CA P. II.

AN Act to facilitate the Administration of Justice respecting Enquêtes in
Civil Matters before the Court of King's Bench for the Districts of
Quebec, Montreal, Three-Rivers, and Inferior District of Saint Francis.

HEREAS it is necessary to facilitate the Administration of Justice in the District of Montreal, in matters relating to Enquêtes in the Superior Terms of the Court of King's Bench for the said District, and also in the Inferior District of St. Francis:-Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Lower-Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of Great Britain, intituled, “ An "Act to repeal certain parts of an Act passed in the fourteenth year of His Majesty's "Reign, intituled, An Act for making more effectual provision for the Government "of the Province of Quebec, in North-America,' and to make further provision for "the Government of the said Province;" And it is hereby enacted by the authority of the same, that upon the expiration of a certain Act passed in the ninth year of the Reign of His late Majesty King George the Fourth, chapter five, intituled, " An "Act to provide for the appointment of Commissaires Enqueteurs for the District of On the Expiration of Act 9, "Montreal, and other purposes relating to the Administration of Justice in the said "District", which will be on the first day of May next, the Enquêtes in causes in the Superior Terms of the Court of King's Bench, for the said District of Montreal, as well as in the Districts of Quebec and Three Rivers, shall be taken before a single Judge, or before more than one Judge of the said Court, as well in Term as bec, Montreal in vacation, and that for that purpose it shall be lawful for the said Judges of the and Three Ri- said Court of King's Bench, in the said Districts of Quebec and Montreal, and Three Rivers, to assign one Room or more than one Room in the said Court House, for the taking of such Enquêtes therein, and to fix the number of Clerks or writers whom the Prothonotaries of the said Court shall employ for the taking of such Enquêtes, accordingly as the case shall require.

'U qu'il est nécessaire de faciliter l'Administration de la Justice en matières civiles dans le District de Montréal, relativement aux Enquêtes dans les Termes Supérieurs de la Cour du Banc du Roi pour le dit District, et aussi dans le District Inférieur de Saint François :-Qu'il soit donc statué par la Très-Excellentė Majesté du Roi, par et de l'avis et consentement du Conseil Législatif et de l'Assemblée de la Province du Bas-Canada, constitués et assemblés en vertu et sous l'autorité d'un Acte passé dans le Parlement de la Grande-Bretagne, intitulé, "Acte qui rappelle certaines parties d'un Acte passé dans la quatorzième année "du Règne de Sa Majesté, intitulé, "Acte qui pourvoit plus efficacement pour le Gouvernement de la Province de Québec, dans l'Amérique Septentrionale;" et qui pourvoit plus amplement pour le Gouvernement de la dite Province;" Et il est par le présent statué par la dite autorité, qu'aussitôt après l'expiration d'un certain Acte passé dans la neuvième année du Règne de feu Sa Majesté George Quatre, chapitre cinq, intitulé, "Acte qui pourvoit à la nomination de Commissaires Enquêteurs pour le District de Montréal et autres objets relatifs à l'Administration de la Justice," lequel cessera d'être en force le premier jour de Mai prochain, les Enquêtes dans les Causes aux Termes Supérieurs de la Cour du Banc du Roi du dit District de Montréal, ainsi que dans les Districts de Québec et des Trois-Rivières, seront prises devant un seul Juge ou plusieurs des Juges de la dite Cour, tant pendant les termes d'icelle que pendant la vacance, et qu'à cet effet il sera loisible aux Juges de la dite Cour du Banc du Roi dans les Districts de Québec, de Montréal et des Trois-Rivières susdits, d'assigner un où plusieurs appartemens dans le Palais de Justice, où les dites Enquètes pourront être prises, et de fixer le nombre de Clercs ou Ecrivains que les Greffiers de la dite Cour seront tenus de fournir aux dites Enquêtes suivant l'exigence des cas.

II. Et qu'il soit de plus statué par l'autorité susdite, que les Juges de la Cour du Banc du Roi siégeant dans les dits Districts de Québec, de Montréal et des TroisRivières, ou aucun d'entr'eux seront autorisés à compter de la passation de cet Acte, et ils sont par le présent autorisés dans tous les cas de procès par Jurés en matières Civiles, d'entendre la contestation de faits, (to try the issue of facts) et recevoir les verdicts des Jurés dans la vacance entre chacun des Termes Supérieurs

III. AN Act to amend an Act passed in the eleventh year of the Reign of His late Majesty, intituled, " An Act to establish Registry Offices in the "Counties of Drummond, Sherbrooke, Stanstead, Shefford, and Missiskoui, and to extend the provisions of the said Act."

