Foreword

This publication is issued pursuant to the requirement of Section 3 (b) of the Administrative Procedure Act (Public Law 404, 79th Congress, approved June 11, 1946) that all final opinions or orders in the adjudication of cases, regardless of whether they are confidential, which may be cited as precedents shall be made available to to public. Because the records of the Department of Justice and the Immigration and Naturalization Service are regarded as confidential, names of persons will be omitted in these decisions. Except as modified or overruled by the Board of Immigration Appeals or the Attorney General these opinions and orders may generally be cited as authoritative interpretations of existing laws and regulations. Some of the statutes relating to immigration and nationality applied in these decisions, when enacted, vested the authority to exercise certain powers in the Secretary of Labor. By section 1 of Reorganization Plan No. V, effective June 14, 1940 (note following 5 U. S. C. 133t), all functions and powers of the Secretary of Labor relating to the administration of the immigration and nationality laws were transferred to the Attorney General. Certain other powers connected with the administration of these laws have been specifically conferred upon the Commissioner of Immigration and Naturalization. By authority of law the Attorney General has delegated certain of his powers and functions to officers of the Immigration and Naturalization Service and of the Department of Justice. By authority of law the Commissioner has delegated some of his powers and functions to designated officers of the Immigration and Naturalization Service. These delegations have been accomplished through regulations published in Title 8 of the Code of Federal Regulations.

The opinions and orders that are or will be contained in this and future volumes of this publication will therefore be those made by the Attorney General, by the Board of Immigration Appeals (sometimes therein called the Board), by the Commissioner of Immigration and Naturalization, and by certain designated officials of the Immigration and Naturalization Service. The Board of Immigration Appeals derives its authority from sections 90.2 through 90.12, title 8, Code of Federal Regulations. The Commissioner, in addition to the powers conferred upon him specially by statute, promulgates opinions and orders pursuant to 8 C. F. R. 90.1, and officers of the Service whom he may designate with the approval of the Attorney General to perform certain of those functions likewise render opinions. and orders that will be published in these volumes.

This, the first volume of Administrative Decisions under the Immigration and Nationality Laws, contains precedent-creating decisions of the Attorney General and of the Board of Immigration Appeals from the time of the creation of that Board in August of 1940 through the month of December, 1943. Succeeding volumes will be issued at such times in the future as the accumulation of decisions may require and will include not only decisions of the Attorney General and the Board of Immigration Appeals but also decisions of the Commissioner or those acting by his authority. Interim precedent decisions are available for review at places designated in title 8, Code of Federal Regulations.
