panies, hose companies, hook-and-ladder companies, steamengine companies, and bucket companies, as they may deem necessary; to provide such companies with necessary and proper buildings, engines, and other implements: Provided, Proviso.. That such steam engines shall first be directed to be purchased by a majority vote of the tax-payers of said city, at a meeting to be called by the common council for that purpose; and the members of such companies shall be excused from the payment of poll-tax in said city, shall be excused from all duty in the militia in time of peace, and also from serving on any jury in any of the courts in session in the county of Montcalm; and upon the breaking out of such fire the chief engineer and his assistants, the marshal, and constables of said city may require the assistance of bystanders to aid and assist such companies in extinguishing the fire or fires, to prevent any goods or property from being stolen or injured, and in protecting, conveying, and securing the same; and in case any bystander shall willfully refuse or neglect to comply with such requirements he shall be punished in the manner provided by the by-laws and ordinances of said common council, who are hereby authorized to pass such by-laws and ordinances in relation thereto as they may deem necessary;

moneys received and expended by them in their corporate capacity during the year or other period next preceding such publication, previous to which they shall audit and settle the accounts of the treasurer and collector, and the accounts of all other persons having claims against the city; which statement shall fully set forth the appropriations made by said common council, the amount of money expended, the amount of taxes raised, the expenses of the fire department, the amount expended on streets, and all such information as shall be necessary to a full and perfect understanding of the financial concerns of the city.

Sec. 61. All ordinances, by-laws, and resolutions of the corcontinue in poration of the president and board of trustees of the village of Greenville which are in force at the time of the passing of this act, shall remain in full force and effect as if passed under the provisions of this act, until repealed, amended, or revised by any common council elected under this act: Provided, That they do not contain anything repugnant to the provisions of this act.

MISCELLANEOUS PROVISIONS.

Sec. 62. The township clerk of the township of Eureka furnish list shall, at least fifteen days prior to the election, furnish the clerk of the village of Greenville with a list, duly certified by him, of all the voters registered in said township, residing within the limits of the city hereby incorporated, and said village clerk shall thereupon make and deliver to the inspectors of each ward a copy of such list; and said inspectors shall, from such list so furnished, and from actual canvass, make a list of the qualified electors in each ward, and enter their names and residence in a book to be furnished for that purpose; and such book shall be the register of electors for such ward, and immediately after the election shall be deposited with the clerk of the city.

Sec. 63. The chairman of the board of inspectors of each Registration ward shall, on Saturday preceding the election, meet at the office of the township clerk of said township of Eureka, for the purpose of completing the list of qualified voters for each ward, at which session it shall be the right of any person who will be an elector at such election, and whose name is not already registered, to have his name entered in the register for the ward in which he resides.

Sec. 64. The township clerk of said township, of Eureka Township shall continue to perform the duties of clerk of said township until his successor is elected and qualified; and when his successor shall have been duly qualified, he shall deliver to him all of the books, papers, and furniture of his office, except chattel mortgages upon property within the limits of the city. Such mortgages, with a book containing the entry of the same, shall be delivered to the city clerk, with whom all personal mortgages upon property in said city shall be hereafter filed.

Sec. 66. All acts heretofore enacted in regard to the village of Greenville, coming within the provisions of this act, are hereby repealed: Provided however, That the repealing of said acts shall not affect any act already done, right accruing or acquired, or proceeding had or commenced, or tax sale made by virtue thereof, or by virtue of any by-laws, ordinances of the president and board of trustees of the village of Greenville, passed in conformity therewith, but the same shall remain as valid, and may be proceeded in, as if the said laws hereby repealed, and every one of them, had remained in full force.

SCHOOL DISTRICT NUMBER THREE.

Sec. 67. This act shall not be construed so as to change, alter, or annul any act passed for the organization or government of school district number one of the township of Eureka, of the laws of eighteen hundred and sixty-seven, of the State of Michigan, entitled "An act to authorize school district number one, of the township of Eureka, in the county of Montcalm, to borrow money and negotiate its bonds therefor." Sec. 68. The officers of the village of Greenville shall continue in office until the election and qualification of the corresponding officers provided for in this act.

Sec. 69. This act shall take immediate effect.

AN ACT to incorporate the city of Hastings.

SECTION 1. The People of the State of Michigan enact, That all that portion of the township of Hastings, in the county of ̧ Barry, known and described as the entire sections seven (7) and eight (8), the entire sections seventeen (17) and eighteen (18), the north half of sections nineteen (19) and twenty (20), the west half of the west half of section sixteen (16), and the west half of the northwest quarter of section twenty-one (21), be and the same is hereby detached and set off from said township of Hastings, and erected into and declared to be a city by the name of the city of Hastings, by which name it shall be hereafter known.

Sec. 2. The inhabitants of said city from time to time shall be and continue a body corporate and politic, to be known and distinguished by the name and title of the city of Hastings, and shall be and are hereby made capable of suing and

being sued, of pleading and being impleaded, of answering and being answered unto, and of defending and being defended, in all courts of law and equity, and in all other places whatsoever; and may have a common seal, which they may alter and change at pleasure; and by the said name shall be and are hereby made capable of purchasing, holding, conveying, and disposing of any real or personal estate for said corporation.

Sec. 3. Said city shall be divided into four wards, as follows: wards. The first ward shall embrace all that portion of the city lying north of the Thornapple river; the second ward shall embrace all that portion of the city lying south of said river, and east of Fall creek; the third ward shall embrace all that portion of the city lying south of said river, west of said creek, and east of Church street, and the continuous line thereof; the fourth ward shall embrace all that portion of the city lying south of said river, and west of Church street, and the continuous line thereof.

Sec. 4. The following officers shall be elected from among officers. the qualified electors of said city, to wit: One mayor, one recorder, who shall be ex-officio city clerk and school inspector, one treasurer, one supervisor, two school inspectors, and four justices of the peace; and such officers shall be elected in the following manner: The mayor, recorder, treasurer, and supervisor shall be elected on the first Monday in April, and shall be chosen for one year and until their successors are elected and qualified; there shall at the same time be one school inspector elected for two years and until his successor is elected and qualified: Provided, That at the first election Proviso held under this act, two school inspectors shall be chosen, one school infor the full term of two years, and the other for the short term of one year; there shall also be elected annually, one justice of the peace, for the full term of four years: Provided Proviso also, That at the first election held under this act, there shall justices. be elected so many justices of the peace as may be necessary