THEREAS it is expedient to amend a certain Act passed in the eleventh year of the Reign of His late Majesty, intituled, "An Act to establish Registry "Offices in the Counties of Drummond, Sherbrooke, Stanstead, Shefford, and "Missisquoi, and to repeal a certain section of the said Act":-Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Lower-Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act passed in the fourteenth year of His Majesty's Reign, intituled, An Act for making more effectual provision for the Government of the Province of Quebec, in NorthAmerica,' and to make further provision for the Government of the said Pro"vince;" And it is hereby enacted by the authority of the same, that the eleventh section of the said Act, passed in the eleventh year of the Reign of His late Majesty, and intituled, "An Act to establish Registry Offices in the Counties of Drummond,

de la dite Cour du Banc du Roi, à tels jours qu'ils auront fixés à cet effet dans leurs séances ordinaires, pendant les Termes de la dite Cour, nonobstant toute Loi à ce contraire.

III. Et qu'il soit de plus statué par l'autorité susdite, que les Juges de la Cour du Banc du Roi dans et pour le District Inférieur de Saint François siégeant en icelle, pourront fixer un certain nombre de jours pendant la vacance pour prendre des Enquêtes dans les Causes pendantes devant la dite Cour, et que le Juge Provincial du dit District Inférieur de Saint François, aura tous les pouvoirs quant à la prise d'Enquêtes dans telles Causes, dont sont revêtus par cet Acte un ou plusieurs des Juges de la Cour du Banc du Roi pour le District de Montréal.

IV. Et qu'il soit de plus statué par l'autorité susdite, que cet Acte sera et demeurera en force jusqu'au premier jour de Mai, mil huit cent trente-deux, et pas plus long-tems.

qu'il est expédient d'amender un certain Acte passé dans la onzième année du Règne de feu Sa Majesté, intitulé, Acte pour établir des Bureaux d'Enregistrement dans les Comtés de Drummond, Sherbrooke, Stanstead, Shefford "et Missiskuoi," et de révoquer une certaine Clause du dit Acte :-Qu'il soit donc statué par la Très-Excellente Majesté du Roi, par et de l'avis et consentement du Conseil Législatif et de l'Assemblée de la Province du Bas-Canada, constitués et assemblés en vertu et sous l'autorité d'un Acte passé dans le Parlement de la Grande-Bretagne, intitulé, "Acte qui rappelle certaines parties d'un Acte passé dans la quatorzième année du Règne de Sa Majesté, intitulé, "Acte qui pourvoit plus efficacement pour le Gouvernement de la Province de Québec, dans l'Amérique Septentrionale;" et qui

Sherbrooke, Stanstead, Shefford, and Missiskoui," which said section is in the words following: "And be it further enacted by the authority aforesaid, that every Registrar for each of the aforesaid Counties, shall keep duplicate copies of all such "books and alphabetical indexes, as are directed to be kept for each of the "Counties aforesaid, by this Act, which every such Registrar or his deputy or clerk,shall on before the thirty-first day of December, in each and every year, convey or cause to be conveyed to the office of the Provincial Secretary, for such purposes as to Justice it may appertain," shall be and the same is hereby repealed,

II. And be it further enacted by the authority aforesaid, that every person owning or claiming to own any landed or immoveable property whatsoever, situate within any of the said Counties of Drummond, Sherbrooke, Stanstead, Shefford, and Missiskoui, by virtue of any Act or Deed in Law, or instrument in writing, executed before. the passing of the Act herein cited and amended, except the Letters Patent of His Majesty, shall before the first day of May, one thousand eight hundred and thirty two, enregister the same in the Registry office of the County in which such land or immoveable property shall be situate, and every such legal instrument which shall not be so enregistered shall be utterly void and of no effect whatsoever against subsequent purchasers for a valuable consideration.

III. And be it further enacted by the authority aforesaid, that all the provisions of and amended, the Act herein before cited and amended, shall extend to all such lands and other the Counties of immoveable property as are or shall be hereafter held in free and common soccage in Ottawa, Beau- the Counties of Ottawa, Beauharnois, and Mégantic.

IV. And be it further enacted by the authority aforesaid, that from and after the passing of this Act, no act or deed in law, or instrument in writing, by which a Mortgage or hypothéque has been or is created, shall bind or effect as a Mortgage, incumbrance or hypothéque, nor shall any Act, Deed, or Instrument in Law, operate or bind as a conveyance, any land or immoveable property situate within any of the said Counties of Ottawa, Beauharnois, and Mégantic, save and except all such land or immoveable property as is or may be held en titre de fief within the same, unless the said Act, Deed or Instrument in Law, be enregistered in the Registry Office for the County in which the said land or immoveable property is situate, within one year from and after the passing of this Act.
