VI. VII. VIII. Provided always, and be it enacted by the authority aforefaid, That none of the commiffioners to be appointed purfuant to this act, fhall incur any penalties, forfeiture, incapacity or disability whatsoever, for putting this act in execution. Vide 3 Geo.I. c.14. & 5 Geo. 1. c.20.

CAP. XXVIII.

An alt for repealing an act, intituled, An act for repealing part of an act paffed in the parliament of Scotland, intituled, Act for difcharging the Yule vacance.

WHE

HEREAS by an act passed in the tenth year of her late majefty Queen Anne, of blessed memory, intituled, An act for repealing part of an act paffed in the parliament of Scotland, intituled, An for discharging the Yule vacance; it was enacted and declared, That the Christmas vacation of the feffion or college of justice, and all other inferior courts of justice in that part of Great Britain called Scotland, fhall yearly, in all time coming, continue and endure from the twentieth day of December to the tenth of January, both inclufive: and whereas alfo the faid vacation has been by experience, found to be a great interruption to the course of business and administration of justice, and greatly prejudicial to the fubjects of that part of Great Britain: be it therefore enacted by the King's moft excellent majesty, by and with the advice and confent of the lords fpiritual and temporal and commons, in this present parliament affembled, and by the authority of the fame, That the aforefaid act paffed in the tenth year of her late majesty Queen Anne, fhall be and is hereby repealed and made void.

CAP. XXXIII.

An act for the more eafy and speedy trial of fuch persons as have levied or shall levy war against his Majefty.

WH

HEREAS a horrid and unnatural rebellion and war has been openly and traiterously raised and levied against his Majesty within this realm, and is ftill continued, with defign to depofe and murder his most facred Majefty, and to fet a popish pretender, bred up and inftructed in Romish fuperftition and arbitrary principles, on the throne of these realms: and whereas great numbers of fuch as have joined in the faid rebellion, have been, by his Majesty's vigilance and care, lately feized, and for fafer custody neceffarily distributed into feveral prifons in different counties: and whereas many of the chief of the faid rebels have been, in order to lay open and difcover the foundations and caufes of the faid rebellion and treafons, with much trouble and expence to the crown, brought up to London, and parts adjacent,

in order to be examined: and forafmuch as bills of indictment, as the law now flands, are to be found in the counties where the faid treafons are committed: but as it will be very inconvenient to the publick justice of the nation, that the judges should remain fo long in the faid counties as will be neceffary for the trying of the faid offenders, fo it will be very burthenfome and grievous to the freeholders of the fame counties to attend so many trials as may be neceffary to be had for the fafety of the publick: to the end therefore that the faid offenders may not conceive any hope of impunity from the distance of the feveral counties. where the faid treafons are committed, or from any power or interest they may have therein, and that juftice may more fpeedily and fecurely be adminiftred against the said offenders, and proper examples made, in fuch feafonable time as may be a means to fupprefs the remains of the faid rebellion, and preferve the peace and tranquillity of thefe kingdoms: be it enacted, &c.

All perfons in cuftody for high treafon before Jan. 23, 1716, may be tried in fuch thire as his Majefty fhall direct. And no challenge for the hire fhall be allowed. Peers fhall be tried by their peers. The place of indictment or trial not to be altered, unless the perfons indicted have been in

actual rebellion. EX P.

An act for preventing mutiny and delertion, and for the better payment of the army and their quarters. EXP.

CAP. XXXV.

An act to appoint a commiffioner for taking, examining and stating the debts due to the army, in the room of Thomas Smith, Efq; deceased; and for continuing the former act until the tenth day of March one thousand seven hundred and fixteen. EXP.

CAP. XXXVI.

An act for charging and continuing the duties on malt, mum,
cyder and perry, for the fervice of the year one thousand
feven hundred and fixteen; and for compelling several re-
ceivers to finish and clear their accounts; and for making
duplicates of Exchequer-bills, lottery-tickets and orders,
loft, burnt or destroyed; and for enlarging the time for ad-
jufting claims to certain benefit-tickets; and for allowing
the charge of executing the lottery-alt, for the service of
the year one thousand feven hundred and ten; and for re-
covering monies of several land-taxes, refting in the hands
of collectors or conftables at St. Albans; and for prevent-
ing frauds in the duties upon fope; and for limiting a
time for persons who have certain annuities for life or lives,
to demand the payments thereupon at the Exchequer; and
for preventing frauds in the duties relating to printed and
painted paper, callicoes, and other things therein mentioned.

er imported into the fame: it is enacted, That if any makers of fope 10 Ann. c.19 fball fraudulently hide or conceal, or caufe to be hid or concealed, any Jope chargeable by the said act, or any the materials for making the fame, to the intent to deceive her Majesty of the just duties by the faid act granted, that then, and in every fuch cafe, the party so offending Shall forfeit for every fuch offence the fum of twenty pounds: and whereas by one other act made in the twelfth year of the reign of her faid late Majefty, amongst other things, for laying additional duties on 12 Ann. ftat.2. Sope, farther duties are granted upon fope; and by the faid last men- c. 9. tioned act it is amongst other things enacted, That all the powers, authorities, rules, directions, penalties and forfeitures, claufes, matters and things whatsoever, contained in the faid act of the tenth year of her faid Majefty's reign, for raising, receiving, levying, recovering, fecuring and paying the faid duties on fope, as are by the said last mentioned act charged with new or additional duties thereupon, should be continued, practised and put in execution, for raising, receiving, levying, recovering, fecuring and paying the fame new or additional duties by the faid laft mentioned at granted, and all arrearages thereof, as fully and effectually, to all intents and purposes, as if they were particularly and at large repeated in the body of the faid laft mentioned act; except in fuch cafes only where any alteration therein is fpecially made by the faid laft mentioned act, as by the said several acts more at large may appear: and whereas the penalties by the before-mentioned acts provided, to prevent the hiding and concealing of sope, have by experience been found ineffectual, and not fufficient to prevent or restrain the fraudulent hiding and concealing thereof, in regard the duties of one boiling of fope fo hid and concealed, may and often do amount to fifty pounds or more, whereby fome ill-difpofed perfons have been encouraged and induced to hide and conceal feveral great quantities of fope, to the great diminution of the revenues arifing by the duties laid upon fope, and to the great difcouragement of other fair traders and makers of fope, who duly pay the full duties upon fope, according to the true intent and meaning of the faid feveral recited acts: for remedy whereof, be it further enacted by the authority aforefaid, That After 16 April if at any time after the fixteenth day of April in the year of our 1716. concealLord one thousand feven hundred and fixteen, any maker of ing fope, &c. fope fhall fraudulently hide and conceal, or caufe to be hid or and the fope. forfeits 500 1. concealed, any fope chargeable by the said several recited acts, or any the materials for making the fame, to the intent to deceive his Majesty of the just duties by the faid acts granted, that then and in every such case the party or parties offending,. fhall forfeit the fum of five hundred pounds for every fuch offence, and also all the fope fo hid and concealed.
