SECTION 42. SECTION 43. That the town council aforesaid be, and are hereby authorized and empowered to levy and collect a tax on any dog or dogs, owned or kept within the limits of the said borough, which tax shall be levied and collected in the same manner, and applied to the same purposes as the other taxes of the said borough, and that they be further authorized to pass all ordinances necessary to effect the said purpose.

SECTION 44. In case the place of any member of the town council of said borough shall become vacant, by the death, resignation, or otherwise, the said vacancy shall be supplied by an appointment made by the council, and any person so appointed, shall hold his office until the next borough election: Provided, That any member resigning, shall be liable to the same penalties as if he had originally refused to serve, and any person refusing to serve, when duly appointed by the town council aforesaid, shall be liable to the same pen. alties.

An Act

For the relief of Joseph Fulton and others, soldiers and widows of soldiers of the Revolutionary and Indian wars.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in Gen- Annuities & eral Assembly met, and it is hereby enacted by the authority 840 each, to gratuities of of the same, That the State Treasurer be, and he is hereby Jos. SECTION 4. The State Treasurer is hereby authorized and required to pay to Frederick Keefer of Franklin county, and

An Act

Authorizing James Worth, a surviving executor of the last will and testament of Isaac Knight, and trustee appointed therein, to cut and sell certain wood upon the estate devised to him in trust, and to authorize the sale of the estate of John Brown, deceased.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That it shall and may be lawful, if the Orphans' Jas. Worth, Court of Montgomery county shall approve thereof, for James Ex'r. of Isaac Worth, sole surviving executor of the last will and testament Knight of of Isaac Knight, late of Abington township, in the county of Montgomery Montgomery, deceased, and devisee in trust of a certain co. deceased, messuage and plantation, or tract of two hundred acres of inay sell land, more or less, for Mary Elizabeth Worth and her children, to cut down or sell so much of the standing wood and timber on the said plantation or tract of land, as may be cut Monies aris- or sold without injury to said land, and the moneys thereing therefrom arising, to invest under the order of the Orphans' court from to be in- for the county of Montgomery, in such securities as are here

ing, the wood and timber herein before mentioned, he shall, together with two or more sufficient sureties, to be approved of by the Orphans' court of Montgomery county, become bound to the Commonwealth of Pennsylvania, for the use of the parties interested, by recognizance, in the sum of twelve thousand dollars, lawful money of the United States, upon condition that he shall duly and faithfully account for the proceeds of the sale of the wood and timber aforesaid, and duly and faithfully make such appropriation and investment thereof as is hereinbefore directed.

An Act

To authorize Job Mann, guardian of the minor children of John Tod, to sell and convey certain real estate, and relative to the sale of real estate of James Coleman, deceased.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That Job Mann, guardian of Julian, Rachel and Isabella Tod, minor children of the Honorable John Tod, deceased, is hereby authorized and empowered to sell at pubchildren of J. lic outcry, upon reasonable notice, a certain tract of land, situTod, dec'd., ate on the Cove mountain, on the road from the Snake spring authorized to to Morison's cove, in Bedford county, containing two hundred sell certain and twenty acres, being part of the real estate of said John Tod, deceased, and to make and to execute a deed, conveying to the purchaser or purchasers thereof, all the right, title and interest of the said minors, of, in and to the said tract of land, in fee simple; said Job Mann, before proceeding to the sale of said property, shall enter into a recognizance, with sufficient security, to be approved of by the Orphans' court of Bedford county, for the faithful application of the money arising from said sale, agreeably to the directions of said court.
