Chapter 287.

An act to amend chapter nineteen of the Special Laws of eighteen hundred and seventy

five.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

SECT. 1. The time named in section two of an act entitled "an act additional to an act entitled an act to enable the city of Bangor to aid the Bangor and Piscataquis Railroad Company," approved January twenty-eight, eighteen hundred and seventy-five, for the completion of the line of said company to Moosehead lake, shall be extended to January twenty-seven, eighteen hundred and eighty; and the time named in the fourth section of said act of January twenty-eight, eighteen hundred and seventy-five, within which the said act shall be accepted as provided for in said fourth section, shall be extended to two years from and after the date of the approval of this act.

SECT. 2. This act shall take effect when approved.

Chapter 288.

An act to authorize the Baptist Society in Warren, to transfer all its real and personal property to the Baptist Church in said Warren, and to discontinue the corporate existence of said society.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

Chapter 289.

An act to extend the time for the completion of the Bangor and Piscataquis Railroad. Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

SECT. 1. The Bangor and Piscataquis Railroad Company shall have a further time of three years from January twenty-seven, eighteen hundred and seventy-seven, within which to complete its line of railroad to Moosehead lake.

SECT. 2. This act shall take effect when approved.

Chapter 290.

An act to amend "an act to confirm the location of the railroad of the Boston and Maine Railroad through the towns of Berwick and North Berwick, subject to certain restrictions," approved February first, eighteen hundred and seventy-three.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

SECT. 1. Section one of chapter two hundred and twenty-two of the special laws of Maine, of the year eighteen hundred and seventy-three, "an act to confirm the location of the railroad of the Boston and Maine Railroad through the towns of Berwick and North Berwick, subject to certain restrictions," is hereby amended, by adding thereto, 'except as is hereinafter provided,' so that said section, as amended, shall read as follows:

SECT. 1. The location of the railroad of the Boston and Maine Railroad, a corporation chartered by the laws of this state, from Berwick, and thence through North Berwick, as heretofore filed with the county commissioners of York county, and as said railroad has been constructed, is hereby confirmed and made valid, subject to the provisions of this act, as hereinafter stated. And said corporation is allowed until the first day of August, in the year of our Lord one thousand eight hundred and seventy-three, to make and file, as required by law, an amendment to its former location, so as to make the same conform to its railroad as now constructed; provided nevertheless, that it shall not be lawful, and it is hereby forbidden, to construct, maintain or use any track across the highway known as Main street, at North Berwick village, other than the one now constructed, being one hundred and seventy-two feet from the present passenger depot of the Portland, Saco and Portsmouth Railroad Company, at that place, and a side track, the southerly rail of which shall not be nearer the depot of the Portland, Saco and Portsmouth Railroad Company

SECT. 2. Section two of said act is hereby amended as follows: Sec. 2, amended. 'Provided however, that it shall be lawful for the Boston and Maine Railroad to unite with the Portland, Saco and Portsmouth Railroad Company in constructing, maintaining and using jointly a union depot or way station easterly of the highway known as Main street, at North Berwick village. And if said corporations shall so jointly construct, maintain and use a union depot or way station easterly of said highway, it shall be lawful for said Boston and Maine Railroad to maintain and use the track of its original location across said highway, so long as said corporations jointly maintain and use a union depot or way station, and no longer,' so that said section, as amended, shall read as follows:

'SECT. 2. And it is further provided that it shall not be lawful for said corporation, and it is hereby forbidden, to construct, maintain or use any depot or way station easterly of said highway, at North Berwick village, nor within seven hundred feet of the westerly side thereof; provided however, that it shall be lawful for the Boston and Maine Railroad to unite with the Portland, Saco and Portsmouth Railroad Company in constructing, maintaining and using jointly a union depot or way station, easterly of the highway known as Main street, at North Berwick village. And if said corporations shall so jointly construct, maintain and use a union depot or way station, easterly of said highway, it shall be lawful for said Boston and Maine Railroad to maintain and use the track of its original location across said highway, so long as said corporations jointly maintain and use a union depot or way station, and no longer.'

SECT. 3. This act shall take effect when approved.

Chapter 291.

An act additional to and amendatory of "an act to enable the city of Bangor to aid the Bangor and Piscataquis Railroad Company in the extended construction of its railroad," approved February twenty-two, eighteen hundred and seventy-one.

CHAP. 292. terminus in Abbot, to some point at or near Moosehead lake, and the provisions of an act entitled "an act to enable the city of Bangor to aid the Bangor and Piscataquis Railroad Company in the extended construction of its railroad," approved February twenty-two, eighteen hundred and seventy-one, are hereby continued in force and made applicable in all particulars, to any extension of said line of railroad, which shall be constructed and completed to the satisfaction of the mayor and aldermen of the said city of Bangor, within the time specified above.

SECT. 2. This act shall not take effect or be of any force, unless within one year from the date of its approval it shall be accepted by each branch of the city council of the city of Bangor, and by the legal voters of the city of Bangor, in the manner, in all respects and in all particulars, prescribed in section fourteen of the aforesaid act of February twenty-two, eighteen hundred and seventy-one, for the acceptance of that act. But if it shall be so accepted within one year from its approval, then it shall be in force thereafter, and be binding upon said city of Bangor according to its true tenor and effect, but not otherwise.

SECT. 3. This act shall take effect when approved.

Chapter 292.

An act granting further time to the Northern Aroostook Railroad Company to make and file the location of its line of railroad.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

A further time of one year from January one, eighteen hundred and seventy-seven, is hereby conceded and allowed to the Northern Aroostook Railroad Company, within which to make and file a location of its line of railroad, as provided in the act chartering said company, approved February twenty-five, eighteen hundred and seventy-one.

Chapter 293.

An act to incorporate the town of Haynesville in the county of Aroostook.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

Chapter 294.

An act to authorize the Maine Central Railroad Company to connect its track with the track of the Androscoggin Railroad Company, in the city of Lewiston.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

SECT. 1. The Maine Central Railroad Company is hereby authorized to locate and build a railroad track or tracks, for the use of said company, connecting its road in the city of Lewiston, with the track of the Androscoggin Railroad in said city, and to take and hold the land necessary therefor, in the same manner as May take real is now provided by law for taking land for building railroads ; provided however, that before said land is taken and the road built, a plan of the contemplated location, describing the route over which it is to be built, shall be submitted to the city government government.
