Form of Want of XXXV. And be it further enacted, That where Diftrefs not any Distress shall be made for any Money to be deemed unlevied by virtue of this Act, the Diftrefs itself shall lawful for not be deemed unlawful, nor the Party or Parties Form. making the fame be deemed a Trefpaffer or Trefpaffers on account of any Defect or Want of Form in any Proceedings relating thereto; nor fhall the Party or Parties diftraining be deemed a Trefpaffer or Trefpaffers ab initio, on account of any Irregu larity which shall be afterwards done by the Parties. diftraining, but the Perfon or Perfons aggrieved by fuch Irregularity may recover full Satisfaction for the special Damage only in an Action on the Cafe. Oath to Per XXXVI. And be it further enacted, That at Chairman at any Meeting of the faid Veftry, or the faid Gover- Meetings may nors or Directors of the Poor, or Committee for adminifter an the Watch, or Committee of Paving, or any Sub-fons exacommittee appointed thereby, it fhall and may be mined. lawful to and for the Chairman, or to and for any Juftice or Juftices of the Peace in and for the County of Middlefex, or the City and Liberty of Westminster, who is or are then present, to admi K 3 nister Proceedings not to be quafhed for Want of Form. Inhabitants competent Witneffes. nifter an Oath to any Perfon or Perfons, for the more certain Information and greater Satisfaction of the Veftrymen or Members of fuch Committee, in any Matter of Bufinefs then depending; and if any Perfon or Perfons fhall upon his, her, or their Examination on Oath before the faid Veftry, Governors and Directors, or Committee of the Watch, or Committee of Paving, or any Sub-committee appointed thereby, wilfully and corruptly give falfe Evidence, fuch Perfon or Persons so offending, and being thereof, duly convicted, fhall be, and he, fhe, and they is and are hereby declared to be subject and liable to all fuch Profecutions, Pains and Penalties, as by any Law now in being Perfons convicted of wilful and corrupt Perjury in any of His Majefty's Courts of Record at Westminster are fubject and liable to.. XXXVII. And be it further enacted, That no Order, Verdict, Judgement, or other Proceeding made touching or concerning the Conviction of any Offender or Offenders against this Act, or the faid recited Act of the Twenty-ninth Year of His prefent Majefty, fhall be quathed or vacated for Want of Form only, or be removed or removable by Certiorari, or by any other Writ or Procefs whatfoever, into any of His Majefty's Courts of Record at Westminster, any Ufage, Law, or Statute to the contrary thereof notwithstanding.. XXXVIII. And be it further enacted, That in all Actions, Profecutions, Informations, Caufes, and Proceedings relating to or concerning the Execution of this Act, or in which the faid Parish, or the Inhabitants thereof, or the faid Veftry, Governors and Directors, or Committees, or any of them, them, fhall be a Party or Parties, no Inhabitant of the faid Parifh fhall be deemed incompetent to give Evidence by reafon of his or her being rated by virtue of this Act, or made liable to pay any Rate or Affeffment relative to the faid Parifh, in any wife howfoever, or by being an Inhabitant of the faid Parish, any Law or Ufage to the contrary notwithftanding. this A&t. XXXIX. And be it further enacted, That all the Powers of Powers, Authorities, Provifions, Penalties, For- former A&t feitures, Claufes, Matters, and Things whatfoever extended to contained in the faid recited A&t of the Twentyninth Year of His present Majefty, fo far as the fame are not hereby exprefsly altered and repealed, fhall extend and be conftrued to extend, operate and be in force, with refpect to all Matters and Things whatsoever which may happen or arise in the Execution of this Act, as fully and effectually to all Intents and Purposes as if the fame were repeated and re-enacted in this Act, and made Part thereof. XL. And be it further enacted, That all Cofts, For paying Charges, and Expences attending the obtaining and the Expences paffing this Act, and incident thereto, fhall be paid of this A&t. out of any Money raised or to be raised for the Relief of the Poor, for repairing the Highways, for defraying the Expence of the Beadles, Watchmen, and Patroles, and for paving, repairing, cleanfing, and lighting the Streets and other public Paffages and Places within the faid Parish of Saint George Hanover Square, and out of the first Monies which fhall be collected after the paffing of this Act, in fuch Proportions as the faid Veftry fhall think expedient to order and direct. XLI. And K 4 Publick A&. XLI. And be it further enacted, That this A& fhall be deemed and taken to be a Public A&t, and fhall be judicially taken Notice of as fuch by all Judges, Juftices, and others, without being spe cially pleaded. 103 Aa of Parliament, 29 Geo. 3.
