the peace of said township of Hudson shall have power, in all Justices of cases where by the provisions of this act, or of any by-law or try cases for ordinance made in pursuance thereof, any person may be sentenced to imprisonment, to imprison in the county jail of the county of Lenawee. AN ACT to amend sections one, fifteen, twenty-two, thirty, thirty-four, thirty-eight, forty-three, and sixty-four, of act entitled "An act to charter the village of New Baltimore," approved March twenty-third, eighteen hundred and sixtyseven, as amended by act number two hundred and ninetysix, session laws of eighteen hundred and sixty-nine. SECTION 1. The People of the State of Michigan enact, That Sections sections one, fifteen, twenty-two, thirty, thirty-four, thirtyeight, forty-three, and sixty-four, of an act entitled "An act to charter the village of New Baltimore," approved March twenty-third, eighteen hundred and sixty-seven, as amended by act number two hundred ninety-six, session laws eighteen hundred and sixty-nine, be and are hereby amended so as to read respectively as follows:

SECTION 1. The People of the State of Michigan enact, That Boundaries. all that tract of country including the docks, wharves, storehouses, and waters within the following boundaries: Commencing at the northeast corner of fractional section twelve, in

township three north, of range fourteen east, in the county of Macomb; thence west to northeast corner of the west half of the east half of section eleven in said township; thence south in east line of said west half of the east half of said section eleven to south line of said section eleven; thence east forty rods; thence south to private claim three hundred and fortythree; thence to west corner of said private claim; thence southeasterly on the line of said private claim to where it intersects the section line between fractional sections thirteen and fourteen, in aforesaid township; thence south on line between said sections thirteen and fourteen and sections twenty-three and twenty-four, to the so-called Anchor Bay, part of Lake St. Clair; thence southeast to the deepest water or channel of said Anchor Bay; thence northeasterly, thence northerly, thence westerly, by the deepest water of said bay, to the north border of said Anchor Bay, where a line extending southeasterly through the center of private claim six hundred twenty-seven intersects said border; thence northwesterly, passing through the center of said private claim six hundred and twenty-seven, to the northwest side line of said private claim six hundred and twenty-seven; thence northeasterly on said line to the north corner of said private claim six hundred and twenty seven; thence westerly to the place of commencement, be, and the same is hereby constituted a village corporate, to be known by the name of the village of "New Baltimore."

Sec. 15. Notice of the time and place of holding any election shall be given by the village recorder, five days before such election, by posting such notice in three public places in said village, and by publishing the same in a newspaper if there be one printed in said village; and in case of a special election, such notice shall set forth the purpose and object of the election as fully as the same is set forth in the resolution Opening and appointing such election; and on the day of election held by closing of polls. virtue of this act, the polls shall be opened at nine o'clock in

Sec. 22. It shall be the duty of the president to preside at all Duties and meetings of the common council, and he shall be the chief president. executive officer of the village. It shall be his duty to cause the appointed officers of said village to comply with, and faithfully discharge their official duties, and cause all laws pertaining to the municipal government of said village, and all ordinances, resolutions and regulations of the common council, to be observed and executed, and to exercise supervision and control over the conduct of all such officers as may be appointed by the common council, and to examine all complaints against them for neglect of duty; to recommend to the common council such measures as he shall deem expedient; to expedite such as shall be resolved upon by them, and, in general, to maintain the peace and good order, and advance the prosperity of the village; and whenever, in his opinion, the peace and safety of the inhabitants of the village require it, he may at any time appoint one or more policemen as watchmen, who shall be conservators of the peace, and who shall have the same power to make arrests and suppress disturbances as is conferred by this act upon the village marshal.

Sec. 30. In the proceedings of the common council, each votes of member present shall have one vote, and when there shall be council. a tie, the president shall give the casting vote. Whenever required by two members, the votes of all the members of the common council, in relation to any act, proceeding, or proposition had at any meeting, shall be entered at large in the minutes; and such vote shall be so entered in relation to the adoption of any resolution or ordinance, report of a committee, or other act for taxing or assessing any property in said village, or the citizens of said village. Sec. 34. The marshal, and any member of the common council, may require the assistance of all bystanders in extinguishing any fire in said village, and in the removal, preservation, and protection of any property endangered thereby, and in tearing down or in any way destroying and removing any building to stop any fire or to prevent its spreading; and in case any bystander shall willfully neglect to comply with such requirements, he shall be punished as provided by the by-laws or ordinances of said village; and the common council are hereby authorized to make such by-laws and ordinances in relation thereto as they may deem necessary.

Sec. 38. The common council shall have power to assess and levy at any time a special tax on any lands, lots, premises, and subdivisions thereof, which the common council shall, by resolution duly passed, decide should be assessed to defray all or any part of the expenses for making, grading, graveling, macadamizing, paving, planking, opening, draining, and repairing streets, roads, highways, lanes, and alleys, and for putting curb-stones and culverts therein, for grading, paving, planking, constructing, and repairing sidewalks, for draining low lands, whenever in the opinion of the common council the drainings shall be necessary to prevent disease or promote the health of the inhabitants of said village, for making drains. ditches, culverts, and sewers, and any other local improvements, in any way or manner the common council may judg best, upon the lots, premises, and subdivisions thereof, which are in front of or adjoining to any such alleys, streets, roads, and highways, sidewalks, drains, ditches, sewers, and other improvements, and upon other lands, lots, and premises which in the opinion of the common council are benefited thereby, and to make and define taxing districts for such purpose; the common council shall have power to make all by-laws and ordinances relative to the mode of assessing, levying, and

Sec. 43. Any poll-tax or tax upon the owners or keepers of dogs, authorized by this act, may be included in said assessment roll, and the last column of said roll shall contain the total amount of taxes asssessed, to be included in said last column.
