer for their ufe; any thing herein contained to the contrary notwithstanding.

LXXI. Provided alfo, That fuch fums as, by any other act commiffioners of this feffion of parliament, fhall be payable to any commifof accounts. fioners of accounts for their falaries, or for their clerks, or any other incident charges, fhall and may be paid out of the aids or fupplies aforesaid, or any of them; any thing herein contained to the contrary notwithstanding,

An act for railing the militia for the year one thousand feven hundred and fourteen, although the month's pay formerly advanced be not repaid; and for rectifying a mistake in an act paffed in this prefent feflion of parliament, intituled, An act for the better regulating the forces to be continued in her Majefty's fervice, and for payment of the faid forces and their quarters. CAP. XI.

An act to prevent the lifting her Majefty's fubjects to ferve as foldiers without ber Majesty's licence.

HEREAS feveral ill-affected perfons, fubjects of the crown of Great Britain, have lately, in open defiance of the laws, prefumed traiterously to lift divers of her Majesty's fubjects within the kingdoms of Great Britain and Ireland, to ferve the perfon pretended to be prince of Wales, during the life of the late king James the Second, and fince his deceafe pretending to be, and taking upon bimfelf the file and title of King of England, by the name of James the Third, as foldiers, to the great disturbance of the peace of thefe her Majesty's kingdoms: and whereas the like traiterous practice may be more covertly carried on, under pretence of lifting her Majesty's fubjects to ferve as foldiers under fome foreign prince, State er potentate: for remedy thereof, be it, &c.

Subjects of Great Britain who fhall, after 1 Auguft 1714. within the kingdom, or in Ireland, and after 1 October out of the kingdom, lift themfelves to ferve any foreign prince, &c. or procure any fubject fo to do, without her Majefty's licence, fhall be guilty of high treafon. Offences out of the realm, where to be tried. No licence fhall exempt from the penalty, perfons lifting any fubject to ferve the French King. Continuance of the act for three years. E X P.

CAP. XII.

An att for the better maintenance of curates within the church of England; and for preventing any ecclefiaftical perfons from buying the next avoidance of any church-preferment.

Wupplied by curates that are sufficient and licensed preachers,

HEREAS the abfence of beneficed minifters ought to be

and no curates or minifters ought to Jerve in any place without the examination and admiffion of the bishop of the diocese, or ordinary of the place, having episcopal jurisdiction: but nevertheless, for want of fufficient maintenance and encouragement for fuch curates, the cures within that part of Great Britain called England, have been in feveral places meanly fupplied: for remedy whereof, be it enacted by the Queen's moft excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this present parliament affembled, and by the authority of the fame, That if any rector or vicar having cure of fouls fhall, After zo Sept. from and after the nine and twentieth day of September, in the 1714. bishop, &c. to appoint year of our Lord one thousand seven hundred and fourteen, a ftipend to nominate and prefent any curate to the bishop or ordinary, to curates, not be exceeding gol.
