Resolution

For the payment of furniture purchased for the Governor's room.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the Clerks of the Senate and House of Representatives, be authorized to pay for furniture bought by the late Clerk of the House of Representatives, to furnish the Governor's room, for the payment of which there is no provision, and that the sum of fifty-five dollars is hereby appropriated for that purpose.

Relative to the Superintendents of Motive Power, and disbursements upon the Canal and Railways.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly

met, That the superintendents of transportation or motive power on the railways of this commonwealth, shall have power to draw out of money received for motive power, and disburse moneys for the maintenance of motive power, agreeably to the provisions of the ninth section of the act passed the sixth day of April, Anno Domini, eighteen hundred and thirty, entitled " An act relative to the appointment of Canal Commissioners:" Provided, That the amount Proviso. of surety shall be increased to twenty thousand dollars, and that the said superintendents may, by the consent of the Canal Commissioners, draw any amount not exceeding twenty thousand dollars.

Resolved, That from and after the passage of this resolution, it shall be the duty of the Canal Commissioners, upon information being given, and due proof made to the board, that any superintendent of construction, superintendent of transportation or motive power, or any supervisor on any the lines of the public improvements, has issued or circulated any scrip or evidence of debt against the commonwealth, or has obtained or procured any receipt from any person, for any debt due by or from the commonwealth, without the actual payment of the money, it shall be the duty of the Canal Commissioners forthwith to discharge and remove the said disbursing officer, as soon as such fact shall have been made known to them.

Resolution

Relative to the undrawn balances in the School fund.

WHEREAS, it appears from the report of the Superintendent of Common Schools, that the undrawn balances of the school fund appropriated to districts that have hitherto refu

sed to accept of the General System of Education, will, under the act passed on the thirteenth day of June, Anno Domini, one thousand eight hundred and thirty-six, revert to the i Common School fund during the present year; And whereas, it is known to have been the intention of the Legislature, that the said undrawn balances should remain in the treasury, and accumulate for the use of such districts respectively, until the first day of November, one thousand eight hundred and thirty-eight; Therefore,

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the balance of appropriation made under the act entitled "An act to establish a General System of Education by Common Schools," passed the first day of April, one thousand eight hundred and thirty-four, and the supplement thereto, and the balance of the first appropriation of one hundred thousand dollars, which shall remain undrawn on the first day of November, one thousand eight hundred and thirty-six, and all subsequent balances, shall remain in the treasury, and accumulate for the use of such district or districts, entitled to the same, for any term not exceeding one year from and after the first day of November, one thousand eight hundred and thirty-seven, and all such undrawn balanees remaining in the treasury on the first day of November, one thousand eight hundred and thirty-eight, shall be re-paid into the school fund; and in like manner, the undrawn balances of subsequent appropriations shall be repaid into the said fund annually thereafter.

Resolution

Relative to the claim of John Keene.

SECTION 1. Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General

Assembly met, That the Canal Commissioners be, and they are hereby authorized and required to estimate, or cause to be estimated, the amounts of hydraulic lime or water cement, furnished by John Keene, tò contractors along the Western Division of the Pennsylvania Canal, and used by them, or any of them, in the construction of the locks along said division, and not included in the estimates of said contractors, and paid for by the commonwealth.

Resolved, That the value of all lime furnished and used as aforesaid, being estimated and determined according to the usual prices for hydraulic lime or water cement, at the time said lime was furnished by the said John Keene, shall be paid, and the Auditor General is hereby authorized to settle the same, in the way and manner other accounts are audited.

Resolution

Relative to the payment of expenses incurred in the survey of the route of a railroad to connect the Pennsylvania Canal at or near Freeport, with the Pennsylvania Canal at or near New Castle.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That whereas, the Canal Commissioners, in pursuance of an act passed the eighteenth February, eighteen hundred and thirty-six, directed a survey to be made and estimate, and report upon the practicability and importance of connecting by railroad, the Pennsylvania Canal at or near Freeport, by way of Butler, with the Pennsylvania Canal at or near New Castle, for which the sum of five hundred dollars was specifically appropriated; And whereas, The said

survey and estimate has been made, in pursuance of the orders of the said Canal Commissioners, but the sum appro priated was not sufficient to pay off the engineers and hands employed in making the said survey; And whereas, justice and equity requires that provision should be made for the payment of said expenses; Therefore,

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the Canal Commissioners are hereby authorized Accounts of to cause to be settled and adjusted, the accounts of Thomas J. Power, civil engineer, and others, employed in the survey of a railroad from New Castle, by the way of Butler, to Freeport, and whatever balance may appear justly due them, the said Canal Commissioners are hereby authorized to draw war. rants in favor of the superintendent of said survey, for the amount of such balances, on the State Treasurer, payable out of any moneys in the treasury not otherwise appropriated; and the said superintendent of surveys shall settle his account with the accountant officers, in the usual manner: Provided, That the sum of money hereby authorized to be paid, shall not exceed fourteen hundred dollars.
